Attorney Heli Bracha from the Legal Bureau of the Administration of Courts, with no lawful appointment and no authority at all, sen a "response" on an "inquiry" that never existed at all. The core fraud in the "response": It is impossible to view "post-it decisions" of the courts "from computational perspective". The reason for the "response" was probably requests to inspect court records in recent corruption cases, but Attorney Bracha refused to disclose the reason for her letters. The case again documents the fundamental fraud in development, implementation and operation of Net-HaMishpat - IT system of the Israeli courts, the central role of the Administration of Courts in such fraud, and the general fraud in the courts in conduct of the recent major government corruption trials.
Figures: The fraud by Administration of Courts, headed by Judge Michael Spitzer was prompted by requests to inspect court records in three major recent corruption trials:Holyland scandal (bribes taken by former PM Ehud Olmert), Rabbi Pinto (bribes taken by senior Israel Police officers), and Ruth David-Ronel Fisher scandal (bribes paid by former Tel-Aviv District Attorney and her law firm partner to senior Israel Police officers).

OccupyTLV, September 6 - Judge Michael Spitzer, Head of the Administration of Courts has been asked for immediate response on fraud in conduct of the office of Administration of Courts, relative to letters, issued by Attorney Heli Bracha of the Legal Bureau, claiming that it it is impossible to view "post-it decisions" in Net-HaMishpat - IT system of the Israeli courts - "from computational perspective".
The unsolicited letters by Attorney Bracha, apparently originated in requests to inspect court records in three recent or current major corruption trials:
- Holyland scandal - bribes taken by former PM Ehud Olmert and his secretary Shula Zaken,
- Rabbi Pinto-Menashe Arbiv -Ephraim Bracha scandal - bribes taken by senior Israel Police officers,
- Ruth David-Ronel Fisher-Eran Malka scandal - bribes paid by former Tel-Aviv District Attorney and her law firm partner to senior Israel Police officers.
The requests to inspect were filed as part of a survey and an academic study of exercising the right to inspect court records in criminal cases, originating in government corruption. Results of the survey so far show that Israeli judges deny access to court record in an arbitrary and capricious manner, in disregard of the law.

Your immediate response is requested in
this important matter.
Dear Judge Spitzer:
I herein request your immediate
response on my August 4, 2014 letter: [1] Request for response on the
July 26 and August 3, 2015 letters by Attorney Heli Baracha from Administration
of Courts, [2-3] regarding the public's right to inspect court decision
records. My request stated that Attorney
Bracha's letter were suspected fraud, and asked for your response within 14
days.
To this date, I have not received any
response from your office of my request.
However, in the meantime I have
received response from the Administration of Courts on Freedom of Information
Request (75-2015), which clarifies that
Attorney Bracha holds no lawful appointment at all in the State Service. [4-6] Therefore, her letters, which previously
were only suspected fraud, are fraud proper.
The essence of the fraud is in the
sending of letters by a person, who misrepresented herself as holding the
authority of a legal professional in the Administration of Courts, and
furthermore, misrepresented herself as providing a “response” on my “inquiry”
to the Administration of Courts, which never existed at all. Through such
misrepresentations, Attorney Bracha attempted to establish false and
deliberately misleading legal position, which falsely denied the right to
inspect court decisions: That “viewing” of “post-it decisions” in Net-HaMishpat
- IT system of the Israeli courts - was not possible “from computational
perspective”.
• Such letters made false and
deliberately misleading statement from “computational perspective”.
• Such letter attempt to unlawfully and
with no authority at all to deny a right, which was declared by the Supreme
Court's Judgment in petition The Association for Civil Rights in Israel v
Minister of Justice (High Court of Justice
5917/97) “a fundamental principle in a democratic regime” and “a
constitutional, supra-statutory right”.
The same Judgment also clarified the expectation, that with
implementation of Net-HaMishpat (IT system of the courts), decisions and
judgments would be “open for inspection by every person on an ongoing basis,
pursuant to the limits in the law”. [underline added -jz]
• Such letters also state a false and deliberately misleading legal
position relative to the Regulations of the Courts – Inspection of Court
Files (2003), Article 2(b), which states: “Every person is permitted to
inspect decisions, which are not prohibited for publication by law”.
• Such letters also stand contrary to the right to inspect court
decisions, which is established in the Universal Declaration of Human Rights,
Article 10 - the right for “fair, public hearing”.
Therefore, I herein request your immediate response in this
important matter, which undermines public trust in the courts.

