Dear Yale Law Faculty:

We write to ask your urgent help in issuing expert opinions regarding alleged fraud in operations of PACER and CM/ECF, the online public access and case management systems, respectively, as operated at the US District Court, Los Angeles, and related systems.  The findings and the records, which are subject of the requested opinion, are described in details in links under #7, below. 

Preliminary opinions were already obtained of fraud pertaining to Sustain, the case management system of the Los Angeles Superior Court, as described below.

PACER and CM/ECF, as operated at the US District Court, Los Angeles, were implemented with no public oversight, no publicly accountable validation, and without founding them in Local Rules of Court, in disregard of the Rule Making Enabling Act.  Some of the blatant fraudulent features in PACER and CM/ECF, for example, are the omission of all authentication records (the NEFs - Notices of Electronic Filings) from public access in PACER, and allowing access to them only to attorneys who are authorized in a given case.  Moreover, as documented in the links below, under such conditions, access is also routinely denied to pro se litigants.   Furthermore, as documented below, the courts in certain cases, then take the liberty of issuing false, invalid authentication records, while posting the respective records in PACER as "Entered".  Under such conditions the public is left in the dark, unable to discern which court records are honest, valid, and effectual court records, such that require "full faith and credit", and which ones are not. 

There simply is no explanation for such design and operation of a case management system that is consistent with honest administration of the courts and the furtherance of justice.

Time is of the essence!   As described below, obtaining such opinions is the first step in our efforts in relationship to the first ever UPR (Universal Periodic Review) of the United States Human Rights record by the UN.  Following Mr Fine's case's treatment by the US courts, we firmly believe that only international pressure through the UPR is likely to affect any restoration of integrity in such computer systems that are critical for the Human Rights of all who reside in the US.

Les escribimos para pedirles su ayuda urgente en la emisión de dictámenes de expertos en relación con el presunto fraude en las operaciones de PACER y CM ECF /, el acceso público en línea y sistemas de gestión de casos, respectivamente, tal como se efectúa en el Tribunal de Distrito de EE.UU., Los Ángeles, y sistemas relacionados. Los resultados y registros, que son objeto del dictamen solicitado, se describe en detalles en los enlaces bajo el número 7, más abajo.
opiniones preliminares ya se han obtenido de fraude relacionados con Sustain, el sistema de gestión de casos de la Corte Superior de Los Angeles, como se describe a continuación.
PACER y CM ECF /, tal como se efectúa en el Tribunal de Distrito de EE.UU., Los Ángeles, se llevaron a cabo sin la supervisión pública, sin la validación públicamente responsable, y sin posarse en ellas las reglas locales del Tribunal, haciendo caso omiso de la Regla Hacer Ley de Autorización. Algunas de las características fraudulentas en flagrante PACER y CM / ECF, por ejemplo, son la omisión de todos los registros de autenticación (FNMA la - Avisos de Electronic Presentados) de acceso público en PACER, y permitir el acceso a ellos sólo a los abogados que están autorizados en un caso determinado. Por otra parte, como se documenta en los siguientes enlaces, en las condiciones, el acceso también es habitual que se niegue a los litigantes pro se. Por otra parte, tal como se documenta a continuación, los tribunales en ciertos casos, a continuación, tomo la libertad de publicar las actas falsas, la autenticación válida, al publicar las actas respectivas en PACER como "Entrada". En tales condiciones, se deja al público en la oscuridad no, para discernir qué documentos de la corte son honestos, válida y eficaz los registros judiciales, tales que requieren "plena fe y crédito" y cuáles no lo son.

Wir schreiben Ihre dringend Hilfe bei der Ausstellung von Gutachten über angebliche Betrügereien bei Operationen der PACER und CM / ECF, dem Online Public Access und Fall-Management-Systeme, bzw., wie auf dem US District Court betrieben, Los Angeles fragen, und verwandten Systemen. Die Feststellungen und die Aufzeichnungen, die Gegenstand der Stellungnahme angefordert werden, sind im Detail in Links unter # 7 beschrieben, unten.
Vorläufiges Gutachten wurden bereits von Betrug über Erkenntnisse Sustain, das Case-Management-System des Los Angeles Superior Court, wie unten beschrieben.
PACER und CM / ECF, wie auf dem US District Court betrieben, Los Angeles, wurden ohne öffentliche Aufsicht durchgeführt, keine öffentlich Rechenschaft Validierung und ohne Gründungsmitglied sie in Landeswährung Verfahrensordnung des Gerichtshofs, in Verkennung der Rule Making Ermächtigungsgesetz. Einige der Features in eklatanter betrügerische PACER und CM / ECF, sind zum Beispiel der Verzicht auf sämtliche Authentifizierungs-Datensätze (die nefs - Bekanntmachungen von Electronic Filings) vom öffentlichen Zugang in PACER, und ermöglicht den Zugang zu ihnen nur für Anwälte, die berechtigt sind, in einem bestimmten Fall.Außerdem ist, wie in der unten stehenden Links dokumentiert, unter solchen Bedingungen ist der Zugang auch routinemäßig zur Pro SE Prozessparteien verweigert. Darüber, wie weiter unten dokumentiert die Gerichte in bestimmten Fällen, dann die Freiheit nehmen, die Ausstellung falscher, Authentifizierung ungültige Datensätze, während die Buchung der jeweiligen Datensätze in PACER als "Eingetragen". Unter solchen Bedingungen die Öffentlichkeit im Dunkeln nicht zu erkennen, welche Gerichtsakten ehrlich, gültig sind links und wirksame Gerichtsakten, so dass "erfordern volle Vertrauen und Kredit", und welche nicht.
Es gibt einfach keine Erklärung für diese Auslegung und den Betrieb eines Case Management System, das im Einklang mit ehrlichen Verwaltung der Gerichte und der Förderung der Gerechtigkeit ist.
Die Zeit ist das Wesen! Wie unten beschrieben, den Erhalt dieser Stellungnahmen ist der erste Schritt in unseren Bemühungen in Beziehung zu den ersten UPR (Universal Periodic Review) der Vereinigten Staaten Menschenrechte durch die UN. Nach Herrn Fine Fall die Behandlung durch die US-Gerichte, wir glauben fest daran, dass nur der internationale Druck durch die UPR wahrscheinlich keine Wiederherstellung der Integrität in einem solchen Computer-Systemen, die kritisch für die Menschenrechte von allen, die in den USA ansässig sind, zu beeinträchtigen.
Die für eine rechtzeitige Reaktion in Bezug auf Ihre Gesinnung in dieser Angelegenheit gebeten.
