If one wants to understand clearly where you stand in the larger scheme of things in relation to your government then this case is the perfect study of what can happen. You don't neccesarily have to be a criminal to find yourself on the wrong end of an indictment. The government sans, an IRS agent, who by herself was nothing special, used an American business family to advance her career by fabricating a case against innocent people.The sad part is, that if you didn't have the money, which most people don't, to disassemble the case and discover the lies, you would be serving several years in a penitentary for crimes you did not commit.Please take time if you can and read the misconduct articulated in the memorandum to understand the injustice committed in your name by your government. I did not defend their case at the trial in 2007, but was brought in for sentencing consultation and appeal in early 2008. We got them bond pending appeal, then after two years of appellate litigation, including a rehearing the 11th Circuit granted in October of 2010, the 11th Circuit Court of Appeals threw out all the convictions two days before Christmas on December 22, 2010. (The Marchellettas were in the middle of their company Christmas party when I called them to advise the 11th Circuit had thrown out all the convictions . . . that was really something).The government's been posturing for a retrial ever since, and when the judge saw the parties' Joint Status Report on August 1st – which included our intention to file a motion to dismiss the indictment for outrageous government misconduct, our contemplated motion to continue the September 24th trial date, and or statement that the government still hadn't complied with discovery after 3 and 1/2 years – the judge took action this past Thursday, the 2nd, and ordered us to file the whole tamale by this past Monday at High Noon, giving the government only 48 hours to respond (by Noon today).The government has spent untold millions of dollars persecuting the Marchellettas for over twelve years, and now the IRS and the U.S. Attorney's Office for the Northern District of Georgia want to retry the case. The perversity of that position is stunning, given the unconscionable misconduct during the investigation, indictment, and prosecution of the case – going back to 2000 – and the serial misconduct continues to this very day.Please circulate far and wide if you will, because my clients want everyone to know what has happened to them at the hands of the IRS and a corrupt U.S. Attorney's Office over the past twelve years. 12-08-18 Lynching or pogrom in Zion Square, Jerusalem: a call for establishment of a Truth and Reconciliation Commission regarding conduct of the Israel Police
Given the scope of
surveillance and undercover police activity in Zion Square, it is unreasonable
that events of late last Thursday night were not prevented or immediately
stopped by the Israel Police. Therefore, the proposed "Special Investigative
Panel" by the Israel Police will not do in this case. A Truth and Reconciliation Commission should
review the conduct of Israel Police in this case.

