12-08-05 Moshe Silman, Israeli self-immolated social protest activist, and the justice system of the State of Israel – Disqualification Statements against Judge Hagai Brenner

The last letter of the late Moshe Silman, self-immolated Israeli social protest activist, levels serious charges against the District Court.  The Disqualification Statements claim that there is "material concern that Judge Hagai Brenner's conduct was and is outside the framework of the law," relative to simulated proceedings and simulated court records in this matter, where Brenner purportedly denied an appeal from his own decision.

Jerusalem and Los Angeles, August 5 -  Joseph Zernik, PhD, of Human Rights Alert (NGO) has filed Disqualification Statements against Registrar/De Facto District Judge Hagai Brenner of the Tel-Aviv District Court in cases related to the late Moshe Silman. [1]

The last letter of the late Moshe Silman, self-immolated Israeli social protest activist, levels serious charges against the District Court. [2]
The Disqualification Statement lists three main findings in the records, discovered so far: 

  • Commencing paper and the first decision in this matter were registered under a case number that the office of the Clerk of the District Court claims has never existed.
  • Other electronic records ("Decision" and "Protocol"), are not original court records.
  • De Facto Judge Hagai Brenner purportedly denied the appeal from Registrar Hagai Brenner's Decision in the civil complaint.
The Disqualification Statement claims that in the cases related to the late Moshe Silman:
  • There is "material concern that Judge Hagai Brenner is biased," "based on objective circumstances";
  • There is "material concern that Hagai Brenner's conducts should be deemed a 'sold game' ;"
  • There is "material concern that Judge Hagai Brenner's conduct was and is outside the framework of the law," relative to simulated proceedings and simulated court records, and
  • There is "material concern that Judge Hagai Brenner is now in a conflict of interest," relative to the discovery of any further records in this matter.
Pursuant to new Regulations of the Courts and Supreme Court of Israel decisions over the past decade, Requests to Inspect and to Copy court records in in the cases related to the late Moshe Silman were pending before Registrar/De Facto District Judge Hagai Brenner, as purported presiding judge in both the original civil complaint and the appeal.

Complaint, filed by the Israel Bar Association against Assistant Presiding Judge of the Tel-Aviv District Court, relative to the production of falsified court records, is still pending.

The 2012 submission of Human Rights Alert to the Human Rights Council of the United Nations, regarding the State of Israel, titled "Integrity or lack thereof, of the electronic record systems of the courts of the State of Israel," is scheduled for review in early 2013. [3]
IBM and EDS, US-based corporations, were involved in the implementation of the fraudulent electronic record systems of the State of Israel over the past decade .  Similar systems had been implemented in the state and federal courts in the United States a couple of decades earlier.  The 2010 submission of Human Rights Alert to the Human Rights Council (HRC) of the United Nations, regarding the United States, was reviewed by the HRC professional staff and incorporated in the official HRC Professional Staff Report with a note referring to “corruption of the courts and the legal profession and discrimination by law enforcement in California.” [4]
