OccupyTLV, May 8 - Joseph Zernik, PhD, of Human Rights Alert (NGO) filed yesterday in the Supreme Court reply on response (objection) by the State Prosecution on his Request to Inspect the Baranes court file.
Amos Baranes (1944-2011), Israeli, was convicted in 1976 on murder of IDF soldier Rachel Heller and was sentenced to life in prison.  His sentence was commuted after 8.5 years by the Israeli President, when it turned out that Baranes's trial was perverted, and police investigators provided fraudulent testimonies.  Following a long battle Baranes won the right for a new trial in 2002, but then the State Prosecution decided not to file an indictment, and Baranes was vindicated by default.  He also won damages for false arrest.
The Request to Inspect the Baranes court file in the Supreme Court was filed as part of a study of access to court files in the State of Israel, following major changes in administration of the courts over the past decade.  While the Israeli courts repeatedly declared that public access to court files is a "basic principle of a democratic regime", experience so far indicates that the courts place major hurdles on public access to court files.  The denial of access is particularly noticeable in cases related to corruption of government agencies.
Public access to court records is known for centuries as the fundamental way to safeguard the integrity of the courts, and absent public access to court records it is impossible to maintain the integrity of the courts.

מאהל המחאה ת"א, 8 למאי - דר' יוסף צרניק (Human Rights Alert - NGO) הגיש אתמול בבית המשפט העליון תגובה על תשובת הפרקליטות (התנגדות) על בקשתו לעיין בתיק עמוס ברנס בבית המשפט העליון.
עמוס ברנס (1944 2011), ישראלי שהורשע בשנת 1976 ברצח החיילת רחל הלר, נשפט למאסר עולם, אך עונשו נקצב על ידי נשיא המדינה לאחר שמונה וחצי שנות מאסר, כאשר התברר כי היו במשפטו עיוותי דין ועדויות שקר של חוקרי המשטרה. לאחר מאבק ארוך של ברנס לקיום משפט חוזר נקבע לו משפט חוזר ב-2002, אך עקב החלטת פרקליטות המדינה שלא להגיש כתב אישום חוזר זוכה ברנס זיכוי אילם, ואף נפסקו לו פיצויים על מאסר שווא‏[1],‏[2].
הבקשה לעיון בתיק ברנס הוגשה כחלק מסקר על גישת הציבור לעיון בתיקים בבתי המשפט בישראל, לאחר המהפך בהנהלת בתי המשפט בעשור האחרון.  בתי המשפט בישראל הכריזו שוב ושוב שזכות גישת הציבור לעיון בתיקים היא "עקרון בסיסי במשטר דמוקרטי".  אולם הסקר מראה שבפועל, בתי המשפט מקשים או מסרבים לאפשר את הגישה לעיון בתיקים.  מצב זה בולט במיוחד בתיקים הנוגעים לשחיתות רשויות השלטון.גישת הציבור לעיון בתיקי בתי המשפט מוכרת מזה מאות שנים כאמצעי הבסיסי לשמירה על יושרת בתי המשפט, וללא גישה לעיון בתיקי בתי המשפט בלתי אפשרי לשמור על יושרת בתי המשפט.

Requester's Reply on Parties' Responses on Request to Inspect Instant Court File
The Requester of Inspection files herein his Reply on Parties' Responses on Request to Inspect in instant court file:
  1. Response by the Public Defender was received by fax on April 27, 2015. [i] The Response in part says:
    A long time prior to the passing away of Baranes... the Public Defender's office stopped representing him. Therefore, the Public Defender cannot respond on the Request to Inspect.
    The Requester of Inspection does not find it necessary to reply on such Response.
  2. Response by the State Prosecution, dated April 20, 2015, was received by fax on May 3, 2015. [ii]
  3. Response by Respondent State of Israel in part says:
    Evidently, the decision on granting or denying a request to inspect depends on various considerations, provided by the Regulations of the Courts and the Labor Courts (Inspection of Court Files) – 2003. Among others, the interest of the parties and those who may be harmed by the inspection should be examined.
  4. Regarding examination of a request to inspect, the 2009 Judgment of the High Court of Justice in the Petition Association of Civil Rights in Israel et al v Minister of Justice et al (5971/97) in part says:
    The principle of public hearing is a fundamental principle of any democratic regime. It holds a constitutional status, super-statutory in our legal system, and its significance and centrality are indisputable...
