Israeli Media are too compliant with the corrupt courts.
#OccupyTLV, April 16 - yesterday I published widely by email, Facebook, blog, etc, regarding the arrest of MAJD KAYYAL in Haifa, with copies of the April 13, 2014 decision by Judge Dr Zaid Falah, which was given "behind closed doors". The Decision also contained a purported Prohibition of Publication Decree on the entire case. [1]
Previously, I published two other files from the same court, which were also purportedly conducted "behind closed doors', and where explicit judicial orders by Judge Esperanza Alon purported to prohibit me specifically from the publication of the same. [2]
Yet, the authorities make no response!
The situation is laughable, both regarding the Publication Prohibition Decrees and also regarding compliance of Israeli media with such blatant violation of Human Rights and Freedom of the Press.
Public access to court records is a fundamental right. Its restriction in Israel through a decision of former Presiding Justice Beinisch, created the fertile soil for judicial corruption.

מאהל המחאה ת"א, 16 לאפריל - אתמול פרסמתי בתפוצה רחבה בדוא"ל. פייס, בלוג, וכו, ברחבי העולם על מאסרו של מג'ד כיאלי בחיפה, בלויית העתק החלטתו של השופט דר' זאיד פלאח מיום ה-13 לאפריל, 2014, שנתנה כבכיכול "בדלתיים סגורות", ובשעה שעל המקרה כולו הוצא כביכול "צו איסור פרסום". [1]
זאת לאחר שפרסמתי שני תיקים אחרים שנערכו "בדלתיים סגורות" באותו בית משפט, וששם גם נאסר כביכול עלי הפרסום במפורש בהחלטה שיפוטית למראית עין של השופטת אספרנצה אלון. [2]
והרשויות אינן מגיבות!
מצב זה הופך לבדיחה הן את צווי איסור הפרסום בישראל, והן את ההישמעות לצווים אלה, העומדים בסתירה ליסודות זכויות האדם וחופש העיתונות, על ידי התקשורת בישראל.
גישת הציבור לכתבי בית דין היא זכות אזרחית בסיסית. הגבלת זכות זאת על ידי נשיאת בית המשפט העליון לשעבר דורית בייניש יצרה קרקע פוריה לשחיתות השופטים.

QUESTION: Is this – recognizing that you don’t have an interest because he is not an American citizen, do you – is this the kind of thing that you – that causes you concern, these types of arrests, or is this something --
MS. PSAKI: Certainly, reports of journalists being arrested certainly cause concern, but we don’t have any confirmation of that specific case, so we’re just looking for more information.

MS. PSAKI: I’d have to check on that. I believe we were exploring through all avenues we have, but I don’t want to speak out of turn, so let me check back with our team

צו איסור פרסום

האזרח הישראלי מאג'ד כיאל, אקטיביסט המתגורר בחיפה, חזר השבוע מכנס 40 שנה לעיתון אל-ספיר שנערך בביירות. דבר נסיעתו היה ידוע למשפחתו, למכריו, לחבריו, ולכל מי שנכנס לדף הפייסבוק שלו, ואפילו פרסם על כך מאמר בעיתון. לא בדיוק שליחות סודית. לדאבוני, בעקבות צו איסור פרסום שהוציא השופט זיאד פלאח בפרוטוקול שעל פי מקורות זרים מתפרסם במלואו ברשת, אני לא יכול לספר לכם איפה נמצא כיאל עכשיו, למרות שמשפחתו, חבריו, מכריו, וכל אדם עם חיבור לרשת יכול לברר את זה בקלות. מי לא יכול לדעת איפה הוא? אזרחי ישראל הנסמכים על התקשורת הישראלית.

מאותה סיבה, למשל, לא שמעתם גם על מוחמד אבו ח'ידר, עיתונאי מירושלים שנעצר בנובמבר ע"י כוחות הבטחון אחרי שחזר מביקור במצרים. הארגון הבינ"ל כתבים ללא גבולות הוציא גינוי רשמי, כל מי שח'ידר נפגש איתו אי פעם שמע על דבר המעצר, אבל אזרח ישראל הנסמכים על התקשורת הישראלית - כלום.

