13-07-16 Criminal complaint filed against Magistrate Judge Hagai Brenner and others in the Tel Aviv District Court // תלונה פלילית הוגשה במשטרת ת"א נגד הרשם חגי ברנר ואחרים

משטרת ת"א קבלה תלונה ופתחה תיק חקירה לעניין "שיבוש הליכי משפט מתוך התנשאות" נגד הרשם חגי ברנר ואחרים בבית המשפט המחוזי, ת"א, בעניין משה סילמן ז"ל

מאהל המחאה, ת"א, 16 ביולי - משטרת ישראל, תחנת לב-תל אביב, קבלה היום תלונה ופתחה תיק חקירה מס 313980/2013  נגד הרשם חגי ברנר ואחרים  בבית המשפט המחוזי, ת"א, לעניין "שיבוש הליכי משפט מתוך התנשאות", בעקבות מכתבו האחרון של משה סילמן ז"ל.  עיון בתיקים גילה ראיות לכאורה המאששות את טענותיו של סילמן.

עפ"י עצת עו"ד דן יקיר מן האגודה לזכויות האזרח בישראל, חייב היועץ המשפטי לממשלה לאשר קיום חקירה מסוג זה נגד שופט.

בהתאם, נשלח העתק התלונה עם מכתב ליועץ המשפטי, עו"ד יהודה ויינשטיין, הדורש שיורה למשטרה לחקור את התלונה.  

ללא לחץ ציבורי, קרוב לוודאי שהיועץ המשפטי לא יפעל בנידון.  לפיכך, נפתחה עצומה ציבורית הדורשת מן היועץ המשפטי להורות למשטרה לקיים את החקירה. פעילים, אזרוחים מן השורה, ומספר עורכי דין כבר חתמו על העצומה.

Occupy Tel Aviv encampment, July 16, - Israel Police, Tel Aviv City Center Police Station accepted today a  complaint and opened a criminal investigation file No 313980/2013 against Magistrate Judge Hagai Brenner and  others in the Tel Aviv District Court, relative to "obstruction of justice with impunity", following the last letter of the self-immolated social protest activist Moshe Silman. Review of the court files in this matter provided evidence that suport Silman's claims.

Following advice by the senior attorney for the Israei Civil Rights Association, Dan Yakir, the Israeli Attorney General must authorize the conduct of such investigation by police against a judge.  Therefore, a copy of the complaint, with a letter demanding his authorization, was sent to Attorney General Yehudah Weinstein.  In parallel, petition was launched calling upon the Attorney General to provide his authorization.  Activists, citizens, and attorneys have already joined the petition.
