12-05-16 Are there two, one, or zero, lawfully appointed "Keepers of the Seal" of the State of Israel?

The law prescribed in 2001 the appointment of a Registrar of Certifying Authorities for electronic signatures.  Over the next decade several individuals possibly held the office - "Keepers of the Seal".  However, public records of legal semblance, originating in the government of the State of Israel, including, but not limited to the recent Freedom of Information response by the Ministry of Justice, are inconsistent and/or contradictory on who held the office, and when.  Most of the "Guidelines" of the Registrar, are published undated, and with no named individual as their author. 
The findings regarding the conduct of the office of the Registrar of Certifying Authorities, and previously documented conduct of the office of Chef Clerk of the Supreme Court of the State of Israel, should raise concerns regarding the integrity of any public legal records, originating in the courts and justice system of the State of Israel.  Under such conditions, the financial system should be deemed at risk as well.

Jerusalem, May 16 - "It is part of a consistent pattern of corruption of the electronic records of the State of Israel," says Joseph Zernik, PhD, of Human Rights Alert (NGO)

Human Rights Alert's (NGO) recent submission for the Universal Periodic Review (UPR) of Human Rights in Israel is narrowly focused on "Integrity, or lack thereof, in the electronic records of the courts of the State of Israel". [1,2]
As part of the submission, requests were filed, pursuant to the Freedom of Information Act (1988) (FOIA) regarding various aspects of certification and authentication of legal public records.  Today, Human Rights Alert has released the response by the Ministry of Justice, on request for the appointment records of the Registrar(s) of Certifying Authorities, pursuant to the Electronic Signature Act (2001).[3,4]  The response denied the request, claiming that the information was published in Reshumot (the official Register of the State of Israel). 

However, the FOIA response failed to provide the specific references in Reshumot.

Moreover, the response named only two appointments for the entire period since the signing of the FOIA in 2001:

• < August 28, 2011 - No Registrar
• August 28, 2011 - Attorney Yoram HaCohen appointed Registrar, and
• September 19, 2011 - Attorney Amit Ashkenazi appointed Registrar (without subtracting from the authority

[of- jz] Attorney Yoram HaCohen).  [It is unclear that the Act permits the simultaneous appointment of two Registrars- jz] In his reply today to the Ministry of Justice, Dr Zernik notes that the information provided by the Ministry of the Justice, was inconsistent or contradictory of other public records of legal semblance:

• Reshumot, Guidelines of the Registrar of Certifying Authorities, names Atty Dror Aram, as Registrar in 2003 and 2004,
• Reshumot, Guidelines of the Registrar of Certifying Authorities, shows Guidelines by unnamed Registrars in 2004, 2009, 2010. [6]
• Annual Report of the Registrar of Certifying Authorities, 2007 [7] lists Atty Amit Ashkenazi as the Registrar of Certifying Authorities. appointed on January 10, 2007
• Annual Report of the Justice, Information, Technology Authority, 2008  [7] describes departmental reorganization, following which, no individual was named as appointed Registrar of Certifying Authorities.
• Undated Press Release (December 13, 2009?) lists enforcement action re: ComSign, as the last by the Registrar of Certifying Authorities Atty Amit Ashkenazi and notes his then recent replacement by Atty Yoram HaCohen

The response by the Ministry of Justice also raises concerns regarding the integrity and the authority of the official Register of the State of Israel (Reshumot).

Both the Ministry of Justice and the Administration of Courts refuse to answer on the related question:
Were any electronic signatures and certifying authorities, , pursuant to the Electronic Signature Act (2001), implemented in the Supreme Court of the State of Israel? 

Guideline 2-2010, published by an unnamed Registrar of Certifying Authorities, in part states:

Pursuant to Article 18(d) of the Act... a Certifying Authority should use 'Only valid, reliable hardware and software systems' "

In contrast, the Guidelines of the Registrar of Certifying Authorities, like other Reshumot records, are published on a server, whose identity is not verified.  Moreover, none of the electronic records, published as "Guidelines of the Registrar of Certifying Authorities", bears a valid, visible electronic signature, pursuant to the Electronic Signature Act (2001), and most of the Guidelines are published undated, with no name of their author.

An undated press release by the office of the Registrar of Certifying Authorities in part says: [9]

According Attorney Amit Ashkenazi [bold in original – jz]: “The Registrar of Certifying Authorities enforces the registration and oversight regarding activities related to the issuance of electronic records, in order to provide the public assurances regarding this important service…

The unreliable nature of the documents, originating in or pertaining to the Registrar of Certifying Authorities, resembles the nature of documents, originating in or pertaining to the Chief Clerk of the Supreme Court. The Human Rights Alert 2012 UPR Submission documents the unreliable nature of records, originating in the Supreme Court of the State of Israel, the district courts and the detainees courts. [1,2]
The Human Rights Alert 2012 UPR Submission concludes that "The validity of any legal public records, originating in the courts of the State of Israel should be re-assessed;"

