Discontinuities in Succession of Certification Authority in the Israeli Supreme Court:  Corrections and Elaboration
Among the records, which were reviewed:

•  First discontinuity appears on March 11, 2002, after the death of Clerk Shmaryahu Cohen (March 6?): Cohen’s certification is replaced by an unnamed “Magistrate”.
• Second discontinuity appear in November 2002: Certifications appear by “Sarah Lifschitz  Clerk of the Court.”
• Third discontinuity appears in early January 2003, in decisions published by Justices Aharon Barak and Dorit Beinsich: No certification statements appear on the decisions, only a disclaimer of authenticity, a practice that continues to this date.

Proposed corrective measures include:

• Examination and validation of the electronic record systems of the courts by Israeli computing experts;
• Reform of the offices of Clerks of the Courts through legislation.  

Under the tenure of Chief Justices Aharon Bark and Dorit Beinisch integrity of the electronic records of the Supreme Court of Israel was and is undermined.
 
Jerusalem, January 21  Joseph Zernik, PhD, published corrections and elaboration on a report, first published on January 17, 2012,  “Evolution of the Electronic Decision Forms…,”[1] an appendix to the earlier report, “Simulated Records, Simulated Litigation Enabled by the Electronic Record Systems of the Supreme Court of the State of Israel”. [2]

Among the records, which were reviewed (dates are best estimates), under the tenure of Chief Justice Aharon Barak:

• On March 11, 2002, after to the death of Clerk Shmaryahu Cohen (March 6?), Cohen’s certification is replaced by an unidentified “Magistrate”.
• November 2002: Certifications appear by “Sarah Lifschitz  Clerk of the Court.”
• Starting in early January 2003, in decisions published by Justices Aharon Barak and Dorit Beinsich: No certification statements appear on the decisions, only a disclaimer of authenticity, a practice that continues to this date.

Under the tenure of Chief Justice Dorit Beinisch:

•  The Ethics Rules for Judges (2007) is published in the Register of Regulations, but the office of Administration of Courts today refuses to certify the record.
•  The Guidelines of the Supreme Court (2010) is published online by the Supreme Court, but the office of Administration of Courts avoids even mentioning the record by name.
•  The May 18, 2011 Order in Katzav v State of Israel (3372/11), is published by Justice Yoram Danziger, which was not duly served, which the Office of the Clerk refuses to certify, and which should be considered a simulated order.

Proposed corrective measures include the following:

The 2010 submission of Human Rights Alert to the Human Rights Council (HRC) of the United Nations was reviewed by the HRC professional staff and incorporated in the official HRC Professional Staff Report with a note referring to “corruption of the courts and the legal profession and discrimination by law enforcement in California.”
