What most who wrote about the case failed to mention are the fundamental facts:

a) There was no warrant issued for the arrest of Mr Fine.

b) There was no valid and effectual conviction

c) There was no valid and effectual sentencing

d) The March 4, 2009 proceeding, at the end of which Mr Fine was abducted, never appeared as part of the litigation chronology - it was - from court's perspective - an "off the record" proceeding.

e) In the past 10 months, through the Habeas Corpus Petition, and the Emergency Petition to the 9th Circuit, the LA Superior Court has denied access to the Register of Actions (California docket) of Marina v LA County (BS109420) - in which Mr Fine was purportedly arrested. How the honorable US Court engaged in a habeas corpus review with no docket, and how the US Court of Appeal, 9th circuit, which splits hairs on warrantless arrests, failed to notice that there was no docket, no warrant, no conviction, and no sentencing, is one of the world's wonders...

f) Donna Thomas, Courtroom Assistant to Magistrate Carla Woehrle, who engaged in transactions in the US District Court docket, which were subject to complaint to FBI, was never authorized as Deputy Clerk.

g) The Clerk of the US Court, Terry Nafisi, has refused to allow access to any of the records in Mr Fine's case, and likewise, is refusing to answer the questions: (i) Was Donna Thomas authorized as Deputy Clerk at the time she engaged in transaction in Fine v Sheriff? 

(ii) Is the docket of Fine v Sheriff (2:09-cv-01914) an honest, valid, and effectual docket of the US Court in compliance with US law?

h) Therefore, the Sheriff in three months of communications, including intervention by the Hon Michael Antonovich, has refused to comply with the law and has continuously denied access to California Public Records, which were the arrest and booking papers of Mr Fine. Instead, his office has repeatedly referred me to the fraudulent data posted in the online Inmate Information Center.

i)   The fraudulent Inmate Information Center falsely stated that Mr Fine was

arrested and booked at the "San Pedro Municipal Court".

j) Such data were false on numerous accounts: 

(i) There were plenty of witnesses and newspaper reports that the abduction took place in the Central District - Judge Yaffe's Courtroom. 

(ii) There were no booking facilities in San Pedro at all. 

(iii) The single sheriff Deputy in San Pedro denied that anybody was arrested or booked there anytime in memory. 

(iv) Municipal Courts ceased to exist in Los Angeles County almost a decade ago.

k) The convenience of the fraudulent listing of San Pedro's non-existent Municipal Court as the "Booking Agency" is that the sheriff's bureau claimed that the standard policy was that the Booking Papers were held with the "Booking Agency". In this particular case - the non-existent Municipal Court of San Pedro...

l) Since Mr Fine was never arrested, and never booked, he is not on the "Count List" of the Men's Central Jail.

m) Therefore, Mr Fine has never even once in ten months participated in the mandatory three times a day "Inmates Counts", which apply to all inmates in the jail.

n) It was for such reasons that Mr Fine was under false, coercive hospitalization, not even jailed.

THE STORY AS A WHOLE IS A RECIPE COPIED STRAIGHT FROM THE KGB COOK BOOK... THE ONLY REMEDIES - 

1) REQUESTING THE INTERNATIONAL RED CROSS TO INVESTIGATE THE FALSE HOSPITALIZATIONS OF ATTORNEYS OF LOS ANGELES COUNTY WHO HAD FILED COMPLAINTS REGARDING JUDICIAL CORRUPTION - RICHARD FINE AND RONALD GOTTSCHALK. 

2) REQUESTING THE UN HIGH COMMISSIONER FOR HUMAN RIGHTS TO INVESTIGATE THE WIDESPREAD CORRUPTION OF THE JUSTICE SYSTEM OF LOS ANGELES COUNTY - EXTREME ABUSE OF THE FUNDAMENTAL HUMAN RIGHTS OF THE 10 MILLIONS WHO RESIDE IN THE COUNTY.

Dear Clerk Nafisi:

Please accept this notice as a reminder of requests for information from your office, made in person to Records Supervisor Dawn Bullock on December 29, 2009, and also in writing, in letters dates January 4, 2010.[1] [2]

In a December 29, 2009 visit to the US District Court, LA, requests were made to access court records, to inspect and to copy. Most requests were denied, but access was allowed to several NEFs (Notices of Electronic Filings) in Zernik v Connor et al (2:08-cv-01550) . Such NEFs cemented concerns regarding honesty, validity, and effect of the PACER docket under such caption.

