Ocupy Tel-Aviv, January 9 - in SEC v Bank of America Corporation, Judge Jed Rakoff, now hailed as the knight of justice in banking regulation, conducted a spectacular public fraud with propensity for the ridiculous. With Ruby Krajick as Chief Clerk of the US District Court, Southern District of New York, he acted out the simulated prosecution of Bank of America by SEC, after it was discovered that Bank of America Corporation was raped by its executives. None of the executives was prosecuted.. Bank of America, the rape victim was convicted and ordered to pay a fine to itself. The prosecution was conducted in disregard of the fundamentals of the Federal Rules of Civil Procedure, or the Federal Judiciary Council Civil Litigation Manual, relative to the maintenance and attestation of litigation records.
The conduct of simulated litigation is extra-activity, not covered by any immunity. It is criminal in its essence, and here represents state organized white collar crime, as an enterprise by the federal authorities under the guise of the law and justice. It defies any semblance of loyalty to the US Constitution.

Outside counsel failed to file certificates of appearance, and both Counsel and Bank of America Corporation refused to provide any documentation of authorization of such Counsel as Counsel of Record - to appear in court, in disregard of the expressed instructions of the published Bank of America Outside Counsel Policies. Countrywide, by then merged with Bank of America, and its Chief Legal Officer Sandor Samuels by then Bank of America Associate General Counsel was opined by Judge Jeff Bohm in Texas as engaged in large-scale fraud through the employment of outside counsel with no authorization, and with a "no communications with client" clause.
Bank of America Outside Counsel also failed to comply with the instructions in same Policies, which require that Outside Counsel comply with Sarbanes Oxley Act, relative to reporting on fraud by executives. Needless to say, Bank of America senior Executives and relevant Members of the Board of Directors also violated Sarbanes Oxley Act, relative to periodic certifications of "No Fraud" in operations.
Chairman of the Board and Chairman of the Internal Audit Committee refused to accept complaints of Fraud by Management against Brian Moynihan, as General Counsel as well as CEO and President and against Sandor Samuels, Associate General Counsel.

Prof Joseph Grundfest, Stanford Law and Business Schools, former Member of the Board of the SEC, filed an affidavit on behalf of Bank of America Corporation, that the Corporation was a "tightly regulated financial institution", while he was intimately aware of the opposite. The docket failed to state on behalf of what party such affidavit was filed...
During the conduct of the spectacle, Judge Jed Rakoff was hailed by the Wall Street Journal as being "tough" on both SEC and Bank of America Corporation... Now Judge Rakoff is hailed by US media for his recent call for prosecution of banking executives.
The unprecedented level of public corruption, underlying the current financial crisis, represents social disintegration to no lesser degree than the "knockout games" by the disenfranchised.