    The right to inspect court records and to publish their content are derived from Basic Law: The Judicature, Article 3, which establishes the principle of public hearing, and from the rule that applies to any statutory public authority, which establishes that unless otherwise provided by statute, its records should be open and transparent....” Supreme Court Judgment, Gahel v Tax Assessment Officer (4825/98)
    Judgment in the Association's Petition also says regarding the requirement for justification by the requester of inspection versus the burden of convincing on opposition to the inspection:
    The opening position is that the inspection should be permitted, and given such opening position, the party which opposes the inspection holds the burden of convincing to deny the request to inspect...
  5. Similarly, in the October 25, 2004 Decision in Ilan Burstein's Request to Inspect in Discount Bank, LTD v Carmel Group et al (3976/04), the Supreme Court determined:
    The principle of public hearing is established in Basic Law: The Judicature, Article 3, and in The Court Act (1984), Article 68... referring to such principle, Presiding Justice Barak stated:
    Courts which are open to the public and which conduct their business in public are an essential condition for the democratic infrastructure of the State of Israel.

  6. Additionally, regarding the principle of public access to court records, the Judgment in the Association's Petition quotes the Petitioners' arguments:
    The significance of this principle is in generating public trust in the public authorities in general and in the courts in particular, since it contributes to generating the appearance of judicial process in a manner which promotes public trust in it.
  7. Similarly, a landmark ruling of the US Supreme Court finds the right of public access to court records justified, inter alia, in the need to satisfy the public's desire “to keep a watchful eye on the workings of public agencies”. [1]
  8. Therefore, when the party opposing the inspection is the State, it should be examined: Is the interest of the State in its opposition to the inspection legitimate, or is it merely an attempt by the authorities to prevent the public from “keeping a watchful eye on the workings of public agencies”?
  9. Therefore, the part of the State of Israel's Response, cited in 3., above, should be deemed as one which does not provide any real argument, and one that fails to fulfill the burden of convincing by a party who opposes the inspection.
  10. Response by Respondent State of Israel additionally says: “What records of the court file exactly does he wish to inspect?”
  11. In part, my research is aimed at examining the boundaries of the right of public access to court records in the wake of implementation of IT systems in the courts, and the administration of public access in such systems. Therefore, the Request was formulated in the most general manner, and it is likewise formulated in all other requests, which I have filed in various courts of the State of Israel. The Request pertains to all paper and electronic record and all registrations in instant court file, such as: docket of records, docket of requests, lists of service, etc. In other words, all the materials, which were referred to, prior to the implementation of IT systems (e.g., in Regulations of the Courts, Registration Office – 1936), as “records and books” of the courts.
  12. Therefore, the part of the State of Israel's Response, cited in 10., above, should be deemed as one which does not provide any real argument, and one that fails to fulfill the burden of convincing by a party who opposes the inspection.
  13. Response by Respondent State of Israel additionally says:
    What is the nature of the academic research, for which the inspection is requested, and how instant court file relates to such research and advance it, and does the Requester intend to publish it.
  14. Regarding such issues, the 2009 Judgment in the Association's Petition says (underlines added):
    The Requester needs to disclose the essence of his intention... The burden is not on the Requester of Inspection, but on the party opposing it. Under such circumstances, the requirement for justification, provided in the Regulations – which, as stated, is a minute requirement, which is unlimited in its causes – is not the burden of convincing by the Requester of Inspection, regarding permitting inspection of the court file... The harm to the right to access court records – if any – resulting from the requirement for justification is marginal and very small, and does not amount to harm which requires the examination of the Regulations from the constitutional perspective...
    The weight of the right to access court records by one who asks to inspect a court file out of prurience is lesser than the right of one who asks to inspect the court file for the purpose of study or research.
  15. Therefore, the part of the State of Israel's Response, cited in 13., above, should be deemed as one which does not provide any real argument, and one that fails to fulfill the burden of convincing by a party who opposes the inspection.
