Statewide court computer project mishandled, audit says

California court administrators failed to properly plan for and realistically budget a massive computer modernization project that has fallen years behind schedule and on which the cost could balloon from the original estimate of $260 million to $1.9 billion, state auditors said Tuesday.
As a result, State Auditor Elaine Howle recommended that the Administrative Office of the Courts (AOC) delay moving forward with installing the system until an independent reevaluation is conducted of potential problems with the California Court Case Management System.
The office "has not analyzed whether the project would be a cost-beneficial solution to the superior courts’ technology needs and it is unclear on what information the AOC made critical decisions during the project’s planning and development," Howle wrote to Gov. Jerry Brown in suggesting the delay in deploying the system at three court systems.
Envisioned as a way to modernize and tie together computer systems operated in the state’s 58 counties, the new system has been in trouble from the beginning, and some presiding judges have called on the administrative office and the Judicial Council of California to rethink the project.
Originally estimated to be completed in 2009, the project now may not be finished until 2015-16, but there is not enough money yet to install it in all counties, which diminishes its value, Howle said.
Howle found the administrative office did not adequately heed warnings by a consulting firm it hired that raised "significant concerns" about the case management system, and bungled the handling of contracts to develop the system. In particular, the main contract to develop the system lacked cost controls, which resulted in the state changing the contract 102 times to increase the contract from $33 million to $310 million, Howle said.
"To make certain that no significant quality issues or problems exist," the audit said, the court administrators "should retain an independent consultant to review the system before deploying it" as planned to three court systems.
The Judicial Council agrees with many of the recommendations but has already made changes and will go ahead with deploying the system in three court systems during the next two years. The council also believes the final project will be brought in at a cost of $1.3 billion, below Howle's estimate.
"The Judicial Council is largely in agreement with the (auditor's) recommendations and in many instances has already adopted practices and policies consistent with the recommendations made," said William C. Vickrey, administrative director of the courts.

The Supreme Court of the United States fails to meet the most fundamental international standards of an honest tribunal.
Los Angeles, February 8 - a United Nations International Crime Prevention Center report lists missing court records as a cardinal sign of judicial corruption. [1] In the Supreme Court of the United States, missing court records are the rule.
In a series of cases from the Supreme Court of the United States, records have been released by Human Rights Alert (NGO), which are invalid notices of purported denial of motions, petitions, and applications filed by individuals in cases involving alleged abuse by government or large corporations. [2]
· The notices issued by office of Clerk William Suter uniformly fail to include any true judicial records.
· The letters are at times issued by unauthorized personnel, or are falsely signed.
Consequently, repeated attempts have been made to access the court file records of the Supreme Court of the United States, to discover if any judicial records existed at all, as the basis for the notices issued by Clerk William Suter.
The right of the public to access court records to inspect and to copy is recognized by the US Supreme Court as a First Amendment right (Nixon v Warner Communications, Inc, 1978). In the English speaking courts it is also held as a Common Law right. Furthermore, it is essential part of Fair Hearings – a fundamental Human Right pursuant to the Universal Declaration of Human Rights.
· In no case, where access to the paper court files has been permitted, has any valid judicial record ever been discovered, to support the purported notices of denial, issued by the office of Clerk William Suter.
· In a number of cases – access to the paper court files has been denied.
· Repeated requests to access the electronic court files of the Supreme Court of the United States have been denied.
· There is no evidence that public access to the electronic court files of the Supreme Court of the United States has ever been permitted.
The combined evidence is the basis for request, recently filed with US Congress, for impeachment of Clerk William Suter for public corruption, deprivation of rights, and violation of his Oath of Office.
The Supreme Court of the United States fails to meet the most fundamental international standards of an honest tribunal.

