נשיא בית המשפט העליון אשר גרוניס, מסרב להגיב על ראיות לשיבוש הליכי בג"ץ, וכן לא ענה עד כה על בקשה לכתב מינוייה של "מזכירה ראשית" שרה ליפשיץ, היושבת מעל ל-10 שנים במשרד המזכיר הראשי בבית המשפט העליון ללא כתב מינוי כחוק. שופטת בית המשפט העליון אסתר חיות עוסקת בניהול עתירה לבג"ץ שאינה עומדת בקנה אחד עם תקנות סדר הדין בבית המשפט הגבוה לצדק, והנפיקה החלטה שבית המשפט העליון מסרב עד כה לאשר "העתק מתאים למקור".

ירושלים, ה-23 למאי - בעתירה לבג"ץ, המביאה ראיות למרמה רחבת-היקף במערכות המחשבים מן הדור האחרון, שהותקנו בבתי המשפט בעשר השנים האחרונות, דר' יוסף צרניק, מסייג לזכויות האדם (NGO), הגיש היום בקשה להעברת העתירה להרכב של שלושה שופטי בית המשפט העליון. [1]

הבקשה שהוגשה היום מציינת שמזכירות בית המשפט העליון עוסקת בעקביות ובעקשנות בשיבוש הכתבים בעתירה זאת. פניות חוזרות לנשיא בית המשפט העליון אשר גרוניס בעניין זה לא הביאו עד כה לתיקונה של התנהלות זאת. הפניות לנשיא בית המשפט העליון נעשו כיוון שהראיות מצביעות על כך שהמזכירה הראשית בבית המשפט העליון, הגב' שרה ליפשיץ התנחלה במשרדה לפני יותר מעשר שנים ללא כתב מינוי כחוק. בקשה שהופנתה לנשיא אשר גרוניס, להמציא את העתק כתב מינוייה של הגב' שרה ליפשיץ, גם היא לא נענתה עד כה. 

העתירה עצמה נמצאת עתה בידיה של השופטת אסתר חיות, העתידה להתמנות לנשיאת בית המשפט העליון בשנים הקרובות. השופטת חיות טיפלה בעתירה זאת בניגוד לתקנות סדר הדין בבית המשפט הגבוה לצדק: במקום להוציא צו על תנאי כדין, או לדחות את העתירה על פניה, קבעה השופטת חיות מועד לתגובת המשיבים (שרת המשפטים ציפי לבני ומנהל בתי המשפט מיכאל שפיצר). אולם החלטתה זאת של השופטת חיות אינה חתומה, כוללת תניית פטור "כפוף לשינויי עריכה ונוסח", והתקבלה ללא מכתב מלווה מאת המזכירות. בקשה לקבל העתק בר תוקף של החלטה זאת, מאושר "העתק מתאים למקור", לא נענה עד כה.

בבתי המשפט שמקורם במשפט האנגלי המקובל, בקשה לקבלת אישור "העתק מתאים למקור", היא הצורה הפשוטה ביותר להבדיל בין כתבי בי דין בני תוקף, וכתבים למראית עין.

לפיכך, נראה שהשופטת אסתר חיות מנהלת בעתירה זאת הליך שאינו הליך התואם את חוקי מדינת ישראל - למעשה - הליך למראית עין.

העתירה עצמה, דר' יוסף צרניק נ שרת המשפטים ציפי לבני ומנהל בתי המשפט מיכאל שפיצר (2689/13) [2] מתעדת השחתה חסרת תקדים של בתי המשפט בישראל בעשור האחרון. תיקים המובאים כדוגמאות לשחיתות בתי המשפט בעתירה זאת כוללים:

1) תיקים מבית המשפט השלום חיפה (ענייני משפחה) שבהם מחזיקה השופטת אספרנצה אלון.

2) התיקים הקשורים למשה סילמן, ז"ל, בבית המשפט המחוזי ת"א, אותם ניהל הרשם חגי ברנר.

3) תיק אי.די.בי פיתוח (נוחי דנקנר) בבית המשפט המחוזי, ת"א, אותו ניהל השופט איתן אורנשטיין.

4) תיק בג"ץ נגד נגיד בנק ישראל סטנלי פישר, בנושא הפיקוח על הבנקים, אותו ניהלה רשמת בית המשפט העליון ליאת בנמלך.

העתירה טוענת ששחיתות בתי המשפט בעשור האחרון, שנחשפה בין השאר במקרים בהם נתפסו שופטים "משפצים" ו"מפברקים" את כתבי בתי המשפט, היא גורם מרכזי במשבר החברתי-כלכלי בישראל.

הבקשה להעביר את העתירה להרכב של שלושה שופטים, שהוגשה היום, אומרת:

מערכות המחשבים שהותקנו בבתי המשפט בישראל בעשור האחרון מחקות מירמה במחשבים של בתי המשפט בארה"ב, שהותקנו 10-20 שנה קודם לכן. על פי חוות דעת מומחים, שחיתות בתי המשפט בארה"ב היום היא ברמה חסרת תקדים בהיסטוריה של ארה"ב, וגורם מרכזי במשבר החברתי-כלכלי שם.