  16. Replying on the questions raised by Respondent State of Israel, cited in 10., above, I add: Generally, it is necessary to conduct preliminary examination of the research materials prior to defining the best research questions. Therefore, I would be hard pressed to detail research questions beyond that which was stated in the Request. However, at this point, it appears that material is accumulating, which is sufficient for writing a preliminary paper on the process of Request to Inspect (e.g., instant Request) and the exercise of public access to court records in the State of Israel in practice, in the wake of the 2009 Judgment in the Association's Petition and the revolution in administration of the courts over the past decade. The collection of requests to inspect, which I have filed in recent years in the Supreme Court and in other courts, is probably unparalleled in its scope. Moreover, it is unique, since the Requester holds no personal interest in the court files themselves, except for the academic interest. The Editor of a well-known Israeli academic legal journal expressed preliminary interest in publishing such paper.
  17. Additionally, regarding to the questions raised by Respondent State of Israel, cited in 10., above:
    The requests to inspect criminal court files (such as instant court file), hold great significance not only relative to the right to access court records, but also relative to Human Rights.
  18. Relative to State of Israel's Response in general:
    The basic principle of the right of public access to court records is recognized in the law of the English speaking nations as inseparable from Freedom of Speech, Freedom of Expression, and Freedom of Information. Such relationship is also stated in Judgment in Gahel v Tax Assessment Officer, quoted in 4., above. There is room for concern that the general questions, raised by Respondent State of Israel in its Response on the Request to Inspect in instant court file are similar or identical in their essence to an attempt of Prior Restraint of Freedom of Expression and Freedom of the Press. Regarding Prior Restraint, the Israeli Supreme Court determined in the Snitzer affair in 1989, similar to a principle that was established in rulings of the US Supreme Court a century ago, that Prior Restrain must not be permitted, unless there is certain existence of “serious material” harm for State security or public peace and welfare.
  19. In summary:
    Jointly, the Requester's Request and instant Reply should be deemed as surpassing the requirements from a requester to inspect, as outlined in the Judgment in the Association's Petition. In contrast, the Response by State of Israel in all its parts should be deemed as failing to raise any real argument, and failing to fulfill the burden of convincing by a party opposing the inspection.
  20. To the degree that State of Israel would find it necessary to respond on my Reply, I herein request that the Court order Respondent State of Israel to serve its respond on me, and if deemed necessary, I would ask a leave to reply again.
The Court should grant instant Request to Inspect in compliance with provisions of the law and the fundamentals of justice.

  3. תשובת המשיבה מדינת ישראל אומרת בחלקה:
כידוע, ההחלטה אם להיעתר לבקשת העיון או לדחותה – תלויה בשורה של שיקולים הקבועים בתקנות בתי המשפט ובתי הדין לעבודה (עיון בתיקים) – תשס"ע-2003. בין היתר יש לבחון את עניינם של בעלי הדין ושל מי שעלול להיפגע כתוצאה מהעיון.
  1. לעניין בחינת הבקשה לעיון, פסק הדין משנת 2009 בעתירת האגודה לזכויות האזרח ואח' נ שר המשפטים ואח' (בג"ץ 5917/97) אומר בין השאר:
עקרון פומביות הדיון הוא עקרון יסוד של כל משטר דמוקרטי. הוא בעל מעמד חוקתי על-חוקי בשיטתנו המשפטית, ועל חשיבותו ומרכזיותו אין חולק...
"הזכות לעיין במסמכי בית המשפט ואף הזכות לפרסם את תוכנם נגזרות מסעיף 3 לחוק יסוד: השפיטה, הקובע את עקרון פומביות הדיון, ומן הכלל החל על כל רשות ציבורית הממלאת תפקיד על-פי דין, ולפיו, בהעדר הוראה חקוקה הקובעת אחרת, מסמכים שברשותה צריכים להיות גלויים ופתוחים...". פסק הדין בע"א 4825/97 גהל נ' פקיד השומה למפעלים גדולים, פ"ד נה(2) 433, 437 (2001)
וכן אומר פסק הדין בעתירת האגודה לגבי חובת ההנמקה של מבקש העיון לעומת נטל השכנוע על המתנגד לעיון:
נקודת המוצא הינה כי יש להתיר את העיון, ובהתחשב בנקודת מוצא זו, על בעל הדין המתנגד לעיון הנטל לשכנע כי אין להתירו...
