13-06-19 Israel: Judge Esperanza Alon (Haifa Magistrate Court) refuses to respond on evidence of her own corruption

Judge Alon was presented with detailed, credible evidence of fraudulent registration in the Index of All Cases and in the Calendar of the Court, the issuance and service of simulated judicial records, and the conduct of simulated court proceeding.  Such conduct was aimed at fraudulently bringing a person to court.  Judge Alon persistently refuses to respond on the evidence and to provide a reasonable explanation for her conduct.  In a civilized society such conduct should be considered criminal - white collar organized crime by attorneys, judges, and clerks.

Through such fraud, attempt was made to falsely summon the recipient to court.

Occupy Tel Aviv Encampment, June 19 - Dr Joseph Zernik of Human Rights Alert (NGO) published Judge Esperanza Alon's May 26, 2013 decision regarding evidence of her own corruption. [1] In her decision, Judge Alon of the Haifa Magistrate Court refuses to comment on the evidence itself. Instead, Judge Alon says:  "It is a well-known rule that whoever files in court should use appropriate respectful language. Pursuant to Regulation 91(a) of the Regulations of Civil Court Procedures and based on my authority and discretion, I order the striking of the Request/Notice for its inappropriate language."

Judge Alon's May 25, 2013 decision was issued in response on a declaration, filed by Dr Zernik, which details evidence of criminal conduct in the Court, including fraudulent registrations in the Index of All Cases and the Calendar of the Court, conduct of simulated court proceeding and the issuance and service of simulated court decisions. [2] Such conduct was aimed at falsely summoning Dr Zernik to Judge Alon's court.

At the center of the evidence are two different and contradictory March 17, 2013 decisions, which were issued and served on behalf of Judge Alon, and were aimed at fraudulently summoning the recipient, Dr Zernik to Judge Alon's court:
  • Judge Alon refuses to state, which of the decisions is valid and which is void.
  • Mr Israel Hen, who appears as "Chief Clerk" of the Haifa Magistrate Court, albeit with no lawful appointment record, refuses to certify either decision "True Copy of the Original".
  • Attorney Amos Zadika, who appears as the Conservator's Counsel in the matter. served both decisions, claiming that decision A was void, and decision B was the valid, corrected decision.
  • Court employee issued a letter, albeit with no lawful authority, claiming that decision B was void, and decision A was the corrected valid decision.
Judge Alon responded on previous evidence of obstructionist conduct in her May 6, 2013 decision, which says that a person, who is not a legal scholar, would find it difficult to understand the "mystical secrets of court procedures". [3]

In his May 22, 2013 Declaration, [2] Dr Zernik replies that a reasonable person, upon review of the evidence, is likely to conclude that Judge Alon is not a master of the "mystical secrets of court procedures", but "obstructionist with impunity" - worlds used by the self-immolated, social protest activist Moshe Silman in his last letter to describe the conduct of Judge Hagai Bernner and the Tel Aviv District Court. Following Judge Alon's refusal to respond on the May 22, 2013 Declaration, a repeat declaration was filed today, hoping that its language would be found "appropriate" by Judge Alon, and that she would finally provide explanation for her conduct in these court files. [4] 

In parallel, Judge Alon continues to deny access to the corresponding court records, to a person, that according to Judge Alon is a party to the case.  Dr Zernik claims that inspection of the court files would uncover additional evidence of fraud and obstruction of court process. [4]

Judge Alon has gained notoriety in the past as well:
  • Judge Esperanza Alon wanted to judge an attorney, who was her former employee - but was recused by the Israeli Supreme Court for material concern of bias. [5]
  • Divorced fathers claimed retaliatory conduct by Judge Alon. [6]
  • Protests were conducted in front of Judge Alon's home by divorced fathers. [7]
Of particular concern is the fact that her past conduct in another case was claimed to involve retaliation against a social activist.
The Israeli courts have experience unprecedented corruption over the past decade under the tenure of Aharon Barak and Dorit Beinisch as Presiding Justices, and corruption of the courts is central to the socio-economic crisis in Israel.

The Human Rights Alert (NGO) submission was incorporated into the UN Human Ritghts Council Report (2013) on Human Rights in Israel with a note referring to "lack of integrity in the electronic records of the Surpreme Court, the disrtrict courts and the detainees courts in Israel".
