במקביל, הטכניון וועד ראשי האוניברסיטאות, שמעסיקים את עו"ד רחל בן-ארי כיועצת משפטית התבקשו להגיב בעניין התנהלותה של עו"ד רחל בן-ארי. בניגוד לאפי נוה, עו"ד רחל בן-ארי היא בשר מבשרו של הממסד הישן, כבר שלושה דורות, כפי שהיא אוהבת להזכיר.

יש לצפות לתגובה מאוניברסיטת בר אילן. אמנם האקדמיה בישראל נמנעת מלהתייחס לראיות לשחיתות בתי המשפט, אולם במקרה זה דומה כי נחצה גבול כלשהו... מרצה בפקולטה למשפטים בבר אילן מעורב בפרשה שמצביעה על סממנים של פשיעה מאורגנת בבית המשפט לענייני משפחה בחיפה... מה עוד צריך לקרות???

In a post on Tuesday, the episodes from the beginning of the affair were described - around the day the first statement of claim was filed, 6.6.2024, at the Haifa Family Court, the dismissal of Attorney Dr. Yair Shiver, after he gave "consent" without the knowledge of his sender, without his consent, and in violation of the representation agreement... and the campaign of punishment and deception by Attorney Rachel Ben-Ari, Attorney Yoav Salomon and Judge Hila Gurvitz, vis-a-vis an unrepresented litigant: that an unrepresented litigant will be granted the same status as an unrepresented absentee under Section 110(c) of the Inheritance Law, or perhaps the status of a legally incompetent person... It would be at the discretion of Attorneys Ben Ari and Salomon. "And this, this is terribly clear!"

עו"ד ד"ר יאיר שיבר הוא דמות ידועה בתחום דיני המשפחה ועורך דין מצליח. מאמרו בעניין מזונות ילדים קטינים צוטט בפסיקת בית המשפט העליון ובית הדין הארצי לעבודה. אולם בפרשת השופטת הילה גורביץ ועו"ד רחל בן ארי נחזה עוסק במרמה כלפי שולחו. ביום 5.6.2024 הסתיר עו"ד ד"ר יאיר שיבר משולחו את העובדה שעו"ד יואב סלומון הגיש בבית המשפט לענייני משפחה בחיפה בקשה להתמנות למנהל עיזבון בצוותא חדא עם עו"ד רחל בן-ארי, כי כתב הטענות הראשון הומצא לו ע"י עו"ד יואב סלומון, כי כתב הטענות הראשון משובש להפליא, וכי לא היה אמור להתקבל לרישום. למרות כל זאת, ביום 6.6.2024 שלח עו"ד ד"ר יאיר שיבר בסתר לעו"ד יואב סלומון את הסכמת שולחו, ללא ידיעת שולחו, ללא הסכמת שולחו, ותוך חריגה מהסכם הייצוג. מה היה המניע??? מה היה טיבם של היחסים בין עו"ד ד"ר יאיר שיבר, עו"ד יואב סלומון ועו"ד רחל בן-ארי??? ומה אומרים בפקולטה למשפטים בבר-אילן על מעללי המרצה עו"ד ד"ר יאיר שיבר???
עו"ד ד"ר יאיר שיבר היה כנראה נכס מיוחד. יומיים לאחר סיום הייצוג, אימצו עו"ד רחל בן-ארי, עו"ד יואב סלומון והשופטת הילה גורביץ דוקטרינה מקורית, לפיה, בהיותו בלתי מיוצג, יוסף צרניק, שולחו של עו"ד ד"ר יאיר שיבר, יאבד את זכותו לאוטונומיה אישית ויטופל כנעדר לא מיוצג או כאדם שאינו כשיר משפטית... כל זאת - לפי "ביצוע בקירוב" על פי דיני היושר ועיקרון תום הלב...
קשה לתאר את תחושת המיאוס, הקבס והתיעוב למראה ולמשמע השופטת הילה גורביץ בהופעה חיה, בחיפה, ביום 9.10.2024, עפה על השטויות של עצמה במונולוג אודות הדוקטרינה הסוטה הנ"ל... ומסיימת בקרשנדו: "וזה, זה נורא ברור!".
פרופ' דפנה הקר כתבה אודות בתי המשפט לענייני משפחה - "ג'ונגל טוטלי, תעשו הכל כדי לא להגיע לשם". העובדות מצביעות על סממנים של פשיעה מאורגנת. מי יעיר את היועמ"שית גלי בהרב-מיארה???
למה רפורמה? כי שחיתות בתי המשפט ומקצוע עריכת הדין! פרשת השופטת הילה גורביץ ועו"ד רחל בן-ארי מתאימה במיוחד כמקרה בוחן בשיח הציבורי אודות הרפורמה.
