The
Tel-Aviv Magistrate Court issued last week an unprecedented
"Restraining Order", which prohibits activist Barak Cohen from any
speech, related to Bank HaPoalim CEO Zion Keinan. The order amounts to
Prior Restraint of Free Speech... It comes in the footsteps of a series
of gag orders, trying to prevent the publication of news regarding
government corruption in general, and judicial corruption in
particular...
Attorney
Barak Cohen has managed to rub the justice system the wrong way through
artful provocations. In the latest round, he managed to provoke the
Tel-Aviv court into issuing on him a Prior Restraint order, prohibiting
him of making any public speech related to Zion Keinan, Bank HaPoalim
top executive, key figure in fraud by the banks in collusion with the
courts.

[1] The request pertains to the court file, where Judge Bosni issued last Thursday a "Restraining Order", prohibiting activist Barak Cohen of any public speech related to Bank HaPoalim CEO Zion Keinan. Together with it, request was also filed for Judge Bosni's Disqualification for a Cause. [2]

In Israel, any request to inspect court file requires a
request and a justification. The justification, provided in today's
request, states that there is a serious concern that Judge Bosni engaged
in fraud and criminality -- conduct of sham court process. The
inspection is requested in order to clarify the nature of the records
and the nature of Judge Bosni's conduct in this case.
The justification for the Disqualification states that
given that the inspection may reveal criminal conduct by Judge Bosni,
she is in a serious conflict of interest relative to the Request to
Inspect.
The unusual hearing on Bank HaPoalim's CEO Zion Keinan's
request for a Restraining Order against activist Barak Cohen took place
last Tuesday. It was scheduled at an unusual time - 8:00pm in the
evening, outside of the court's regular working hours - and it lasted
till almost midnight. It was also conducted in an unusual place, not in
Judge Bosni's regular courtroom, but in the basement of the court house.
Regardless, when CEO Keinan appeared in the Court, he was welcomed by
by a chorus of activists, yelling at him "Thief! Thief!".
Furthermore, although the court hearing was extensively covered by media, the case is now inexplicably "sealed" by the Court.
Over the past years, Barak Cohen launched a campaign
against fraud by the banks and the justice system, similar to the
foreclosure fraud epidemic, plaguing the United States since the onset
of the financial crisis in 2008.
Last Tuesady's hearing, regarding a "Restraining Order" on activist Barak Cohen, was not conducted in Judge Bosni's regular courtroom, but in an alternative space, designated as a bomb-shelter.

The outcome of the process by Judge Bosni was an unusual
decision as well. It prohibited activist Barak Cohen from "publication,
of any kind and type, in writing, in the internet, and in any social
media," relative to Bank HaPoalim's CEO Zion Keinan. Cohen's response
following the issuance of the Decree: "A decree can't prohibit an idea,
particularly - not an idea, whose time has come".
The June 25, 2015 Restraining Order, which prohibits
activist Barak Cohen from any public speech relative to Bank HaPoalim's
CEO Zion Keinan, was extensively covered by media. However, the court
now designated it "sealed" (the diagonal water mark on the record).

The conduct of sham, simulated legal process is a
well-known form of judicial corruption. It involves the conduct of sham
proceedings and the issuance of abusive court papers, which the judges
themselves do not consider valid and effectual, but which the judges
deceive or extort compliance with.
In numerous nations, such conduct is explicitly defined
by law as criminality. In contrast, in Israel, the falsification and
forgery of court records by judges has become a well-known phenomenon
over the past decade. It has been facilitated by the implementation of
new, fraudulent IT systems in the courts, which enable such conduct.
Moreover, even when caught, judges have not been prosecuted, and the
judiciary refuses to impose any significant punitive measures on judges
for such conduct.for such conduct
The Human Rights Alert (NGO) submission was incorporated
into the 2013 UN Human Rights Council Professional Staff Report with a
note regarding "lack of integrity in the electronic record systems of
the Supreme Court, the district courts and the detainees courts in
Israel". [3] The 2015 European Conference on E-Government published a
report, subject to international, anonymous peer-review, titled
"Fraudulent, new IT-systems of the Israeli courts -- unannounced regime
change?". [4]
Over the past year, restrictions on Free Speech have
become particularly notable in Israel . A series of "gag orders"
("Publication Prohibition Decrees") were issued in recent months,
relative to a series of high profile corruption scandals, which involve
senior figures of the Israel Police, the State Prosecution, and judges. [5]
In parallel, the courts engage in wholesale denial of
access to court files related to corruption of government authorities.
Access to court records is considered part of Free of Speech and Freedom
of the Press as well.
Restrictions on Free Speech became particularly severe
last summer, during the Gaza massacre. Various Israeli employers,
including universities, issued instructions, which prohibited employees
from engaging in any political speech, even if such speech was conducted
outside working hours and off work premises. In one extreme case, the
Dean of Bar-Ilan University law school demanded an apology from a law
professor, who expressed sorrow for the loss of lives, without
explicitly restricting such sorrow for the loss of Jewish life... In
another case, the New York Times got into a dispute with the Israeli
government, when the latter tried to regulate what would be publish
relative to the Gaza conflict...
Freedom of Speech and Freedom of the Press are probably
the two areas, where Israel fails most visibly its claims of being "the
only democracy in the middle-east". And judicial corruption is the to
government corruption in Israel today, albeit, a form of corruption,
whose existence the justice system simply denies, and mention of which
its tries to prohibit from being published...