Zion Square, Jerusalem, August 18 - Jewish mob attack on Palestinian youths last
Thursday night was described by eyewitnesses and media as "lynch". [1]
More properly, the recent violence in Zion Square should be described as a
pogrom. Given the scope of surveillance and undercover police activity in
Zion Square, it is unreasonable that events of last Thursday night were
not prevented or immediately stopped by the Israel Police on the ground.
According to several witnesses it took
uniformed police about 15-30 minutes to arrive on the location, at the center
of Jerusalem and less than half a mile from Police Headquarter, after emergency
calls by persons on location, who described the event as
"murder". When police arrived, they stood by as the Jewish mob
continued with the violence. According to witnesses, police intervened
only after victims were in bad condition, on the ground.
The most troubling questions about conduct of
the Israel Police in this case are:
1)
Why was there no uniformed police presence in Zion Square on a
Thursday night?
Uniformed police presence in Zion Square on
Thursday, Friday, Saturday nights has been repeatedly requested, following the
murder of a Palestinian youth by Jews in February 2011 under similar
circumstance.
2)
Why did it take uniformed police so long to arrive on
location?
Past experience shows that the Israel Police
response in the same location was remarkably faster in much less serious cases.
3)
With the multiplicity of surveillance cameras and undercover
police on the ground in Zion Square and Ben Yehuda pedestrian areas, why was
the violence not immediately stopped?
Regulars in the Zion Square area are familiar
with the constant surveillance and undercover police presence.
Less than three weeks ago, an Open Memo was
filed with Nitzav Meni Yitzhaqi, Substitute Commander of the Jerusalem
District, Israel Police, specifically addressing conditions in Zion
Square. [2] The Open Memo listed a sequence of recent events
in the Square, starting with:
February
2011 – an Arab youth
is murdered on nationalistic background near the Square. In the wake of the
murder, and in view of ongoing disturbances of public peace in the Square,
request was forwarded by this writer to a Member of Knesset, for uniformed
Israel Police presence in the Square at nights, at least Thursdays-Saturdays.
Consequently, such presence was maintained for a short period only.
The Open Memo concludes:
a)
Public Safety in the Zion Square area is deficient.
b)
The Israel Police has deliberately refused to investigate some
of the most significant violations of public safety in the Square over the past
half year with no reasonable explanation, although the incidents were of the
nature of sabotage attempts [Nisayon Pigu'a].
c)
Civilian agencies have attempted to restrict the rights to Free
Speech and Free Assembly in the Square, a historic public space. Israel Police
has not enforced such policies. However, law enforcement of the State of Israel
is increasingly using the public space for parking of vehicles and motorcycles.
d)
Undercover operations and unwarranted surveillance are conducted
by law enforcement of the State of Israel in the Zion Square area. Some of such
conduct is likely to be deemed in violation of Human Rights, or worse - staging
of provocations.
The conclusions of the Open Memo are
re-affirmed by events of last Thursday night.
Combined, they raise serious concerns that withholding uniformed police
and the reliance on surveillance devices and undercover police are employed for
institutionalized discrimination by law enforcement - a serious violation of
Human Rights.
Given the nature of the events, the proposed
"Special Investigative Panel" by the Israel Police is unreasonable.
Likewise, an investigation commission, headed by a retired justice of the
Supreme Court of the State of Israel (a common practice) would be deficient, in
part, because the standard of review should be based on Human Rights, as
applicable to Jerusalem, "Corpus Separatum" by international
law.
Instead, a Truth and Reconciliation
Commission should be established to investigate the conduct of the Israel
Police surrounding the recent lynching/pogrom in Zion Square. [3] Obviously,
such Commission would not have access to critical evidence, held by the Israel
Police. It is unlikely that the surveillance videos, or identities of
undercover police, who were present on the scene, would ever be made public
under any other investigative body in this case either. And investigation by
any body of the State of Israel, where the evidence is kept confidential,
should not be trusted in this case.
The agreement of peers, both Arabs and Jews,
to serve on the proposed Truth and Reconciliation Commission, and likewise - the
voluntary appearance of eye witnesses, both Jews and Arabs, should be
sufficient to reach informed and competent conclusions and recommendations in
this case. The voluntary service of panel members and the voluntary
appearance of eye witnesses would also provide the real demonstration that the
People of Jerusalem are willing/ready/able to safeguard Human Rights and
justice for all. Otherwise, constant presence of voluntary or mandated
international monitors may be required.

