Enforcement and Collection Authority, in re: Kelim Shluvim
IT-system.
Your
response within 14 days is kindly requested.
Dear
FOIA Officer:
On
May 13, 2015, the Freedom of Information Enforcement Unit of the
Ministry of Justice issued its Decision [1] on my Complaint
[2] regarding failure of the Enforcement and Collection
Authority to duly respond on the FOIA Request, referenced above. [3]
My
January 1, 2015 Complaint, [2] filed with the Ministry of
Justice FOIA Enforcement Unit, listed the following fundamental
defects in purported December 18, 2014 Response, [4] issued by
the Authority on my FOIA Request:
a)
The purported Response was by Ms Rivca Aharoni, using the title “FOIA
Officer”. Ms Rivca Aharon holds no valid appointment as “FOIA
Officer”, as detailed in previous correspondence. [5]
The
FOIA Enforcement Unit Decision fails to address this point.
b)
The purported Response is unsigned, in disregard of October 29, 2014
Decision of the FOIA Enforcement Unit on Complaint 68/14 on past,
similar conduct by Ms Aharoni. [6]
The
FOIA Enforcement Unit Decision fails to address this point.
c)
The purported Response includes neither a Request number nor a
Reference number, as required in official, valid State government
communications.
The
FOIA Enforcement Unit Decision fails to address this point.
d)
The purported Response fails to address in any way the request for
records in the FOIA Request.
On
this issue, the Decision on Complaint 2-15 says:
The
[FOIA-jz] Response fails to explicitly address the demand by the
Complainant for receipt of records, pertaining to “Kelim Shluvim”
IT system...
Regarding
such records, the the Respondent on the Complaint informed us, that
there was a need for clarifications by the Complainant, since there
might be a difference between the terms, used in the FOIA Request,
and those recognized by the Respondent...
The
Respondent on the Complaint should expediently send the Complainant a
Response on the FOIA Request, explicitly addressing the existence of
the requested records...
Therefore,
I again request the records,
pertaining to the following:
1)
Compliance of development and implementation of “Kelim Shluvim”
IT system with Treasury Accounting Office Standards, and October 28,
1991 Cabinet Decision 103/eco, pertaining to development and
maintenance of IT systems:
a)
Certification of IT system specifications in conjunction with
signing contracts for its development
by a State employee, including but not limited to his name, title,
appointment record (if pursuant to a tender number – the tender
document detailing the position).
b)
Reports of core management of IT system development
by a State employee, including but not limited to his name, title,
appointment record (if pursuant to a tender number – the tender
document detailing the position).
c)
Examination and validation of IT system prior to
implementation by a State
employee, including but not limited to his name, title, appointment
record (if pursuant to a tender number – the tender document
detailing the position).
2)
State authorities, which hold the responsibility for security of the
servers and IT systems of the Enforcement and Collection Authority
(e.g., National Information Security Authority-Shin-Bet?)
The
Request is explicitly for records.
It should be noted that the Enforcement and Collection Authority has
never provided a single record in response on any of my FOIA
Requests, only general statements in unsigned letters by an
unauthorized person.
Regarding
the request by the Enforcement and Collection Authority for further
clarifications:
- References were provided in the body of the original request to specific relevant Procedures of the General Accounting Office of the Ministry of Treasury and specific Government Decision.
- As further clarification, the terms used in my FOIA Request correspond to those used in the State Ombudsman's Report 60b, 2010 (pp 693 et seq), regarding development of IT systems in the Ministry of Justice and the courts in the previous decade. [7]
- As further clarification, the terms used in my FOIA Request also correspond to the terms found in the binding, Israeli government's IT-system Development and Maintenance Procedures. [8]
International
observers are likely to find the claims by the Enforcement and
Collection Authority, regarding lack of clarity in the terms used in
the FOIA Request ludicrous. Moreover, it is likely that conduct of
the Enforcement and Collection Authority regarding instant FOIA
Request will be seen as additional evidence, beyond that in the above
referenced State Ombudsman's Report, responses by the Enforcement
and Collection Authority on similar questions by Counsel for the
Petitioners in Ashkenazi+76 others v
Minister of Justice et al (HCJ
2300/11), [9]
and growing evidence regarding the operation of “Kelim Shluvim”
in practice.
Given
such extensive body of evidence, international observers are likely
to conclude that the Debtors' Courts, administered by the Enforcement
and Collection Authority of the Ministry of Justice, are engaged in
serious violations of the Debtors' fundamental Human Rights for Fair
Hearing, and that conduct of the Debtors' Courts is in fact
large-scale theft under the color of law, and a key factor in
increasing poverty in the State of Israel.

על ידי אדם חסר סמכות כדין.
לעניין
בקשת רשות האכיפה והגבייה להבהרות נוספות:
- אסמכתות ניתנו בגוף הבקשה המקורית לתקן החשכ"ל במשרד האוצר (ר' הוראות תכ"מ / תקנות כספים ומשק) ולהחלטת ועדת השרים לכלכה מס' 103 /כל מיום 28 לאוקטובר,1991.
- לשם הבהרה נוספת, המונחים בהם נוקטת הבקשה גם תואמים את המונחים בהם השתמש מבקר המדינה בדו"ח 60ב' משנת 2010 (עמ' 693 ואילך)על מחשוב במשרד המשפטים ובתי המשפט בעשור הקודם. [7]