עו"ד חלי ברכה מהלשכה המשפטית של הנהלת בתי המשפט, ללא כתב מינוי וללא סמכות כלל, שלחה "תשובה" על "פניה" שלא הייתה מעולם. עיקר ההונאה ב"תשובה": אין אפשרות לראות "החלטות בפתקית" ב"נט המשפט" - מערכת המידע של בתי המשפט - "מבחינה מחשובית". הסיבה למכתבים אלה, שעו"ד ברכה מסרבת לגלות, הייתה ככל הנראה בקשות לעיון בתיקי בתי המשפט בפרשות השחיתות האחרונות... מקרה זה מתעד שוב את ההונאה הבסיסית בפיתוחה, הטמעתה והפעלתה של "נט המשפט" - מערכת המידע של בתי המשפט, את תפקידה המרכזי של הנהלת בתי המשפט בעניין זה, ואת ההונאה הכללית בניהול משפטי השחיתות האחרונים בבתי המשפט.

מאהל המחאה ת"א, 6 לספטמבר - השופט מיכאל שפיצר, העומד בראש הנהלת בתי המשפט, התבקש לתת תגובה מידית על הונאה בהתנהלות הנהלת בתי המשפט, בעניין מכתבים שהונפקו על ידי עו"ד חלי ברכה מהלשכה המשפטית של הנהלת בתי המשפט, ואומרים שאין אפשרות לראות "החלטות בפתקית" ב"נט המשפט" - מערכת המידע של בתי המשפט - "מבחינה מחשובית".
מכתביה של עו"ד ברכה, שהוצגו כ"תשובה" על "פנייה" שלא הייתה מעולם, נבעו ככל הנראה מבקשות לעיון בתיקים בשלושה משפטי שחיתות בולטים:

הריני מבקש את תגובתך המידית בעניין חשוב זה.
לכבוד השופט מיכאל שפיצר,
הריני מבקש בזאת את תגובתך המידית על מכתבי מיום 4 לאוגוסט, 2014: [1] בקשה לתגובה על מכתביה של עו"ד חלי ברכה מהנהלת בתי המשפט, שתאריכיהם 26 ליולי, ו- 3 לאוגוסט, 2015, [2-3] בעניין זכות הציבור לעיון בהחלטות בתי המשפט. בקשתי ציינה שיש לראות את מכתביה של עו"ד חלי ברכה חשודים כהונאה, וביקשה את תגובתך בתוך 14 ימים.
עד יום זה לא קיבלתי כל תגובה ממשרדך על בקשתי זאת.
לעומת זאת, קיבלתי בינתיים את תשובת הנהלת בתי המשפט על בקשה בכפוף לחוק חופש המידע (75-2015), המבהירה שלעו"ד חלי ברכה אין כתב מינוי כדין כלל. [4-6] לפיכך, מכתביה של עו”ד ברכה, שהיו קודם לכן רק חשודים כהונאה, הם הונאה של ממש.
עיקר ההונאה הוא במשלוח מכתבים על ידי אדם המתחזה כבעל סמכות של משפטן מטעם הנהלת בתי המשפט, ומתחזה בנוסף כמספק "תשובה" על “פנייה” שלי להנהלת בתי המשפט, שלא הייתה מעולם. מתוך מיצגי שווא אלה, ניסתה עו"ד ברכה לבסס עמדה חוקית שקרית, מטעה בכוונה תחילה, השוללת במרמה את זכות העיון בהחלטות בתי המשפט: ש"ראייתן" של "החלטות הניתנות בפתקית" במערכת המידע "נט המשפט" של בתי המשפט בישראל אינה אפשרית “מבחינה מחשובית".
• מכתבים אלה מציגים אמירה שקרית ומטעה בכוונה תחילה "מבחינה מחשובית".
• מכתבים אלה בכללם מנסה לשלול שלא כדין וללא סמכות כלל את הזכות לעיון בהחלטות בתי המשפט, שהוכרזה על ידי בית המשפט העליון בפסק הדין בעתירת האגודה לזכויות האזרח בישראל נ שר המשפטים ואח' (בג”ץ 5917/97) "עקרון יסוד במשטר דמוקרטי" ו"זכות חוקתית על-חוקית". אותו פסק דין גם מבהיר שהציפייה הייתה שעם התקנת נט המשפט, יהיו פסקי הדין והחלטות בתי המשפט "פתוחים לעיונו של כל אדם באופן שוטף בכפוף למגבלות הדין". • מכתבים אלה גם מציגים עמדה שקרית ומטעה בכוונת תחילה ביחס לתקנות בתי המשפט – עיון בתיקים (2003), סעיף 2 (ב), האומר: "כל אדם ראשי לעיין בהחלטות שאינן אסורות לפרסום על פי דין.”
• מכתבים אלה גם נוגדים את זכות העיון בהחלטות בתי המשפט, הנובעת מההצהרה לכל באי עולם בדבר זכויות האדם, סעיף 10, הקובעת את הזכות ל”שימוע הוגן ופומבי”.
לפיכך, הריני מבקש את תגובתך המידית בעניין חשוב זה, המערער את אימון הציבור בבתי המשפט.