גם את קורותיהם של כעשרה עורכי דין ישראלים ופלסטינים לא יכולתם לגלות במשך כחודש מרגע מעצרם, למרות שפרטי הפרטים של הפרשה היו ידועים לכל מי שרק ביקש לדעת. הם נעצרו ב-24 בפברואר ודבר מעצרם הותר לפרסום רק ב-6 באפריל. מעל חודש בו אזרחי ישראל הנסמכים על התקשורת הישראלית לא ידעו דבר. אגב, יש עוד קבוצה של עורכי דין ישראלים ופלסטינים עצורים שגם את דבר מעצרם לא יכלו אזרחי ישראל הנאמנים לדעת. הם גם לא יכלו לדעת שהם התלוננו על שימוש בעינויים במהלך חקירתם.

דוגמא נוספת, טיפשית במיוחד, סיפק חיים לוינסון בעמוד הפייסבוק שלו: שני נערים הדפיסו במדפסת הביתית כמה דפי A4 שאת תוכנם אי אפשר לדעת, אלא אם כן יש לכם חיבור לאינטרנט.

הדוגמאות האלה ועוד רבות רבות אחרות באות להראות שצו איסור הפרסום הניתן באופן אוטומטי לכל גחמה של שירותי הבטחון הוא אווילי ומיותר. אם כל מי שבאמת מעורב בפרשה יודע את פרטי פרטיה, הצורך היחיד שהצו בא למלא הוא הסתרה של פעולות אנטי-דמוקרטיות מעיני הציבור, כמו למשל מניעת מפגש עם עורך דין או פרקטיקות חקירה פסולות. יתרה על כך: עצם האיסור על דיון בעניין מסוים ואיום במעצר על אלה שכן מבקשים לדבר עליו מעודד חתרנות במעגל שמזין ומגביר את עצמו. המדינה הופכת אנשים המבקשים לדבר על גבולות חופש הביטוי לפושעים, ואם הם פושעים - כל מה שיגידו הוא בגדר בגידה ועבירה על החוק. טאוטולוגיה הלרית.

מה שהיה פעם אמצעי חקירה הפך לכלי נגד הציבור עליו הוא אמור, כביכול, להגן. הצידוק היחיד שעוד נותר להוצאת צו כזה הוא מניעת הפעלת לחץ ציבורי, שכן אם הציבור לא יודע - הוא לא יכול להתקומם נגד מה שנראה התעמרות של המדינה באזרחיה ממניעים פסולים.

מה שהממשלה לא מבינה הוא שכאשר סותמים לאנשים את הפה, הם מוצאים דרכים אחרות להתבטא, והדרכים האלה רק ירחיקו אותם ממנה, ולא להפך. "תרופת ההרגעה" הזו, הבורות המבורכת שמבקשת המדינה להשית עלינו, האזרחים, היא חרב פיפיות: ככל שתסתירו מאיתנו, כך נבקש לדעת עוד. ככל שתעבדו במחשכים, לשם נכוון את זרקורינו.

המגמה הזו של ההסתרה רק הולכת ומתגברת. היא נובעת הרבה מתסכול. אפשר לראות דוגמא קיצונית שלה במהלך שמוביל שר הבטחון יעלון למען כליאה ללא משפט של מתנחלים, דבר המרחיב את הפגיעה האנושה באופי הדמוקרטי של מדינת ישראל הקיים גם כך מעצם כליאתם של מאות פלסטינים ללא משפט וללא ראיות. אסור לנו לעמוד מנגד כאשר המדינה מנסה לגזול עוד קצת, להרחיב את האמצעים האלה, להגביר את החושך. אם לא נצעק עכשיו, אחר כך כבר כבר יהיה מאוחר מדי.
