2018-12-12 למה בחו"ל? הצעה לפוסטר או הרצאה הוגשה לפרופ' אלי ביהם: חתימות אלקטרוניות, חירות האדם, וזכויות האדם - ישראל כמקרה בוחן

למה בחו"ל?  הצעה לפוסטר או הרצאה הוגשה לפרופ' אלי ביהם: חתימות אלקטרוניות, חירות האדם וזכויות האדם - ישראל כמקרה בוחן 
פרופ' אלי ביהם, ראש המרכז לחקר אבטחת סייבר בטכניון, פרסם היום קריאה להצעות לפוסטר או הרצאה ביום "קריפטו" בטכניון בסוף החודש.  בתשובה, שלחתי לפרופ' ביהם הצעה לפוסטר או הרצאה: "חתימות אלקטרוניות, חירות האדם, וזכויות האדם - ישראל כמקרה בוחן".  ההצעה מציינת את הרקורד הארוך שלי בתחום, כולל הרצאות בחודשים האחרונים בכנס אירופי למחשוב ממשלתי בספרד, קולוקוויום של פרופסורים למשפטים בגרמניה, וכנס לאבטחת מידע בינואר הקרוב בלונדון.  הפניה לפרופ' ביהם גם מעלה תקוה, שהטיפול בהצעה יתנהל על פי הליכים אקדמיים.  העתק נשלח לנשיא הטכניון שאישר את קבלתו.  נותר לצפות לתשובתו של פרופ' ביהם עצמו.  
כבר הדו"ח לאו"ם לשנת 2018 מתעד את המצב בישראל, בו פרופסרים בכירים בתחום המשפטים והמחשבים בישראל נחזים כמי ששותפים להסתרת המצב החמור בבתי המשפט בישראל.
פרופ' זאב שטרנהל הזכיר לאחרונה את "בגידת האינטלקטואלים" כגורם מרכזי להתדרדרות החברה באירופה לפני מאה שנה...

תל-אביב, 12 לדצמבר  - לאחר שהתקבלה קריאה של פרופ' אלי ביהם להצעות לפוסטרים או להרצאה ביום "קריפטו" בטכניון בסוף חודש זה, נשלחה לפרופ' אלי ביהם הצעה: "חתימות אלקטרוניות, חירות האדם וזכויות האדם - ישראל כמקרה בוחן"  (הקריאה התפרסמה באנגלית, ולכן ההצעה נשלחה באנגלית ג"כ - שתיהן מועתקות להלן).
ההצעה מציינת שהפוסטר או ההרצאה יתמקדו במצב העניינים ביחס ליישום חתימות אלקטרוניות במערכת נט-המשפט (מערכת ניהול התיקים של בתי המשפט המחוזיים והשלום), חוק החתימה האלקטרונית (2001), וההשלכות של מצב עניינים זה לגבי חירות האדם וזכויות האדם בישראל.
ההצעה מצינת את הרקורד העשיר שלי בהצגת נושאים דומים בפורומים אקדמיים:
* אוקטובר 2018 - הרצאה בספרד בכנס האירופי למחשוב ממשלתי.
* נובמבר 2018 - הזמנה להרצאה ודיון מעמיק בנושא דומה בקולוקוויום של פרופסורים למשפטים מאירופה בבי"ס למשפטים של אוניברסיטת גטינגן, גרמניה.
* ינואר 2019 - הרצאה שנקבעה בכנס אקדמי בלונדון בנושא אבטחת מידע.
ההצעה מציינת שארבעה דוחות בנושא התקבלו על ידי הצוות המקצועי של האו"ם: בשנים 2010 ו-2015 ביחס לארה"ב, ובשנים 2013 ו-2018 ביחס לישראל.
כרך עב כרס בן מאות עמודים בנושא הוגש לבדיקה התקופתית של זכויות האדם ע"י מועצת זכויות האדם של האו"ם בשנת 2018.  הממצאים סוכמו על ידי נציב זכויות האדם של האו"ם כך:
ההצעה מציינת שעבודות בנושא צוטטו בספר לימוד על "למידה ממוכנת" בנושא "כריית נתונים", תוך ציון השימוש בשיטות אלה למטרות מחקר בזכויות האדם על ידי כריית נתונים ממסמכים ממשלתיים, המאפשרת זיהוי הונאות במערכת החוק והמשפט - לדוגמה - בתי המשפט ובתי הסוהר...
ההצעה מציינת שהפרסומים בתחום זכו להערכה מידי מומחים מישראל ומחוצה לה, ביניהם פרופ' עוזי אורנן, עו"ד אביגדור פלדמן, ופרופ' אמנון שעשוע.
ההצעה הועתקה גם לפרופ' פרץ לביא - נשיא הטכניון, וסגן הנשיא למחקר - פרופ' וויין קפלן, מתוך תקוה שההצעה תיבחן על פי הליכים אקדמיים.
נשיא הטכניון פרופ' פרץ לביא אישר את קבלת ההצעה, אך עד עתה לא התקבלה תגובה מפרופ' אל ביהם עצמו.