A $54m lawsuit over a pair of pinstriped trousers that went missing from a Washington,DC, cleaners was thrown out by a judge this week. It had attracted worldwide ridicule. The fact that the case was brought, not by a random loony, but by a former judge has added to the sense that something is wrong not just with America's litigation laws, but with the kind of men and women Americans choose to sit in judgment over them.
A whole series of judicial misdemeanours, ranging from the titillating to the outrageous, has emerged over the past year. Take the Florida state judge, John Sloop, who was ousted after complaints about his “rude and abusive” behaviour. This included an order to strip-search and jail 11 defendants for arriving late in traffic court after being misdirected. Or the Californian judge, José Velasquez, sacked in April for a plethora of misconduct, including extending the sentences of defendants who dared question his rulings.
Then there was the Albany city judge, William Carter, in New York, censored for his “utterly inexcusable” conduct after jumping down from the bench during a trial, shedding his robes and apparently challenging a defendant to a fist-fight. Another time, he suggested that the police “thump the shit out” of an allegedly disrespectful defendant. Mr Carter wasn't carrying a gun; many judges now do. In Florida, Charles Greene, chief criminal judge in Broward County, had to step down after describing a trial for attempted murder involving minority defendants and witnesses as “NHI” (No Humans Involved). Then there are the sexual peccadilloes. In Colorado, a (male) judge resigned after admitting having sex with a (female) prosecutor in his chambers. In California, a former judge was jailed for 27 months for downloading child pornography. And in Oklahoma Donald Thompson, a judge for more than 20 years, was jailed for four years for indecent exposure and using a “penis pump” to masturbate during trials.
“To distrust the judiciary,” said Honoré de Balzac, “marks the beginning of the end of society.” In Britain, judges are one of the most respected groups. But in America they tend to be held in low esteem, particularly at state level. For this many people blame low pay and the fact that judges are elected. In 39 states, some or all judges are elected for fixed terms. Federal judges, usually held in much higher esteem, are appointed on merit for life—as in Britain.More serious are the cases of corruption. On June 5th Gerald Garson, a former judge in Brooklyn, New York, was jailed for taking bribes to rig divorce cases. Another judge was convicted of accepting money to refer clients to a particular lawyer. Rumours of buying and selling of judgeships in the district abound. At one time, one in ten Brooklyn judges were said to be under investigation for sleaze.
Most states allow judicial candidates to raise campaign funds. Huge sums are often involved, leading to inevitable suspicions that, once on the bench, judges will pass judgments that favour their benefactors. In 2004 the two candidates in one Illinois district (with a population of just 1.3m) raised a staggering $9.4m between them. Some of the states with the highest levels of campaign spending—Texas, Louisiana and Alabama—are also those whose judges are most criticised.
In the past, judicial candidates were banned from discussing controversial legal or political issues on the campaign trail. But in 2002 the Supreme Court ruled such bans to be unconstitutional, leading candidates to advertise freely their views on abortion and suchlike. Personal attacks have also become more common. Indeed, Sandra Day O'Connor, a former Supreme Court justice, fears that judicial elections have turned into “political prize-fights, where partisans and special interests seek to install judges who will answer to them instead of the law and the constitution.”
The meagre salaries of judges, whether at state or federal level, do not help raise standards either. Federal judges have not had a real pay rise for 17 years; a district court judge earns $165,000 a year, about the same as a first-year associate in a top law firm. John Roberts, chief justice of the Supreme Court, earns just $212,000—half the salary of England's top judge and one-fifth of the average income of a partner in the majority of America's 100 top-grossing law firms. Around 40 judges have left the federal bench over the past five years.
In his annual report to Congress in January, Mr Roberts said that the issue of judges' pay had reached “the level of a constitutional crisis”. It was threatening the judiciary's strength and independence. In February, Patrick Leahy, the Democratic chairman of the Senate Judiciary Committee, promised legislation to fix it within the current session. The judges are still waiting. The Florida Bar has proposed a new rule to eliminate coverage of court proceedings by citizen journalists. The Bar’s proposed rule prohibits anyone other than an employee of a traditional media outlet or an official court reporter from using any device which can make video or audio recording from being brought into a court including laptop computers.

The US Department of Justice has treated Los Angeles County for at least three decades as an extra-constitutional zone. On such background, synergy between the Los Angeles Superior Court and Countrywide Financial Corporation gave rise to Los Angeles County as "the epicenter of the epidemic of real estate and mortgage fraud."
The financial crisis and corruption of sub-prime lenders have deep roots in Los Angeles County, California:
- In the early 2000s, FBI reports distinguished Los Angeles County, California as "the epicenter of the epidemic of real estate and mortgage fraud."
- That distinction is claimed to have been earned through synergy of the Los Angeles Superior Court and the Los Angeles based Countrywide Financial Corporation - the leading sub-prime lender at that time.
- At least in one case, where a renowned Fraud Expert, and FBI veteran, opined real estate fraud, the evidence showed collusion by the Los Angeles Superior Court (with Judge Jacqueline Connor leading the pack), Countrywide (with Chief Legal Officer Sandor Samuels leading the pack), and later Bank or America (with Brian Moynihan leading the pack). - By January 2008, collapse of Countrywide ushered in the US and global financial crisis
- The Los Angeles based Sustain Technologies is wholly owned by the Los Angeles based Daily Journal - the largest legal newspaper in California, with tight ties to the California Judicial Council.
- Sustain Technologies is the maker of:
- Sustain - the secretive courts' case management system, and
- eCourt - the courts' online public access system
- Around 1985 Sustain was first developed and installed in the Los Angeles Superior Court.
- At that time, Ronald George, the immediate past Chief Justice of the California Supreme Court, according to his official bio, served in leadership positions in the Los Angeles Superior Court.
- Based on two unpublished reports by Dr Zernik, a world-renowned computer science expert provided an opinion [4,5] supporting Dr Zernik's claims that the Sustain enables fraud by court staff, and called upon US based computer science experts to investigate the system.
- Combined, Sustain and eCourt were opined by Dr Zernik as the enabling tools for racketeering in the Los Angeles Superior Court.
- The latest report by Sustain Technologies claims: "25 Years. Two Provinces. Eleven States. Three Countries." [6]
- Based on submission by Human Rights Alert (NGO), detailing conditions in Los Angeles County, California, the Human Rights Council of the United Nations issued in 2010 a report referring to "Corruption of the courts and the legal profession" in California. [7]