The US District Court would not certify its dockets. Moreover, no statements appear in the dockets in the name of the Clerk or any Clerk Deputy, as such.  Therefore requests were made, and requests are made herein, for statements by the Clerk of the US District Court, LA - Terry Nafisi, whether the dockets in Zernik v Connor et al (2:08-cv-01550) and Fine v Sheriff (2:09-cv-01914) were honest, valid, and effectual dockets, in compliance with US law.  Please accept this request also as Custodian of Records of the US District Court, LA, pursuant to California Law, as a request for custodian of records declaration regarding the PACER dockets of Zernik v Connor et al (2:08-cv-01550) and Fine v Sheriff (2:09-cv-01914).

As a follow up to the December 29, 2009, visit to the United States District Court, Los Angeles, where access to almost all records requested was denied, request was made for written explanations of the legal foundation for such denials, and related questions regarding the legal foundation for the rules of operation of PACER & CM/ECF at the US District Court.

Ms Bullock indicated that some of my questions would require research.  However, it should be possible to provide without any further delay at least responses to two of the simpler questions:

a) Are the PACER docket in Zernik v Connor et al (2:08-cv-01550) and Fine v Sheriff (2:09-cv-01914) honest, valid, and effectual dockets, in compliance with US law?

b) Was Donna Thomas, Courtroom Assistant of Magistrate Carla Woehrle, who conducted various transactions in the dockets of Zernik v Connor et al (2:08-cv-01550)  and Fine v Sheriff (2:09-cv-01914) a Deputy Clerk at that time, who was authorized to engage in such transactions, pursuant to your authority as Clerk of the US Court, Central District of California?

I look forward to your expedient responses on at least these two questions.

El interés inicial en el sistema de gestión de casos del Departamento del Sheriff del Condado de Los Angeles apareció, tras el encarcelamiento y la hospitalización de dos abogados de alto nivel que habían presentado denuncias relativas a denuncias de corrupción de los jueces de la Corte Superior de Los Ángeles. Uno de ellos, Richard Fine, se ha limitado en virtud de la hospitalización forzada de más de 10 meses. En paralelo - Sheriff de Los Angeles, Lee Baca, se negó a permitir el acceso a los Registros Públicos de California, que son la detención y los documentos de reserva de los dos abogados. En lugar de datos, su oficina en varias ocasiones se hace referencia falsa y deliberadamente engañosa publicada en la línea de Internos Centro de Información.

Anterior datos de las encuestas demuestran que alrededor del 30% de las entradas en el Departamento del Sheriff del Condado de Los Angeles de Internos del Centro de información no tenían número de reservas disponibles. Asimismo, mostró que cerca del 50% de las entradas habían tribunal ficticio y / o número de caso como la autoridad legal para su encarcelamiento.Encuestas de datos de los nombres latinos comunes tales como "José Martínez", "José Rodríguez", frente común "anglosajón" de nombres como John Smith o John Williams, también sugirió que el nombre latino reclusos tenían más probabilidades de que falta un número de reserva o venta con otros datos falsos.

Aquí, estos datos fueron analizados mediante el acceso a más de revistas de Los Angeles Departamento del Sheriff de los reclusos a partir de dos fuentes alternativas: el sistema de vid, y el Centro de Información del Recluso, y comparando los resultados de las mismas consultas de los dos sistemas.

Las diferencias eran de una magnitud sorprendente: El nativo de Internos Centro de Información encontrado 141 hits para una consulta sobre "José Martínez", mientras que el sistema VINE identificado sólo 28 hits en la misma consulta. Además, de los internos que se encuentran a través de vid, el 7% (2 de 28) no detectable en el Condado de Los Angeles Reclusos Centro de Información sobre todo, a pesar de vid que figuran el Departamento del Sheriff del Condado de Los Ángeles como la fuente de datos. Entre los presos que aparecen en vid, algunos tenían un número de reservas que eran de la serie "bajo" previamente identificados, que no son continuos con los números de reserva y otras en relación a Fechas de la reserva, y por tanto sospechoso.