  1. בדומה, בהחלטה מיום 25 לאוקטובר, 2004, על בקשה לעיון של אילן בורשטיין בתיק בנק דיסקונט לישראל בע"מ נ. קבוצת כרמל ואח' (3976/04), קבע בית המשפט העליון:
    3. עקרון פומביות הדיון מעוגן בס' 3 לחוק יסוד: השפיטה ובסעיף 68 לחוק בתי המשפט [נוסח משולב] התשמ"ד-1984 בהתייחסו לעקרון זה אמר הנשיא ברק:
    בתי משפט, הפתוחים לקהל והעושים דין בפומבי, הינם תנאי חיוני לתשתיתה הדמוקרטית של מדינת ישראל.
    ב"ש 678/82 טייר נ מדינת ישראל ואח' פ"ד לו (3) 386 ,387).
  2. בנוסף, לגבי עקרון זכות העיון בכתבי בתי המשפט, מצטט פסק הדין בעתירת האגודה את נימוקי העותרים:
    חשיבותו של עקרון זה ביצירת אמון הציבור ברשויות הציבור בכלל ובבתי המשפט בפרט, שכן הוא תורם ליצירתה של מראית פני הליך עשיית הצדק באופן המקדם אמון זה.
  3. בדומה מוצאת פסיקה בעלת חשיבות היסטורית של בית המשפט העליון של ארה"ב את הבסיס לזכות העיון, בין השאר, בצורך לספק את רצונו של הציבור "להחזיק עין מפקחת על פעולותיהן של הרשויות הציבוריות.” [1]
  4. לפיכך, כשבעל הדין המתנגד לעיון הוא המדינה, מן הראוי שבית המשפט יבחן: האם עניינה של המדינה בהתנגדותה לעיון עניין לגיטימי, או שמא הוא ניסיון של הרשויות למנוע את יכולתו של הציבור "להחזיק עין מפקחת על פעולותיהן של הרשויות הציבוריות"?
  5. לפיכך, מן הראוי לראות את חלקה של תשובת המשיבה מדינת ישראל, המצוטט ב-3., לעיל, כשאינו מעלה כל טיעון של ממש, וכשאינו מספק את נטל השכנוע על בעל דין המתנגד לעיון.
  6. תשובת המשיבה מדינת ישראל אומרת עוד:
    בדיוק באילו מסמכים מתוך איזה תיק ברצונו לעיין.
  7. בחלקה, מטרת מחקרי לבדוק את גדרי זכות העיון בכתבי בתי המשפט בעקבות הנהגת מערכות המידע האלקטרוניות, וכן את ניהול התיקים וניהול גישת הציבור לתיקים במערכות אלה. לפיכך, נוסחה הבקשה בצורה הכללית ביותר, והיא מנוסחת בצורה כמעט זהה בכל הבקשות שהגשתי בשנים האחרונות בבתי המשפט השונים במדינת ישראל. הכוונה היא לכלל הכתבים, ובתוכם כתבי נייר וכתבים אלקטרוניים, ולכלל הרישומים בתיק זה, כגון: רשימת הכתבים, רשימת הבקשות, רשימת ההמצאות, וכו'. במילים אחרות, כלל החומר שנקרא לפני הנהגת מערכות המידע האלקטרוניות, (לדוגמה, בתקנות בתי המשפט - משרד רישום, 1936) "כתבים ופנקסים” של בתי המשפט.
  8. לפיכך, מן הראוי לראות את חלקה של תשובת המשיבה מדינת ישראל, המצוטט בפסקה 10., לעיל, כשאינו מעלה כל טיעון של ממש, וכשאינו מספק את נטל השכנוע על בעל דין המתנגד לעיון.
  9. תשובת המשיבה מדינת ישראל אומרת עוד:
    מה טיבו של המחקר האקדמי בגדרו מתבקש העיון בתיק, כיצד התיק נשוא העיון נוגע אליו ומקדם אותו וכן האם יש בכוונת המבקש לפרסמו".
  10. לעניין זה אומר פסק הדין משנת 2009 בעתירת האגודה בין השאר (קו תחתון הוסף):
על מבקש העיון לגלות בתמצית את מטרת העיון... הנטל הוא לא על מבקש העיון כי אם על המתנגד לו. במצב דברים זה, אין בדרישת ההנמקה הקבועה בתקנות - שהינה כאמור דרישה מזערית אשר אינה מוגבלת בעילותיה - משום הטלת נטל השכנוע להתרת העיון בתיק על מבקש העיון... הפגיעה בזכות העיון - אם נגרמת - כתוצאה מדרישת ההנמקה הינה פגיעה שולית וקטנה ביותר, אשר בכל מקרה אינה עולה כדי הפגיעה המחייבת את בחינת התקנות במשקפי הבחינה החוקתית...
