13-08-21 First they came for... and I was silent!

First they tortured a U.S. citizen and gang member …
I remained silent;
I wasn’t a criminal
Then they tortured a U.S. citizen, whistleblower and navy veteran …
I remained silent;
I wasn’t a whistleblower
Then they locked up an attorney for representing accused criminals …
I remained silent;
I wasn’t a defense attorney
Then they arrested a young father walking with his son simply because he told Dick Cheney that he disagreed with his policies …
I remained silent;
I’ve never talked to an important politician
Then they arrested people for demanding that Congress hold the President to the Constitution …
I did not speak out;
I’ve never protested in Washington
Then they arrested a man for holding a sign …
I held my tongue;
I’ve never held that kind of sign
Then they broke a minister’s leg because he wanted to speak at a public event …
I said nothing;
I wasn’t a religious leader
Then they shot a student with a taser gun and arrested him for asking a question of a politician at a public event …
I remained silent;
I wasn’t a student
Then they started labeling virtually every innocent and normal behavior as marking Americans as “potential terrorists” 
I remained silent;
I didn’t want to be called a terrorist
Then they threw political dissenters in psychiatric wards …
I remained silent;
I didn’t want to be seen as crazy
Then they declared that they could label U.S. citizens living on U.S. soil as “unlawful enemy combatants” and imprison them indefinitely without access to any attorney …
I remained silent;
I didn’t want to be labeled an enemy
Then they assassinated an American citizen without any court trial
And they killed his son because he should have had a “far more responsible father” …
I remained silent;
I live on American soil
Then they declared that they could assassinate U.S. citizens living on U.S. soil without any due process of law(update) …
I remained silent;
I didn’t want to be on the list
Then they forced down the airplane carrying the president of a sovereign nation, because they were looking for a whistleblower
I remained silent;
I’m not a foreign leader
Then they called for the founder of an independent publisher to be killed by drone
I remained silent;
I don’t want to worry about drone strikes against me
Then they started spying on all Americans, even though top experts say that doesn’t protect us from terrorism
I remained silent;
I didn’t want to call even more attention to myself from the spies
Then they detained the gay partner of an investigative journalist for 9 hours under terrorism laws – and denied him the right to call a lawyer – as a way to intimidate the journalist
I remained silent;
I’m happily married to a woman
When they came for me,
Everyone was silent;
there was no one left to speak out.

America No Longer Has a Functioning Judicial System

The Separation of Powers Which Define Our Democracy Have Been Destroyed

The Department of Justice told a federal court this week that the NSA’s spying “cannot be challenged in a court of law”.
(This is especially dramatic given that numerous federal judges and legal scholars – including a former FISA judge – say that the FISA spying “court” is nothing but a kangaroo court.)
Also this week, the Department of Justice told a federal court that the courts cannot review the legality of the government’s assassination by drone of Americans abroad:
“‘Are you saying that a US citizen targeted by the United States in a foreign country has no constitutional rights?’ [the judge]  asked Brian Hauck, a deputy assistant attorney general. ‘How broadly are you asserting the right of the United States to target an American citizen? Where is the limit to this?’
“She provided her own answer: ‘The limit is the courthouse door’ . . . .
“‘Mr. Hauck acknowledged that Americans targeted overseas do have rights, but he said they could not be enforced in court either before or after the Americans were killed.’”
(Indeed, the Obama administration has previously claimed the power to be judge, jury and executioner in both drone and cyber-attacks.  This violates Anglo-Saxon laws which have been on the books in England and America for 800 years.)
The Executive Branch also presents “secret evidence” in many court cases … sometimes even hiding the evidence from the judge who is deciding the case.
Bush destroyed much of the separation of powers which made our country great.  But under Obama, it’s gotten worse.
For example, the agency which decides who should be killed by drone is the same agency which spies on all Americans.
After Pulitzer Prize winning journalist Chris Hedges, journalist Naomi Wolf, Pentagon Papers whistleblower Daniel Ellsberg and others sued the government to enjoin the NDAA’s allowance of the indefinite detention of Americans – the judge asked the government attorneys 5 times whether journalists like Hedges could be indefinitely detained simply for interviewing and then writing about bad guys. The government refused to promise that journalists like Hedges won’t be thrown in a dungeon for the rest of their lives without any right to talk to a judge
It’s not just the Executive Branch which has attacked the courts.  For example, Congress passed a billstripping courts of the power to review issues related to genetically modified foods.
The Constitution is mortally mounded.  While the “war on terror” is commonly cited as the excuse, most of the attacks on our rights started before 9/11.  Indeed, the Founding Fathers warned 200 years ago that open-ended wars give the Executive an excuse to take away our liberties.
Two former U.S. Supreme Court Justices have warned that America is sliding into tyranny.   A formerU.S. President, and many other high-level American officials agree.
In addition to attacks on the judiciary by the White House and Congress, judges are voluntarily gutting the justice system … and laying down in lapdog-obeisance to D.C.
For example, the Supreme Court ruled that if judges don’t like plaintiffs’ allegations of bad government actions, the judge can simply pre-judge and throw out the lawsuit before even allowing the party to conduct any discovery to prove their claims.   This guts 220 years of Constitutional law, and makes it extremely difficult to challenge harmful government action in court.

America's assault on a free press moves into high gear: Detention of Greenwald Partner Clearly Came on US Orders

It is becoming perfectly clear that the outrageous detention of American journalist Glenn Greenwald's Brazilian partner David Miranda by British police during a flight transfer at London's Heathrow Airport was, behind the scenes, the work of US intelligence authorities.
British police and the British Home Office (the equivalent of America's Department of Homeland Security) are claiming that the action was taken by them on the basis of an anti-terrorist statute, passed in 2000, with the Orwellian name "Schedule 7." The give-away that this was not something that the British dreamed up on their own, however, is their admission that they had "notified Washington" of their intention to detain Miranda, a Brazilian national, before the detention actually occurred.

Britain forced Guardian to destroy copy of Snowden material


The editor of the Guardian, a major outlet for revelations based on leaks from former U.S. intelligence contractor Edward Snowden, says the British government threatened legal action against the newspaper unless it either destroyed the classified documents or handed them back to British authorities. In the building's basement, Guardian editor Rusbridger wrote, government officials watched as computers which contained material provided by Snowden were physically pulverized. 'We can call off the black helicopters,' Rusbridger says one of the officials joked.