מאהל המחאה ת"א, 28 ליוני – בקשה לעיון הוגשה היום בבית המשפט השלום ת"א בתיק בו הנפיקה השופטת אפרת בוסני ביום חמישי שעבר "צו הרחקה" נגד ברק כהן לבקשתו של מנכ"ל בנק הפועלים ציון קינן. [1] יחד עם הבקשה, הוגשה גם בקשת פסלות נגד השופטת אפרת בוסני. [2]
ההצדקה לבקשת העיון אומרת שקיים חשש חמור שהשופטת אפרת בוסני עסקה בהונאה בבית המשפט בהליך הקשור ל"צו ההרחקה", והעיון נועד לוודא את טיב הכתבים וההליכים בתיק זה.
ההצדקה לבקשת הפסלות אומרת שכיוון שיש חשש להתנהלות פלילית של השופטת אפרת בוסני בתיק זה, היא מצוייה בניגוד עניינים לגבי העיון בתיק.
הדיון החריג בבקשתו של מנכ"ל בנק הפועלים התרחש ביום שלישי שעבר. הוא נקבע מראש לשעה בלתי רגילה – 8:00 בערב- מחוץ לשעות העבודה הרגילות של בית המשפט. ועל פי התקשורת, הדיון נמשך כמעט עד חצות... הדיון גם לא התקיים באולם הדיונים הרגיל של השופטת בוסני, אלא במרתף בית המשפט. למרות זאת, כשהגיע מר קינן לבית המשפט, קיבלה אותו מקהלה של פעילים בקריאות "גנב! גנב!".
יתרה מזאת, למרות שהדיון והצו דווחו בהרחבה בכלי התקשורת, התיק כולו מסווג כעת כ"בלדתיים סגורות".
במהלך השנה האחרונה, מנהיג ברק כהן מערכה נגד ההונאות של הבנקים בשיתוף פעולה עם בתי המשפט, הדומות להפליא למגיפת הונאות של בנקים ושופטים גם בארה"ב בשנים האחרונות...
הדיון ביום ג' שעבר על בקשתו של מנכ"ל בנק הפועלים ציון קינן ל"צו הרחקה" נגד ברק כהן נערך בשעת לילה מאוחרת, לא נרשם ביומן בית המשפט, ולא נערך באולם הדיונים הרגיל של השופטת אפרת בוסני, אלא בחדר קטן - "מרחב מוגן" שלא יכול היה להכיל את הציבור שהגיע לדיון.

תוצאותיו של דיון זה של השופטת אפרת בוסני היו חריגה גם כן. ביום ה' דיווחה התקשורת בהרחבה, בלוויית ציטוטים, על צו גורף שהנפיקה השופטת לבקשת ציון קינן, האוסר על ברק כהן להטריד אותו ואת בני משפחתו, בין השאר על ידי "פרסום מכל מין וסוג שהוא במדיה כתובה, ברשת האינטרנט או ברשת חברתית". תגובתו של ברק כהן: "לא ניתן לתת צו נגד רעיון. במיוחד לא רעיון שבא זמנו."
צו גורף מסוג זה נראה כעומד בסתירה לחוק, האוסר על "מניעה מוקדמת" של חופש הדיבור וחופש העיתונות, פרט למקרים קיצוניים של סכנה לבטחון המדינה ושלום הציבור.
"צו ההרחקה" מיום 25 ליוני, 2015, דווח בהרחבה על ידי התקשורת, אולם בית המשפט הטיל חיסיון בדיעבד על התיק כולו.

