Occupy Tel Aviv, November 27 - as of October 31, 2013, "Chief Clerk" of the Israeli Supreme Court Sarah Lifschitz, who sat in her office for over ten years with no lawful authority "departed".  Since then, the Israeli Supreme Court now operates with no Chief Clerk at all.

As documented in the Human Rights Alert (NGO) submission to the Human Rights Council of the United Nations, during the same decade, numerous decision records of the Israeli Supreme Court have been forged and falsified, and the conduct of simulated, sham process in the Supreme Court has become a routine.  Ever since the appearance of "Chief Clerk" Sarah Lifschitz and to this date, all decision records of the Supreme Court are served unsigned, with no authentication by the clerk, and with a disclaimer "subject to editing and phrasing changes".

The Human Rights Alert submission was incorporated into the Universal Periodic Review Report (2013) of the Human Rights Council of the United Nations with the note "lack of integrity in the electronic records of the Supreme Court... in Israel".

Criminal complaints were filed against Ms Sarah Lifschitz with the Israel Police for false appearance as Chief Clerk of the Supreme Court and for fraud in certification of Supreme Court records.  Additional criminal fraud complaint was also filed against Presiding Justice Asher Grunis for his part in such conduct.

Following the filing of the criminal complaints, Ms Lifschitz "departed" from the Supreme Court on October 31, 2013.

In the aftermath, Presiding Justice Asher Grunis refuses to disclose who today holds the authorities of Chief Clerk of the Supreme Court.

As is the case in other courts that originate in the English common law, the Chief Clerk is responsible for integrity of court records, for the registration of papers filed in court, for the service of court decisions, and for certification of court records "True Copy of the Original".

More recently, in proceedings, pertaining to incitement for violence against Arabs by State supported rabbis , which were conducted outside any law of the State of Israel, Ms Aluma Zernik was listed as "Clerk".  Both Ms Zernik and Presiding Justice Grunis have so far failed to explain the legal foundation for Ms Zernik's listing as "Clerk" of the Supreme Court.

As of today, Ms Lifschitz's name, which was listed as "Chief Clerk" on the web site of the Supreme Court, was removed.  Instead, Ms Edit Melul is listed as "Deputy Chief Clerk", and no Chief Clerk is listed.  The source of Ms Melul's legal authority remains unknown as well.

Over the past decade, starting with the tenure of Aharon Barak as Presiding Justice of the Supreme Court,  the Israeli courts have experienced unprecedented corruption, and the appearance of unauthorized "Chief Clerks" in the various courts has been accompanied by an epidemic of falsification of court records by judges.

Under the current circumstances, the Israeli Supreme Court should be deemed an incompetent court.

כפי שתועד בדוח "סייג לזכויות האדם" (NGO) למועצת זכויות האדם של האו"ם, במשך אותן שנים זויפו ושובשו כתבי החלטות רבים של בית המשפט העליון, וניהול הליכים למראית עין בבית המשפט העליון הפך לעניין שבשגרה.  מאז החלה הגב' שרה ליפשיץ להופיע כ"מזכירה ראשית" ועד היום, כל החלטות בית המשפט העליון מתפרסמות בכפוף לתניית פטור "כפוף לשינויי עריכה ונוסח".

דוח "סייג לזכויות האדם" נכלל בדוח התקופתי האוניברסלי (2013) של מועצת זכויות האדם של האו"ם בלוויית ההערה "חוסר יושרה בכתבים האלקטרוניים של בית המשפט העליון.. בישראל". 

תלונות פליליות הוגשו למש\טרת ישראל נגד הגב' שרה ליפשיץ על התחזות והונאה באישור החלטות בית המשפט העליון.  תלונה פלילית הוגשה גם נגד נשיא בית המשפט העליון אשר גרוניס על חלקו בעניין זה.

בעקבות הגשת התלונות הפליליות, "פרשה" הגב' ליפשיץ מבית המשפט העליון ב-31 לאוקטובר, 2013.

אולם מאז, מסרב נשיא בית המשפט העליון אשר גרוניס לגלות. מי מחזיק היום בסמכויות המזכיר הראשי של בית המשפט העליון.

כמו בבתי משפט אחרים שמקורם בחוק האנגלי המקובל, המזכיר הראשי אחראי ליושרת כתבי בית המשפט, לרישום כתבים המוגשים לבית המשפט, להמצאת החלטות בית המשפט, ולאישור ההחלטות "העתק מתאים למקור".

לאחרונה, התקיימו בבית המשפט העליון הליכים למראית עין בעניין הסתה לאלימות נגד ערבים בספר "תורת המלך".  בהליכים אלה נרשמה הגב' אלומה צרניק כ"מזכיר" בית המשפט העליון.  אולם הן הגב' צרניק והן נשיא בית המשפט העליון אינם עונים על בקשה להבהרה - מה הבסיס החוקי לרישומה של הגב' צרניק כ"מזכיר" בית המשפט העליון.

נכון להיום, שמה של הגב' שרה ליפשיץ, שהופיעה בעבר ה"מזכירה ראשית" באתר האינטרנט של בית המשפט העליון הוסר, ובמקומו מופיע שמה של עדית מלול כ"סגנית מזכיר ראשי".  אולם הבסיסי החוקי למינויה של הגב' מלול אינו ברור גם הוא. 

בעשור האחרון, החל בכהונתו של אהרן ברק כנשיא בית המשפט העליון, חלה השחתה חסרת תקדים של בתי המשפט בישראל, והופעת "מזכירים ראשיים" ללא כל מינוי כחוק לוותה במכה של זיופים של כתבי בתי המשפט על ידי שופטים.

תחת התנאים הנוכחיים, יש לראות בבית המשפט העליון של מדינת ישראל בית משפט שאינו כשיר.
