=Conditions, where a member of the public has to ask the Presiding Justice to disclose, who holds a key public position in the court system is questionable to begin with.  Any ambiguity, regarding who holds the authorities of Chief Clerk, undermines the competence of the High Court of Justice as a national tribunal for acts violating fundamental rights. Moreover, the Supreme Court being the highest court of the land, such ambiguity also undermines the integrity of the entire Israeli court system.=

Occupy Tel Aviv, November 6 - Joseph Zernik, PhD, of Human Rights Alert (NGO) has forwarded a letter to Israeli Supreme Court Presiding Justice Asher Grunis, asking that the Presiding Justice disclose, who today is holding the authorities of Chief Clerk of the Supreme Court, and his/her credentials.
The unusual request comes following the departure of Ms Sarah Lifschitz from the Supreme Court on October 31, 2013.
On November 4, Dr Zernik also issued a request to renowned Israeli law professors, Daniel Friedman, Mota Kremnitzer, Menahem Mautner, Barak Medina, Amnon Rubinstein, Yedidyah Stern to exert their good faculties in affecting action by the Israel Bar Association in order to ensure lawful appointment of a Chief Clerk for the Supreme Court of the State of Israel.
"Chief Clerk" Sarah Lifschitz, who falsely appeared under that title for over 10 years, resigned as of October 31, 2013. During the period that she falsely occupied the office, corresponding to the tenure of Presiding Justices Aharon Barak, Dorit Beinisch, and Asher Grunis, the electronic records of the Israeli Supreme Court have been corrupted in an unprecedented manner.
On November 3, 2013, request was filed yesterday with the Israel Bar Association for action by the Bar to ensure lawful appointment of a Chief Clerk for the highest court of the land.
Today's letter to Presiding Justice Grunis states:
"Any ambiguity, regarding holds the authorities of Chief Clerk, undermines the competence of the High Court of Justice as a national tribunal for acts violating fundamental rights. Moreover, the Supreme Court being the highest court of the land, such ambiguity also undermines the integrity of the entire Israeli court system."
The entire affair is blacked out by Israeli media, although it was published by internet based OpEdNews.com, and was also adopted by the UN Human Rights Council in its Universal Periodic Review Report (2013).
There is no doubt that resignation of the secretary of cabinet, or the secretary of Knesset would have been immediately reported. Moreover, the resignation of "Chief Clerk" Sarah Lifschitz comes after the filing of two criminal complaints, alleging fraud in the unlawful occupation of office and fraud in certification of Supreme Court records.

Corruption of the courts is a central cause of socio-economic conditions in Israel today.

מאהל המחאה החברתית, ת"א, ה-6 לנובמבר - דר' יוסף צרניק, מ"סייג לזכויות האדם" (NGO) הגיש בקשה לנשיא בית המשפט העליון, לגלות מי מחזיק היום בסמכויות המזכיר הראשי, ולהציג את המסמכים המתאימים.

בקשה יוצאת דופן זאת הועלתה לאחר פרישתה של הגב' שרה ליפשיץ ב-31 לאוקטובר, 2013.

ב-4 לנובמבר הגיד דר' צרניק בקשה לפרופסורים ידועים למשפטים - דניאל פרידמן, מוטה קרמניצר, מנחם מאוטנר, ארנון רובינשטיין וידידיה שטרן, להפעיל את השפעתם למען פעולה על ידי לשכת עורכי הדין לאבטחת מינוי כחוק של מזכיר ראשי חדש בבית המשפט העליון. 

"מזכירה ראשית" שרה ליפשיץ, שהחתזתה ל"מזכירה ראשית" במשך יותר מ-10 שנים, פרשה ב-31 לאוקטובר, 2013. המזכיר הראשי בבית המשפט אחראי ליושרת הכתבים, ובמשך תקופת הופעתה במרמה של שרה ליפשיץ כ"מזכירה ראשית" זוייפו ושובשו רבים מכתבי בית המשפט העליון.  המכתב לפרופסורים מעלה חשש שאי פעולה מצד לשכת עורכי הדין למינוי מזכיר ראשי כחוק, ייחשב תחת ביקורת וקני מידה בינלאומיים ל"שחיתות מקצוע עריכת הדין בישראל".

המכתב מהיום, לנשיא בית המשפט העליון אשר גרוניס אומר:

"כל אי-בהירות לגבי סמכויות המזכיר הראשי מעמידה בספק את כשירותו של בית הדין הגבוה לצדק כבית דין לאומי להגנה נגד הפרה של זכויות יסוד. יתרה מזאת, אי בהירות לעניין זה בבית המשפט העליון – הערכאה העליונה במדינת ישראל - מערערת את אמינותה של מערכת בתי המשפט במדינת ישראל כולה."

העניין כולו מושתק בתקשורת הישראלית: פרישתה של שרה ליפטיץ לא דווחה עד היום בתקשורת הישראלית, וכן אי מינויו של מזכיר ראשי חדש. אין ספק שהתפטרות מזכיר הממשלה או מזכיר הכנסת היו מדווחות מיד. יתרה מכך, התפטרותה של "מזכירה ראשית" שרה ליפשיץ באה לאחר הגשת  תלונות פליליות  נגדה - על החתזות והונאה באישור החלטות בית המשפט העליון, ותלונה נוספת נגד נשיא בית המשפט העליון אשר גרוניס על הונאה לגבי חלקו בעניין.  קרוב לודאי שעל פי קני מידה בינלאומיים, המצב בבית המשפט העליון ייחשב לשחיתות.

בניגוד, עיקרי הפרשה פורסמו לאחרונה בסוכנות ידיעות באינטרנט (OpEdNews.com), כמו כן התקבלו עניינים אלה לאחר בדיקה כחלק מדו"ח הביקורת התקופתית העולמית של האו"ם על זכויות האדם בישראל (2013).
בעשר השנים האחרונות:
* התחזתה שרה ליפשיץ למזכירה ראשית בידיעתם ותמיכתם של שופטי בית המשפט העליון.
* שובשו וזוייפו כתבי בית המשפט העליון כעניין שבשגרה.
* התנהלו הליכים למראית עין כעניין שבשגרה.
* עתה, שנחשפה ההונאה והגב' ליפשיץ "פרשה". מסרב נשיא בית המשפט העליון אשר גרוניס לפרסם מי מחזיק בסמכויות בית המשפט העליון.
אין ספק שעל פי קני מידה בינלאומיים ייחשב בית המשפט העליון למושחת. 

שחיתות בתי המשפט היא גורם מרכזי במצב החברתי-כלכלי בישראל היום..