Resultados de dicho análisis se pretendía demostrar que tras la investigación que era muy probable que se encuentre que las grandes detenciones ilegales y encarcelamiento falso prevalecían en Condado de Los Angeles, California. La evidencia demostró que tales prácticas eran frecuentados por los tribunales. La evidencia adicional demostró la corrupción generalizada de la Corte Superior de California, condado de Los Ángeles - en relación a la propiedad inmobiliaria y el fraude institución financiera. Del FBI y el Departamento de Justicia de EE.UU. se negó a investigar las denuncias y pruebas contundentes de la corrupción generalizada del sistema de justicia del Condado de Los Angeles. Por lo tanto, propuso que observadores internacionales deben tratar de acceder a los registros públicos en Condado de Los Angeles, California, y explorar más a fondo lo que parecía ser falso encarcelamiento a gran escala - extensión directa del escándalo de Rampart (1998-2000). Condiciones del sistema de justicia en el Condado de Los Angeles, California, también pueden requerir acceso inmediato a los tribunales internacionales de derechos humanos.

The report below is one in a series documenting the widespread corruption of the justice system in Los Angeles County, California, which is claimed to be a Human Rights disgrace of historic proportions. Such corruption was fully documented in government reports and government records, for at least two decades. It may initially appear as unrelated to banking and banking regulation. However, it was the same judge, Jacqueline Connor, who was at the center of the Rampart corruption scandal (1998-2000), who was inexplicably best friends with some of the most corrupt police, which led to the false imprisonment of thousands of Rampart-FIPs (Falsely Imprisoned Persons), who was also the key figure in instigating in 2005 the malicious and fraudulent litigation, as opined by decorated veteran FBI agent report, in collusion with Countrywide - now Bank of America Corporation.

The evidence demonstrates widespread corruption of the courts in collusion with the largest financial institutions, such as Bank of America Corporation, affecting Human Rights abuse on multiple fronts. It was doubted that anyone living outside the US has any ability to gauge the dimension of the corruption. It was therefore recommended already a year ago, that some international observers were desired, if for no other reason - to reduce the risk of catastrophic financial failure.

Initial interest in the case management system of the Los Angeles County Sheriff’s Department arose following the jailing and hospitalization of two senior attorneys, who had filed complaints pertaining to allegations of corruption of judges of the Los Angeles Superior Court. One of them, Richard Fine, has been confined under coerced hospitalization for over 10 months. In parallel – Los Angeles Sheriff, Lee Baca, refused to allow access to California Public Records, which were the arrest and booking papers of the two attorneys. Instead, his office repeatedly referenced false and deliberately misleading data published on the online Inmate Information Center.

Previous data surveys demonstrated that about 30% of the entries in the Los Angeles County Sheriff’s Department Inmate information Center had no booking number available. It further showed that about 50% of the entries had fictitious court and/or case number listed as the legal authority for their jailing. Data surveys for common latino names such as “Jose Martinez”, “Jose Rodriguez”, versus common “anglo” names such as John Smith or John Williams, also suggested that latino named inmates were more likely to be missing a booking number or listed with other false data.

Here, such data were further analyzed by accessing the Los Angeles County Sheriff’s Department listing of inmates from two alternative sources: The VINE system, and the Inmate Information Center, and by comparing the results of the same queries from the two systems.

The differences were of surprisingly large magnitude: The native Inmate Information Center found 141 hits for a query for “Jose Martinez”, while the VINE system identified only 28 hits for the same query. Moreover, of the inmates that were found through VINE, 7% (2 out of 28) were not traceable in the Los Angeles County Inmate Information Center at all, although VINE listed the Los Angeles County Sheriff’s Department as the data source. Among inmates listed on VINE, some had Booking Numbers that were from the “low series” previously identified, which were non-continuous with other booking numbers in respect to Booking Dates, and therefore suspect.

The comparison was repeated by a query of both systems or “Jose Rodriguez”, yielding 133 hits in the native Inmate Information Center, but only 26 inmates in VINE for the same name.
Results of such analysis was claimed to demonstrate that upon investigation it was very likely to be found that large-scale false arrests and false jailing were prevalent in Los Angeles County, California. The evidence demonstrated that such practices were patronized by the courts. Additional evidence demonstrated widespread corruption of the Superior Court of California, County of Los Angeles – relative to real estate and financial institution fraud. FBI and the US Department of Justice refused to investigate allegations and overwhelming evidence of widespread corruption of the Los Angeles County justice system. It was therefore proposed that international observers should attempt to access public records in Los Angeles County, California, and further explore what appeared as large scale false jailing – direct extension of the Rampart scandal (1998-2000). Conditions of the justice system in Los Angeles County, California, may also require immediate approach to International Human Rights courts.