משקלה של זכות העיון של מי שמבקש לעיין בתיק מתוך סקרנות גרידא פחוּת ממשקל זכותו של מי שמבקש לעיין בתיק לצורך לימוד או מחקר.
  1. לפיכך, מן הראוי לראות את חלקה של תשובת המשיבה מדינת ישראל, המצוטט בפסקה 13., לעיל, כשאינו מעלה כל טיעון של ממש, וכשאינו מספק את נטל השכנוע על בעל דין המתנגד לעיון.
  2. אוסיף בתשובה לשאלות המשיבה מדינת ישראל, המצוטטות בפסקה 13., לעיל:
    בדרך כלל, יש צורך בבדיקה מקדמית של חומר המחקר לפני הגדרת השאלות המתאימות. לפיכך, אתקשה להגדיר בבירור את שאלות המחקר מעבר למה שתואר בבקשה בשלב זה.
    אולם בשלב זה נראה שהולך ומצטבר חומר מספיק לכתיבת מאמר ראשוני העוסק בהליכי הבקשה לעיון (כגון בקשה זאת) ומימוש גישת הציבור לעיון בתיקים במדינת ישראל בפועל, בעקבות פסק הדין משנת 2009 בעתירת האגודה והמהפך שחל בהנהלת בתי המשפט בעשור האחרון. אוסף הבקשות לעיון, שהיגשתי בשנים האחרונות בבית המשפט העליון ובבתי משפט אחרים, הוא ככל הנראה חסר תקדים בהיקפו. יתרה מכך, אוסף זה ייחודי, משום שלמבקש העיון אין כל עניין אישי בתיקים עצמם, פרט לעניין האקדמי. עורך של כתב עת משפטי ישראלי ידוע הביע עניין מקדמי בפירסום מסוג זה.
  3. אוסיף בתשובה לשאלות המשיבה מדינת ישראל, המצוטטות בפסקה 13., לעיל:
    הבקשות לעיון בתיקים פליליים (כגון תיק זה), הן בעלות חשיבות יתרה לא רק מבחינת עקרון גישת הציבור לעיון בתיקים, אלא גם מבחינת זכויות האדם.
  4. לגבי תשובת המשיבה מדינת ישראל בכללותה:
    העקרון הבסיסי של זכות העיון בתיקים מוכר בחוקי האומות דוברות האנגלית כחלק בלתי נפרד מעקרונות חופש הביטוי, חופש העיתונות, וזכות הציבור לדעת. קשר זה מוכר גם בפסק הדין בגהל נ פקיד השומה למפעלים גדולים, שצוטט בפסקה 4., לעיל. יש מקום לחשש שהשאלות הכלליות, שהועלו על ידי המשיבה מדינת ישראל בתשובתה על הבקשה לעיון בתיק זה, הן קרובות או זהות במהותן לניסיון מניעה מוקדמת של חופש הביטוי וחופש העיתונות. לעניין מניעה מוקדמת, קבעה הכרעת בג"ץ בעניין שניצר בשנת 1989, בדומה לעקרון דומה שבוסס בפסיקות בית המשפט העליון בארה"ב כבר לפני כמאה שנה, שאין לאפשר מניעה מוקדמת של חופש הביטוי וחופש העיתונות, אלא בהתקיים ודאות קרובה לפגיעה "קשה או ממשית" בביטחון המדינה ובשלום הציבור.
  5. לסיכום:
    יחדיו, מן הראוי לראות את הבקשה לעיון ותגובת מבקש העיון כאן כעולות על הנדרש ממבקש העיון על פי פסק הדין בעתירת האגודה. לעומת זאת, מן הראוי לראות את תשובת המשיבה מדינת ישראל על כל חלקיה, כשאינה מעלה כל טיעון של ממש, וכשאינה מספקת את נטל השכנוע על צד המתנגד לעיון.
  6. ככל שהמשיבה מדינת ישראל תמצא לנכון להשיב על תגובתי זאת, הריני מבקש בזאת שבית המשפט יורה למשיבה מדינת ישראל להמציא לי את תשובתה, ובמידת הצורך אבקש את רשותו של בית המשפט להגיש תגובה נוספת.
מן הדין והצדק שבית המשפט יתיר את העיון בתיק זה.
