13-07-22 Israel: Shabak whistleblower confirms Human Rights Alert (NGO) findings of large-scale fraud in computers of the Israeli courts // צייצן מהשב"כ מאשר את מסקנות סייג לזכויות האדם לגבי מרמה במחשבי בתי המשפט בישראל

Events that took place in the Israeli Supreme Court in 2002, should be deemed second only to the assassination of Prime Minister Yitzhaq Rabin in 1995, relative to the nature of the current regime of the State of Israel.

Occupy Tel-Aviv Encampment, July 22 - recently, the undersigned was approached by a stranger, who identified himself as an Israeli Security Agency person.  That person said that he had read some of my reports, regarding the Israeli courts computer systems of the latest generation, and confirmed the conclusions of my reports.  A third part confirmed the identity and qualification of the stranger.

The Human Rights Alert (NGO) submission was incorporated into the Universal Preiodic Review Report (2013) of the Human Righst Council of the United Nations (Professional Staff Report, paragraph 25), pertaining to Israel, with the note: "Lack of integrity in the electronic records of the supreme court, the district courts and the detainees court in Israel".

The main findings of the Human Rights Alert (NGO) submission are:

• Starting in 2002, and ending towards 2010,  new electronic record systems were implemented in the Israeli courts, which should be deemed large-scale fraud on the People of the State of Israel.
• In the process, servers of the courts were removed from the custody of the chief clerks of the courts.  Accorsding to the State Ombudsman's Report 60b (2010) the systems were develolped and implemented in violation of the law of the State of Israel, and the servers are today under the custody of a corporation (IBM, EDS???, the Ombudsman's report did not name the specific corporation).
• In the Supreme Court, the process started on March 7, 2002, with the death, under suspicious circumstances of then Chief Clerk Shamryahu Cohen, in office, which was the subject of an Israel Police complaint of murder in March 2002 by a family member/friend.
• Today, there is no lawfully appointed chief clerk in the supreme court or the district courts in Israel.  None of the court records are authenticated by the clerks.
• In parallel, an epidemic of falsification (fabrication, reconstruction, various euphemisms were used by the press to describe the phenomenon) of court records has erupted, as well as the larege-scale conduct of simulated court proceedings.
• Events that took place in the Supreme Court in 2002, should be deemed second only to the assassination of Prime Minister Yitzhaq Rabin in 1995, relative to the nature of the current regime of the State of Israel.
• The case of the State of Israel mimics events that had taken place in the US a decade or two earlier.
• The case of the State of Israel should be deemed the first fully documetned case of digital, unannounced regime change in any nation.

Three senior Israeli Computer Science professors, from Hebrew U, from Weizmann Institute, and from Bar Ilan U., have previously examined part of the findings of the Human Rights Alert submission, and all three expressed serious alarm regarding the findings.

As is the case in the United States, whistleblowers from the secret services and related agencies hold a key role in protecting the People against abuse by their governments in the digital era.

 דו"ח סייג לזכויות האדם נכלל בדו"ח התקופתי של מועצת זכויות האדם של האו"ם (2013) לגבי ישראל- דוח הסגל המקצועי, פסקה 25 - בלוויית ההערה, "חוסר יושרה בכתבים האלקטרוניים של בית המשפט העליון, בתי המשפט המחוזיים, ובתי הדין למוחזקי משמורת בישראל".י

הממצאים העיקריים בדו"ח סייג לזכויות האדם הם:י

 י- החל ב-2002 וכלה בערך ב-2010, הונהגו מערכות מחשבים חדשות בבתי המשפט בישראל, שמן הדין שייחשבו להונאה רחבת היקף על העם במדינת ישראל.י

י- בתהליך זה, הוצאו השרתים של בתי המשפט ממישמורת המזכירים הראשיים.  על פי דוח מבקר המדינה 60ב (2010)   מערכות אלה פותחו והותקנו  בניגוד לחוקי מדינת ישראל, והשרתים נמצאים  היום במשמורת חברה.י

י- בבית המשפט העליון, התהליך החל ב-7 למרץ, 2002, עם מותו תחת נסיבות מחשידות של המזכיר הראשי של בית המשפט העליון שמריהו כהן, ז"ל, שהיה נושא תלונה על חשד לרצח שהוגשה על ידי מכ/קרוב משפחה במרץ 2002.י

י- היום, אין כל מזכיר ראשי ממונה כחוק בבית המשפט העליון ובבתי המשפט המחוזיים בישראל, וכתבי בתי המשפט אינם מאושרים על ידי המזכירות.י  (authenticated)

י- במקביל, פרצה בישראל מגפה של כיזוב, שיפוץ ופיברוק כתבי בתי המשפט על ידי שופטים, וניהול הליכים למראית עין כדבר שבשיגרה.י

 י- מן הראוי שהאירועים בבית המשפט העליון של מדינת ישראל ב-2002 יחשבו שניים בחשיבותם רק לרצח רבין ב-1995 לגבי מהות המשטר בישראל היום.י

י- האירועים בישראל מחקים אירועים שקרו בארה"ב עשור או שניים קודם לכן.י

י- המקרה של מדינת ישראל, מן הראוי שיחשב המקרה הראשון המתועד של שינוי משטר בלתי מוכרז באמצעים דיגטליים.י

חלק מן הממצאים בדוח סייג לזכויות האדם נבדקו על ידי שלושה מבכירי הפרופסורים למדעי המחשב בישראל, מן האוניברסיטה העברית, ממכון ויצמן, ומבר אילן, ושלושתם הביעו דאגה עמוקה לגבי ממצאים אלה.י

 כמו בארה"ב, לצייצנים מתוך  מערכת הביטחון מקום מרכזי בהגנת העם מפני ניצול והתעללות בידי הממשלה בעידן הדיגיטלי.י
