משה סילמן, נט המשפט, ומחוזי תל-אביב – מערכת ספרים כפולים – טבלת סיכום // S-12-11-24 Silman, Net HaMishpat, and the Tel-Aviv District Court – a double books system – table summary


The records, which were discovered in the office of the clerk's case management system under the purported appeal file (6909-01-10) on November 19, 2012, are different that the records that are displayed in the online public access system. Only one (1) out of eight (8) decisions appears in the online public access system, and none of the decisions, which are listed in the Court's case management system were served on the Requester.  Such decisions should all be deemed simulated decisions. The case of Moshe Silman uniquely documents the way that new electronic record systems in the Israeli courts and Net HaMishpat in particular, are used as "double books", out of compliance with basic notions of Fair and Public Hearings and national tribunals for protection of Rights.  Over the past decade, in parallel to the implementation of new electronic record systems, the courts of the State of Israel were corrupted in an unprecedented manner.  During this period Aharon Barak and later Dorit Beinisch served as Presiding Justices of the Supreme Court.

ההחלטות שהתגלו בביקור במערכת ניהול הכתבים האלקטרוניים במזכירות בית המשפט ביום ה-19 בנובמבר., 2012, תחת תיק הערעור כביכול (6909-01-10) שונות מן הכתבים המוצגים במערכת המקוונת לניהול גישת הציבור לתיקים במקרה זה.  רק אחת משמונה (8) ההחלטות, הרשומות במערכת ניהול הכתבים האלקטרוניים במזכירות מופיעה גם במערכת המקוונת לניהול גישת הציבור לתיקים, ואף לא אחת מן ההחלטות לא הומצאו ונמסרו למבקש בעניין זה. מקרהו של משה סילמן חשף בצורה ייחודית  את הדרכים בהן מערכות הכתבים האלקטרוניים של בתי המשפט בישראל, ובמיוחד נט המשפט, משמשים כ"ספרים כפולים", תוך הפרת מושגי היסוד לגבי משפט הוגן וציבורי ובתי משפט לאומיים להגנה על זכויות.  בעשור האחרון, במקביל להנהגת מערכות כתבים אלקטרוניים חדשות, הושחתו בתי המשפט בישראל בצורה חסרת תקדים. בתקופה זאת כיהנו כנשיאי בית המשפט העליון אהרון ברק ודורית בייניש.

The Table, below, shows:
·         Six (6) purported decisions of the Court, which were not served and delivered on the Requester in this matter.
·         At least one (1) case, possibly two, of deliberate ex-parte communications between the Court and other parties in the case through requests and decisions, which were not served and delivered on Dr Zernik- the Requester in this matter.
·         The existence of at least one (1) more recent purported decision of the Court, on an unknown request, which was never served on Dr Zernik, and which was not discovered during the November 19, 2012 visit to the office of the Clerk of the Court.
Interaction with the office of the clerk, which led to the discovery of the records on November 19, 2012, also documented:
  • Refusal of the office of the clerk to permit access to the list of records (docket) in a case, even to a party to the matter.
  • Refusal of the office of the clerk to permit access to the listings, which certify service by the Court of its own records.
  • Refusal of the office of the clerk to permit access to listing, which certify the assignment of the case to the appropriate judicial authority.

מקרה אחד (1) לפחות, ייתכן שניים, בו ניהל בית המשפט תכתובת עם צד אחד בלבד על ידי בקשות והחלטות שלא הומצאו ונמסרו למבקש, דר' צרניק.
קיומה של החלטה אחת (1) לפחות מן החדשים האחרונים, בעניין לא ידוע, שלא נמסרה לדר' צרניק, ושלא נתגלתה במהלך הביקור במזכירות ב-19 לנובמבר, 2012.

בית המשפט מסרב להתיר לבעל העניין לעיין ברישום, המאשר את הפניית התיק לגורם השיפוטי המתאים.