"The findings should raise concerns regarding stability of the financial system in the State of Israel," states Dr Zernik.  Data from the ongoing financial crisis in the United States show that corruption of electronic records in mortgage underwriting, banking regulation, registration services, and the courts are central to the crisis. [10]
The Human Rights Alert 2012 UPR Submission recommends that major efforts should be made to address what amounts to a constitutional crisis in a nation with no constitution:
1.       The electronic records systems of the courts should be examined and repaired by Israeli computing/legal experts, under accountability to the legislature.
2.       A Truth and Reconciliation Commission should be established relative to events surrounding the 2002 death of Supreme Court Chief Clerk Shmaryahu Cohen and the role of the judiciary in implementation of the invalid, false and deliberately misleading electronic record systems in the courts; 
3.       No court of any nation should be permitted to develop and implement its own electronic record systems.

The 2010 submission of Human Rights Alert to the Human Rights Council (HRC) of the United Nations was reviewed by the HRC professional staff and incorporated in the official HRC Professional Staff Report with a note referring to “corruption of the courts and the legal profession and discrimination by law enforcement in California.”  ___________LINKS:

Huge Loss at JP Morgan Proves Even The Risk-Management Experts Can't Regulate Themselves
  Felix Salmon explains what happened with JP Morgan yesterday and it's frankly kind of scary. Nobody seems to think this has indications for the greater financial system at the moment but then we've heard that before. In any case, he ends with this:

[T]his loss only goes to show how weak the Volcker Rule is: Dimon is adamant, and probably correct, in saying that Iksil’s bets were Volcker-compliant, despite the fact that they clearly violate the spirit of the rule. Now that we’ve entered election season, Congress isn’t going to step in to tighten things up ­ but maybe the SEC will pay more attention to Occupy’s letter, now. JP Morgan more or less invented risk management. If they can’t do it, no bank can. And no sensible regulator can ever trust the banks to self-regulate.

Gosh that sounded familiar. Oh right:

JPMorgan this week finalised a $US153.6 million ($145m) settlement with the SEC over claims it misled investors about collateralised debt obligations created before the global crisis.

Dimon admits banks -- including his -- made mistakes.

Ever the salesman, though, he is confident JPMorgan has righted the wrongs and says it is disappointing that Wall Street's reputation is so tarnished.

"It's so unfair to talk about Wall Street and ethics," he says.

"The people that we deal with a lot on Wall Street are some of the most ethical people I know.

"There are some bad apples on Wall Street. I think the military is the most extraordinary organisation but there are some bad apples in the military.

"I think universities are unbelievable but there are some bad apples in universities. I think reporters for most part are smart and hard-working people, but there are some bad apples as reporters."

Yes, that was so unfair.

I don't know if any of that talk about misleading people this week is going to turn out to be relevant to be honest. But you would think that Dimon, of all people, would have been careful about such things. On the other hand, what's the difference? They apparently didn't violate the Volcker Rule even with 2 billion in losses and the SEC probably won't do much.

JP Morgan Chase was known for being the best in the business at risk management --- rare entity that didn't get caught up in the speculative fever that characterized the business before the crash. And as a result Dimon took the lead in making lugubrious pleas to leave the poor banks aloone, insisting that regulations like Dodd-Frank were destroying the very foundation of the financial system which was well able to regulate itself. Well, how'd that work out?

Let's all pray that nobody's bonus is affected by all this. I couldn't take the weeping.

While giving a talk to Georgetown University’s Labor Lab on April 30th, renown community organizer Stephen Learner boasted some peculiar parenting accomplishments, while bringing into question his version of the Jewish tradition of Bar Mitzvah.

Lerner began his speech by bragging about his disruption of Washington DC in the Justice for Janitors campaign of the 80‘s and 90’s:

“Do people know about when we shut down Washington, D.C.?  Does anybody know that story?  So we had this idea to get– that if we couldn’t picket the buildings anymore because of secondary boycott law, maybe we should just shut the city down.  So we parked school buses across the bridges into the city and set up classrooms to symbolize that pacts weren’t being paid, and the schools were in deterioration.”

He then announced a point of personal importance and pride over the protest:

“An important event in my life because my oldest son got arrested for his first time.  And it was very big event, [we're] joking now that the leftist bar mitzvah is when your son gets arrested for the first time.  And he then– just a great side story– at our local elementary school my youngest son, they said during story time, “do you have anything to share?”  And he said, “yes, my brother went to jail last night.” And the teacher said, “Oh, that’s ok it happens to all of us, you know it will get worked out.”  And my youngest son said, “We’re so proud.”

It's time for EvolutionICELAND. No news from Iceland?… why? How come we hear everything that happens in Egypt but no news about what’s happening in Iceland:

In Iceland, the people has made the government resign, the primary banks have been nationalized, it was decided to not pay the debt that these created with Great Britain and Holland due to their bad financial politics and a public assembly has been created to rewrite the constitution.