Dear Prof Biham,
Via the Center for Cyber Law & Policy, Haifa University, I have received today your call for posters and proposals for the open slot for a talk in the December 31, 2018 Cryptoday at the Technion (copied below).
I write to propose a talk or a poster on the subject: E-signatures, liberty and human rights - Israel as a case study.  Such a talk or a poster would narrowly focus on the current state of implementation of e-signatures in Net-HaMishpat (case management system of the district and magistrate courts in Israel) vis-à-vis the E-signature Act (2001), and implications of such state of affairs relative to liberty and human rights. 
I have a long track record of publishing and speaking on such subjects in academic forums:
  • In January 2019 I am scheduled to speak on similar subjects in the 12th International Conference on Global, Security, Safety & Sustainability in London.
  • In November 2018, I was invited to Goettingen University Law School for a colloquium of European law professors,  on Cyber and Law, sponsored by the EU.  The colloquium held an in depth discussion of the HRA-NGO submission to the UN Human Rights Council Universal Periodic Review of Israel (2018), which focused on e-government and the cyber establishment in Israel.  Our voluminous submission was summed up in the 2018 report of the UN High Commissioner for Human Rights on Israel as follows:
24. HRA-NGO highlighted the serious deterioration in integrity of law and justice agencies as a consequence of the implementation of e-government systems. It affirmed that the validity and integrity of any legal and judicial records of Israel should be deemed dubious at best.
  • In October 2018 I spoke on similar subjects in the European Conference on Digital Government in Santiago de Compostela, Spain.
My work was also cited in a textbook on “Machine Learning”:
Data mining of government records - particularly records of the justice system (i.e., courts, prisons) - enables the discovery of systemic human rights violations in connection to generation and publication of invalid or fraudulent legal records by various government agencies.
My work in this field has won appreciation by experts in Israel and abroad:
  • Attorney Avigdor Feldman - “In my opinion you are doing very important work… thank you for your thorough and persistent work”.
  • Prof Uzzi Ornan - “All power to you! I hope that you see your tremendous efforts reach fruition!”
  • Prof Amnon Shashua, Mobileye Co-founder - “… very important work”.
  • International experts, as part of anonymous peer-review - “… challenges current thinking in the field”.
Four (4) submissions, of which I was the primary author, addressing similar subjects, and submitted under Human Rights Alert - NGO, were incorporated into UN Human Rights Council Periodic Reports  - regarding the US (2010, 2015), and regarding and Israel (2013, 2018).
I would be glad to provide additional information upon request. I hope and expect that decision in this matter would follow academic process.

On December 31st we will hold the next CRYPTODAY event at the Technion.

1. I would like to ask you to encourage your students to participate in
the poster session of CRYPTODAY 2018. The poster session is a great
opportunity for the students to present their work before the academic
community and the industry, and receive useful comments, find
cooperation oportunities, and attract the audience with new
results.

Any work in cryptology, cyber, security, privacy or related areas is
highly welcome.

Details of registering to the poster session will be published (when
ready) in the event's website
