II. Comments:


1)  Mischief in the Courts
Joe - when there is a lot of money involved in court cases there is a lot of temptation for mischief by the judges. As the bible clearly and obviously states, the Love of Money is the root of all evil. B, JD [Admitted to 9th Cir and US Supreme Court, but not the Calif Supreme Ct. due to State Bar Crimes against me.]

2) On Due Process in Denial of Life, Liberty and Property
I guess Mischief is your euphemism for corruption.

Let's go through the list:

Jed Rakoff, Judge, US Court, Southern District of New York - specializes in simulated litigation and Fraud on the Court in banking cases.
a) Property:
The power of money is a given. That is why one of my routine methods of exposing corrupt, simulated litigation cases, is simply to search for case involving banks.
For example, in the US District Court, Southern District of NY, which is supposed to regulate the NYSE, any case involving the infamous US Judge Jed Rakoff and a bank, is likely to involve Fraud on the Court.

Alex Kozinski, Chief Judge, US Court of Appeals, 9th Circuit - under his watch, the 9th Circuit, by far the largest US court of appeals, has reached unprecedented levels of corruption.  Judge Kozinski himself issued a simulated decision and engaged in Fraud on the Court in denial of the Emergency Petition and Habeas Corpus of the 70 year-old former US prosecutor Richard Fine.
b) Liberty:
It is not only money.  It is also the desire of the government to exert absolute powers.
For example, in my searches of the US Court of Appeals, 9th Circuit, a good way to search for corrupt, simulated litigation cases and Fraud on the Court, is to look up the Habeas Corpus cases.  In that particular instance, they are conducting fraud on individuals, who don't even have good access to the records.

c) Life:
I never got into reviewing capital cases in the US courts, because it made me sick.

The issue is to go beyond the fabricated concept of the courts and the legal profession as "controlling the other branches of government", as some here (perhaps you) stated.  Instead, systematic data mining of the electronic records of the US courts (or Israeli courts, and soon I plan to initiate review of additional nations), provides a good way to estimate the scope of the corruption through Fraud on the Court.

The bottom line:
In any matter involving due process in the deprivation of life, liberty, and property, you cannot trust the judiciary and the legal profession.  That does not leave much...

3) More on Life under Mischief in the courts

Although I have avoided reviewing capital cases in the United States, I ended up reviewing posthumously a case of Fraud on the Court that resulted in death:

In July 2012, the self-immolated social protest activist Moshe Silman made statements in the opening lines of his suicide letter, which implied that he was victim of corruption in the Tel-Aviv District Court, State of Israel. Initial review of the electronic records shows that the original complaint (arising from refusal of Social Security Administration to provide due benefits) and a decision on it were filed under a Case Number, which now the Court claims has never existed (simulated Case Number, or Index Fraud). And Judge Hagai Brenner, whose decision denied the original complaint, also denied the appeal arising from his decision.

Including the case of Judge Hagai Brenner, by now, there are three clearly documented cases of falsification of electronic court papers by judges of the State of Israel over the past year and a half. The other two are:

a) Unnamed Judge in the Detainees Courts - no one even requested his removal from the bench, and the Spokesperson of the Ministry of Justice (under which the Detainees Courts are administered) issued an official statement to the press, dismissing the entire affair as "tempest in a teapot".


Deputy Judge Varda Al Sheikh of the Tel Aviv District Court - lifts some heavy weight corporate and banking cases, was caught falsifying her own court records.

b) Deputy Presiding Judge Vardah AlSheikh of the Tel Aviv District Court - she handles some of the biggest corporate and financial institution cases - the Israeli Bar is pressing for her removal from bench, but so far the Inspector General of the Judiciary and the newly appointed Chief Justice Asher Grunis, have found that her conduct did not justify any serious response.

c) Why the judges of the State of Israel would not be able to address their own corruption
The reason is obvious - hundreds of falsified decision records of the Supreme Court itself have been documented since 2002 in the Human Rights Alert 2012 submission to the United Nation.

I guess it all falls under mischief in the courts, and surely there is a hefty cost to be incurred by the State of Israel (or the United States for that matter), related to the administration of social security benefits today.
