OccupyTLV, May 13 -  in an April 29 letter to Dr Joseph Zernik of OccupyTLV, Tel Aviv Police Commander Benzi Sau informed Dr Zernik that conduct of police, relative to the April 25, 2014 violence incident in the OccupyTLV camp, was forwarded to the State Counsel, Department of Police Investigations, for investigation of suspected criminality by police. [4]
The April 25 violence incident involved former police officer Uriel Benveniste, who is also a former prisoner on violent crimes, and who also has a long track record of violent conduct in the OccupyTLV camp.  Police again apparently failed to take action against him following the April 25 incident.
The April 29 letter from Tel Aviv Police Commander came in response to an April 28 letter by Dr Zernik to Commander Sau, [1] which included the recording of an April 25, 2014 phone call between a senior Tel Aviv Police Intelligence Officer and a policeman on the ground in the OccupyTLV camp. [2-3]
Following the letter by Commander Sau, Dr Zernik wrote today to the office of State Counsel, and asked to provide evidence related to the investigation. [5] 

In his letter today, Dr Zernik states that the event of April 25, 2014, should be examined on the background of police conduct in the camp throughout the past year and a half.  Moreover, Dr Zernik alleges that such examination is likely to lead to the conclusion that the Israel Police in collaboration with the Tel Aviv Municipality deliberately permit the establishment of violent, lawless environment in the OccupyTLV camp.
The recent case from the OccupyTLV camp follows a series of other cases, which raise concern regarding conduct of the Tel Aviv Police, relative to Social Protest and Civil Society activists.
Earlier this year, attempt was made by the Israel Police to prosecute Daphni Leef, a Social Protest leader, on bogus charges of violence against police.  The prosecution was supported by false testimonies by policemen on the stand in the Tel Aviv court.  However, that effort failed, when it became apparent police was lying, and videos showed police violence against Leef.  On April 1, 2014, Attorney General Weinstein announced the dropping of the prosecutions against Leef and other Social Protest activists. [6]
On May 26, 2014,  the next hearing is scheduled in the Tel Aviv Court of criminal prosecution of Tax Authority whistleblower Rafi Rotem on charges including insulting and harassing police on duty. 

The case of whistleblower Rafi Rotem has been going on for some 12 years now.  Around 2002, then highly commended, senor Tax Authority intelligence officer Rotem complained of corruption of higher officers of the Tax Authority, involving undermining the investigations of NIS tens and hundreds of millions tax liabilities by businesses related to organized crime, tycoons, and persons close to the authorities.

Since his whistle-blowing, Rotem was subjected to harassment, intimidation, and retaliation, while the justice authorities have refused to fully investigate his allegations, and also refused to accord him protection, due to whistleblowers under Israeli law.  

As part of retaliatory measures, Rotem,  who had won a number of commendations by the Israel Police previous to his whistleblowing, has been subjected to false arrests, humiliation and beating by police.  

No policeman has been disciplined for such conduct against Rotem, but now the Israel Police is prosecuting Rotem for his words to such policemen during the incidents of his abuse.  

The case of Rafi Rotem has become a major cause of the Israeli Social Protest movement in recent months. [7] 

Overall, concern is that the Tel Aviv Police is resorting to methods employed by repressive regimes against legitimate Social Protest and Civil Society activists. That, on the background of the glaring failure of police in investigations of organized crime, including assassinations in broad daylight in Tel Aviv center, and rampant government corruption.

האירוע ב-25 לאפריל כלל איש משטרה לשעבר - אוריאל בנבנישתי, שהוא גם אסיר לשעבר על עבירות אלימות, ושלו עבר עשיר של אירועי אלימות במאהל המחאה, וכשל אנשי משטרה לנקוט בפעולות מתאימה כנגדו וכנגד אחרים.

מכתבו של מפקד מחוז ת"א נשלח בתגובה לפנייתו של דר' צרניק לניצב סאו, [1]  שכללה הקלטה של שיחת טלפון מיום ה-25 לאפריל בין קצין מודיעין בכיר של משטרת ת"א לבין איש משטרה בשטח בזמן אירוע האלימות. [2-3] 

בעקבות מכתבו של ניצב סאו, פנה היום דר' צרניק למח"ש בבקשה למסור ראיות נוספות לעניין חקירה זאת.

במכתבו היום למח"ש, דר' צרניק אומר שמן הראוי לחקור את האירוע מיום ה-25 לאפריל בהקשר להתנהלות משטרת ת"א במאהל המחאה בשנה וחצי האחרונות. יתרה מכך, דר' צרניק אומר שחקירה מעין זאת תוליך קרוב לודאי למסקנה שמשטרת ישראל בשיתוף פעולה עם עיריית ת"א יצרו בכוונה תנאים של אליומות וחוסר חוק במאהל.

האירועים במאהל המחאה גם מעלים חששות לגבי התנהלות משטרת ישראל נגד אנשי המחאה החברתית ופעילי חברה מתוקנת.

בתחילת שנה זאת  ניסתה משטרת ישראל להעמיד לתביעה פלילית את דפני ליף על האשמות שווא של אלימות נגד שוטר.  התביעה הסתמכה על עדיויות שקר של שוטרים בבית המשפט.  אולם ב-1 לאפריל שנה זאת החליט היועץ המשפטי לממשלה יהודה ויינשטיין להפסיק את התביעות נגד ליף ופעילי מחאה אחרים. [6]

ב-26 למאי, 2014, יתקיים הדיון הבא בבית המשפט בת"א בתביעה פלילית נגד חושף השחיתויות ברשות המיסים רפי רותם, על האשמות הכוללות העלבה והטרדה של שוטרים.

המקרה של רפי רותם נמשך כבר כ-12 שנים.  בסביבות 2002, רפי רותם - אז קצין מודיעין בכיר ומוערך ברשות המיסים - חשף שחיותות בדרגים הגבוהים של מחלקת החקירות של רשות המיסים, בקשר לטיוח וסגירת חקירות של העלמות מס של עשרות ומאות מליוני ש"ח נגד עסקים הקשורים לאנשי פשע מאורגן, טייקונים, ומקורבים לשלטון.

מאז, הפך רפי רותם לקורבן של מערכה מתואמת של הטרדות, איומים ונקמנות, בשעה שרשויות החוק מסרבות לחקור את טענותיו, ומסרבות להעניק לו הגנה המגיעה על פי החוק לחושפי שחיתויות.

כחלק מצעדי נקמה, רותם, שבעברו זכה למכתבי הערכה והוקרה ממשטרת ישראל, הפך לקורבן של מעצרי שווא נשנים, השפלה, ומכות מידי שוטרים.

אנשי משטרה שהיו מעורבים בפעולות אלו, לא הועמדו לדין, אך רותם עומד עתה למשפט על האשמות הכוללות העלבת והטרדת שוטרים בעת אירועים אלה.

המקרה של רפי רותם הפך לעניין מרכזי של אנשי המחאה החברתית בחודשים האחרונים.  עצומה גם נפתחה, הקוראת לביטול ההליכים הפליליים נגדו.  [7]

התנהלות משטרת ת"א בכלל מקרים אלה מעלה חששות שהמשטרה נוקטת בשיטות פעולה הנהוגות במשטרים רודניים נגד פעילים פוליטיים ואלה המנסים לתקן עיוותים.  זאת, על רקע כשלונה הבולט של המשטרה בחקירת הפשיעה המאורגנת, ובכלל זה חיסולים לאור היום במרכז ת"א, ושחיתות ממשלתית חסרת תקדים.