האלימות. על פי עדי ראייה, הם התערבו בנעשה רק לאחר שהקורבנות הוכו קשות ונפלו

השאלות המרכזיות בנוגע להתנהלות המשטרה

לא הופסקה האלימות לאלתר?
לפני פחות משלושה שבועות נמסר ללשכתו של ניצב מני יצחקי, ממלא
מקום מפקד מחוז ירושלים, תזכיר פומבי שעסק במצב הבטיחות ופעילות המשטרה בכיכר
ציון. [2] התזכיר הפומבי כלל רישום של רצף אירועים בכיכר, שתחילתו:
פברואר 2011- צעיר פלסטינאי נרצח על רקע לאומני ליד
כיכר ציון. לאחר הרצח, ולאור הפרות חוזרות
של הסדר והבטיחות בכיכר, הוגשה בקשה על ידי הכותב לחבר כנסת, להצבת שוטר במדים
בכיכר ציון בלילות, לפחות בימי חמישי עד שבת.
בעקבות הבקשה, אכן הופיעו שוטרות בכיכר. לאחר תקופה קצרה הופעת משטרה במדים
בלילות סוף השבוע נפסקה.
התזכיר הפומבי סוכם
כלהלן:
א. מצב הביטחון בכיכר ציון אינו מספק.
ב. משטרת ישראל בכוונה נמנעת מלחקור כמה מן
האירועים החריגים בתקופה האחרונה בנוגע לביטחון בכיכר, ללא הסבר מניח את הדעת, אף שכמה
מאירועים אלה היו בגדר ניסיונות פיגוע.
ג. רשויות אזרחיות ניסו להגביל את חופש הביטוי
וחופש ההתכנסות בכיכר ציון – מרחב ציבורי היסטורי. משטרת ישראל לא אכפה החלטות
אלה. אולם המשטרה הגבירה לאחרונה את
השימוש במרחב הציבורי לחניית רכבים ואופנועים.
ד. פעילות משטרתית חסויה מתנהלת בכיכר ציון,
שבחלקה מן הראוי שתחשב להפרה של זכויות האדם –
או אפילו מעורבות בפרובוקציות.
מסקנות התזכיר הפומבי
מאוששות על ידי אירועי יום חמישי שעבר.
יחד, הם מעלים חשש כבד שההימנעות מהצבת שוטרים במדים וההסתמכות על מצלמות
אבטחה ושוטרים סמויים משמשים לאפליה שיטתית באכיפת החוק – פגיעה חמורה בזכויות האדם.
מחמת טיב האירועים, "צוות חקירה מיוחד" של משטרת ישראל
אינו צעד סביר. בדומה, ועדת חקירה בראשות
שופט עליון בדימוס אינה מספקת במקרה זה, גם מכיוון שמן הראוי שהבירור במקרה זה
יהיה מבוסס על זכויות האדם – בירושלים, המוגדרת כ"קורפוס ספרטום" בחוק הבינלאומי.
מן הראוי להקים ועדת אמת ופיוס לבירור
התנהלותה של משטרת ישראל בנוגע למקרה האחרון של לינץ' או פוגרום בכיכר ציון. [3] ועדה כזאת לא תזכה לגישה לראיות מרכזיות,
המצויות בשליטת המשטרה. אולם אין לצפות
שמשטרת ישראל תמציא את הקלטות מצלמות האבטחה, או את מספרם וזהותם של שוטרים חסויים
שנכחו במקום האירוע לבדיקה פומבית תחת כל גורם בירור אחר. בירור המקרה על ידי גורם ממשלתי על סמך ראיות שיישארו
חסויות, אינו ראוי לאימון הציבור במקרה זה.
הסכמתם של אזרחים מן השורה, פלסטינאים
ויהודים, לשרת בהתנדבות כחברים בוועדה לאמת ופיוס, ובדומה, הופעתם מרצון של עדי
ראייה, יהודים ופלסטינאים, יכולים לספק מידע שיאפשר לוועדה להגיע למסקנות ולהמלצות
הולמות. הסכמתם של אזרחים מן השורה, פלסטינאים ויהודים, לשרת בהתנדבות כחברים

Visa page of a visitor to Jerusalem: a) The standard 3-month tourist visa of a guest in the State of Israel was crossed out by hand, and instead "one week" was inscribed. In constrast with other stamps from other nations in the same passport, the State of Israel stamps show neither the ID number, nor the hand-signature of the Immigration Officer. No explanation was provided for the shortening of the visa term. b) Corpus Separatum Jerusalem passport visitor's stamp.
One guest, an Austrian student and yoga instructor arrived on August 11, 2012, and was issued upon arrival the usual 3 months visa. However, then he was asked to go for another interview, and when he mentioned that he knew me and that he came for the party, the 3 month visa was crossed by hand, and 1 week visa was issued instead. Attached are the relevant pages of the passport (passport number was redacted).
During the interviews, the guest held a return ticket for August 28.
I went with the guest to the Interior Ministry of the State of Israel in Jerusalem. They said that they had no access to the data of Ben Guion Airport Border Control, and could not tell the reason why the visa term was drastically shortened. However, they could schedule a meeting and extend the visa after review.
The guest also visited here in the previous two summers, both times he got 3 months visas, and left after about 3 weeks with no problem at all.
I tried to convince the guest to stay for the additional interview in the Ministry of Justice and return home as scheduled, on August 28. However, he decided to leave before the end of the 1-week visa, describing the whole experience with Israeli authorities as "a bad joke".
It should be particularly noted that his destination was Jerusalem, where the State of Israel prides itself on freedom of access to all, and which by International Law is Corpus Separatum, not under the sovereignty of any nation.

Not only is the White House fighting in court for the power to jail Americans indefinitely without trial, but the Obama administration is refusing to tell a federal judge if they've abided by an injunction that prohibits them from such. When President Obama signed the bill on December 31, he granted the government the power to put any American away in jail over even suspected terrorist ties, but federal court Judge Katherine Forrest ruled in May that this particular part of the NDAA, Section 1021, failed to "pass constitutional muster" and ordered a temporary injunction.