And all of this in a peaceful way. A whole revolution against the powers that have created the current global crisis. This is why there hasn’t been any publicity during the last two years: What would happen if the rest of the EU citizens took this as an example? What would happen if the US citizens took this as an example.

This is a summary of the facts:

2008. The main bank of the country is nationalized.
The Krona, the currency of Iceland devaluates and the stock market stops. The country is in bankruptcy

2008. The citizens protest in front of parliament and manage to get new elections that make the resignation of the prime minister and his whole government.
The country is in bad economic situation.
A law proposes paying back the debt to Great Britain and Holland through the payment of 3,500 million euros, which will be paid by the people of Iceland monthly during the next 15 years, with a 5.5% interest.

2010. The people go out in the streets and demand a referendum. In January 2010 the president denies the approval and announces a popular meeting.
In March the referendum and the denial of payment is voted in by 93%. Meanwhile the government has initiated an investigation to bring to justice those responsible for the crisis, and many high level executives and bankers are arrested. The Interpol dictates an order that make all the implicated parties leave the country.

In this crisis an assembly is elected to rewrite a new Constitution which can include the lessons learned from this, and which will substitute the current one (a copy of the Danish Constitution).
25 citizens are chosen, with no political affiliation, out of the 522 candidates. For candidacy all that was needed was to be an adult and have the support of 30 people. The constitutional assembly starts in February of 2011 to present the ‘carta magna’ from the recommendations given by the different assemblies happening throughout the country. It must be approved by the current Parliament and by the one constituted through the next legislative elections.

So in summary of the Icelandic revolution:
-resignation of the whole government
-nationalization of the bank.
-referendum so that the people can decide over the economic decisions.
-incarcerating the responsible parties
-rewriting of the constitution by its people

Have we been informed of this through the media?
Has any political program in radio or TV commented on this?
No! The Icelandic people have been able to show that there is a way to beat the system and has given a democracy lesson to the world

Alleged Shabak (undercover internal security services) agent “Haim” and his Italian male partner “Pietro” have joint me in the hostel 3 and 2 months ago, respectively.
The latter claims that they have often spent vacations together over the past decade in various locations, including the cocaine-plenty beaches of the Dominican Republic.

Many of the boutique bars and hangouts on their favorite beach, including the Mosquito Bar, have been burned down in recent days, apparently by Colombian cartels, who intend to seize the beach and build on it a respectable “resort”.  This unfortunate event also apparently ruined Haim and Pietro’s summer vacation plans for this year.

During this period Haim has engaged in conduct, described in criminal complaint, recently filed by me with the Israel Police, as harassment, serious threats, and provocations.

I have been videotaping life in the Jerusalem Hostel and surrounding area on a routine basis over the past 2 years.

However, over the past three months, new de facto Rules of the House have been established:  Haim demanded that he never be videotaped, absent his prior consent.

The first time that the matter came up, I was videotaping Keith cooking in the kitchen.  Haim, who was sitting with his back to the camera, was concerned that he was accidentally captured in the frame, and violently snatched my camera.

More recently, Haim confirmed that there was a telescopic surveillance camera installed, overlooking the roof of the Jerusalem Hostel.  That videotaping did not bother Haim and Pietro at all.

Regardless, anytime I wanted to videotape, as has been the case in performances of Erik Fleshler, I had to give ample advance notice.

Upon such notice yesterday, Haim and Pietro chose to leave the roof, in order not to be videotaped.

Regardless, both Pietro and I admire the art of Erik Fleshler, and after I brought Erik for the first time to perform on the roof, Pietro asked me to bring him in again.

At 2:30am on May 10, 2012, Pietro woke me up, telling me that Erik was up and singing on the roof.

I came upstairs. Seated there were Erik, Haim, Pietro, and two French tourists, one of them a Paris attorney by trade.  I had earlier discussed with the attorney my past work, so he knew the general situation.

I explained to the attorney what was going to happen: I was going to give advance notice of videotaping Erik singing Tziflonushka… (The Little Chick); there was ongoing surveillance by video camera above; regardless, Haim is likely to immediately leave the roof upon my notice of videotaping.  That indeed happened to the French attorney’s surprise…

Once that happened, the French attorney and his friend immediately left the roof as well, and refused to return, even as witnesses to the performance.

To my surprise, Haim, who heard the conversation with the French attorney, decided to come back to the roof, wearing thick black framed fake glasses, and covering his head and face with a blanket. With that, he agreed to be videotaped.

Pietro hid his face.

Erik sang Tziflonushka… (The Little Chick).Some ethnographers claim that the song is a pre-revolutionary underground song, directed against the Tzar’s secret police, who catch the life-loving Tziflonushka, slaughter it, and make meatball out of it…

One must note, that the above should be considered mild treatment, compared to what took place under similar circumstances in the United States, in days preceding the deadline for submission for the 2010 UPR of Human Rights in the United States.