ניהול של הליכים למראית עין ופרסום כתבי בית דין למראית עין הוא שיטת שחיתות מוכרת וידועה של שופטים מזה מאות שנים. עיקרה של התנהלות זאת הוא בפרסום כתבי בית דין העומדים בניגוד לחוק, בשעה שהשופטים עצמם מחשיבים כתבים אלה לחסרי תוקף, אך סוחטים את שיתוף הפעולוה של הצדדים עם כתבים אלה.
באומות רבות, התנהלות מסוג זה היא במפורש התנהלות פלילית חמורה, הנחשבת לטיפוסית לפשע מאורגן בבתי המשפט. לעומת זאת בישראל, זיוף ושיבוש כתבי בית דין על ידי שופטים הפכו לתופעה נפוצה בעשור האחרון. תופעה זאת מתאפשרת במידה רבה על ידי מערכות המידע החדשות שהותקנו בבתי המשפט בעשור האחרון. יתרה מכך, גם כששופטים נתפסים בשיבוש וזיוף כתבי בית דין, אף שופט לא הועמד לדין, והשופטים מסרבים לענוש את השופטים העבריינים כדין.
דו"ח של Human Rights Alert – NGO נכלל בדו"ח הצוות המקצועי של מועצת זכויות האדם של האו"ם על ישראל (2013), בלוויית ההערה "חוסר יושרה במערכות הכתבים האלקטרוניים של בית המשפט העליון, בתי המשפט המחוזיים, ובתי הדין למוחזקי משמורת בישראל". [3] הכנס האירופי למחשוב ממשלתי (2015) כלל מאמר והרצאה: "מערכות מידע הונאתיות חדשות בבתי המשפט בישראל – שינוי שיטת משטר בלתי מוכרז?" [4]
במהלך השנה האחרונה, דיכוי חופש הדיבור הפך לעניין בולט במדינת ישראל. סדרת "צווי איסור פרסום" הונפקו בחודשים האחרונים לגבי פרשיות השחיתות האחרונות, הנוגעות בבכירים במשטרה, בפרקליטות, ובשופטים. [5] יתרה מכך, מקורות מהימנים מדווחים על איומים של הנהלת בתי המשפט על אנשי תקשורת, במטרה להסיר דיווחים על חקירות נגד שופטים המעורבים בפרשיות אלה.
במקביל, עוסקים בתי המשפט במניעת סיטונאית של גישת הציבור לתיקי בתי המשפט, העוסקים בפרשיות השחיתות. הגישה לעיון בתיקי בתי המשפט נחשבת לחלק בלתי נפרד של חופש הדיבור וחופש העיתונות. בית המשפט העליון הכריז בעבר על זכות העיון כ"עקרון יסוד במשטר דמוקרטי" ו"זכות חוקתית על-חוקית", אך ברור שאין לשופטים בישראל כל כוונה לקיים זכות זאת, אם יש חשש שתביא לידיעת הציבור את ממדי השחיתות...
ההגבלות על חופש הדיבור בלטו גם במהלך סבב האלימות בקיץ שעבר. מעסיקים שונים, ובהם אוניברסיטאות, הורו למועסקים שאסור להם להתבטא בעניינים פוליטיים, גם אם מחוץ לשעות העבודה ומחוץ למקום העבודה. המקרה הבוטה ביותר היה של דקאן בית הספר למשפטים בבר-אילן, שדרש התנצלות מפרופסור למשפטים, שהביע את צערו על אובדן חיים – ולא כפי שהדקאן היה רוצה – צער על אובדן חיי יהודים בלבד...
חופש הדיבור וחופש העיתונות הם קרוב לוודאי שני התחומים, בהם ישראל כושלת בצורה הברורה ביותר בניסיונה הכושל לפרסם את עצמה כ"דמוקרטיה היחידה במזרח התיכון". ושחיתות השופטים עומדת במרכז כשל זה – שחיתות שמערכת המשפט אינה מוכנה להודות בקיומה, ומנסה למנוע כל פירסום אודותיה...