Jerusalem, May 23 - in a petition that claims large-scale fraud in the latest generation of computerized systems of the Israeli courts, implemented over the past decade, Joseph Zernik, PhD, of Human Rights Alert (NGO), filed a request for review by a three-justice panel. [1]

Today's request notes that since the filing of the petition, the Office of the Clerk has engaged in false and deliberately misleading registration of papers in the petition.

Repeat requests, which were addressed to the Presiding Justice Asher Grunis (in the absence of lawfully appointed Chief Clerk), did not remedy the situation.  The petition also documents that in the Israeli Supreme Court, Ms Sarah Lifschitz has occupied the office of the Chief Clerk for over 10 years with no lawful appointment records.

Justice Esther Hayut (who by the Israeli seniority system is scheduled to become Presiding Justice later this decade), to whom the petition was assigned, did not follow the Regulations of the High Court of Justice in handling the petition.  Instead of issuing a Conditional Decree (or dismissing the petition outright), she issued a false on its face decision (unsigned, subject to "editing and phrasing changes", and served with no authentication letter by the Office of the Clerk), asking the respondents for a response by May 30, 2013.

Petitioner's request to have such order signed "True Copy of the Original" by the Chief Clerk of the Israeli Supreme Court has not been addressed so far.

In the courts that originate from the English common law, asking for the Clerk's certification "True Copy of the Original" is probably the easiest way to distinguish between true and simulated court records.

The petition documents widespread corruption of the Israeli courts over the past decade, through the implementation of computerized record systems that undermined the authority, duties and obligations of the Chief Clerks, relative to the maintenance and service of honest court records, through the implementation of invisible electronic signatures ("The Emperor's New Clothes"), and through granting judges unlimited access to enter, alter, or adulterate court records with no checks by the Office of the Clerk. [2]

Today's request in part says:
“There is a reasonable concern that review of instant petition by a single justice  would deprive the Petitioner of his Due Process rights in a matter of high public policy significance, relative to the Rule of Law in the State of Israel.  Moreover, most likely, continued review of instant Petition by a single justice would create documentation that would be disgraceful for Justice Esther Hayut (future Presiding Justice of the Israeli Supreme Court), disgraceful for the Israeli Supreme Court, and disgraceful for justice and judges in the State of Israel today.  The Petitioner (who is not a legal scholar) doubts that even a panel of three justices could restore Due Process in instant Petition at this point.  However, the Petitioner hopes that a panel of 3  justices would find a way to generate a positive, constructive message out of this case for the future of justice in the State of Israel.”

The systems, which were implemented in the Israeli courts over the past decade, mimic similar fraudulent systems, which had been implemented in the state and federal courts in the United States a decade or two earlier.  Today, widespread corruption of the state and federal courts is one of the key causes of the socio-economic crisis in the United States.

The correspondence below was forwarded to the German Consul in Israel, who had previously provided protection against abuse of my rights by the US and Israeli governments.

The US Consulate, Jerusalem, Jerusalem, is built in the no man's land between territories that were held by Israel and Jordan prior to 1967. The US Consulate in Jerusalem is unique among US diplomatic missions, since it reports directly to State Department, and not to any ambassador. It is likely that the US considers the Jerusalem Consulate of similar status to Guantanamo Bay, Cuba - not subject to any law.

Brief summary:

On January 1st, 2013, my bank accounts in Israel were blocked by Bank HaPoalim. The bank claimed that it was done on behalf of the US gov. No written records were provided. No legal procedure was the basis for such conduct, either in Israel or in the US.
The Israeli gov refused to provide Equal Protection under the law.

Eventually, after request for protection by the German Consul in Israel, my money was returned.

In parallel, on January 14, 2013, I appeared in the US Consulate in Jerusalem, paid the exorbitant fees, and fulfilled my duties for renunciation of US citizenship. The US Consulate scheduled me outside of working hours, and probably outside of consular calendar, and US Consult Kirk G Smith refused to perform his duties, and only false and deliberately misleading records were produced.

No response was provided at the end of the correspondence below by the US Consulate in Jerusalem.

It is not expected that the US gov would recognize my renunciation of US citizenship anytime soon (i.e., I do not believe that I would ever get a CLN - "Certificate of Loss of Nationality".)


In recent years, record numbers of US citizens have been trying to renounce their citizenship, and the US gov is engaging in various delay tactics to prevent them from doing so, in direct violation of Article 18 of the Universal Declaration of Human Rights.

The Israeli Social Protest is back and gaining momentum.  Saturday night demonstrations are becoming a routine.  The specific locations, times are announced at times only hours ahead of the event, none of which was by permit.

Saturday, at 5:00pm in the afternoon, I had to decide:

1) The main event at HaBimah Square, Tel Aviv - a beautiful venue;

2) A demonstration in Poleg, 20 min along the shore north of Tel Aviv - in front of the home of gas tycoon Teshavah.  He already defaulted on public bonds, and now plans to export, with government blessing, the meager gas reserves of the State of Israel, in order to immediately materialize profits, while by world standards paying minimal royalties to the treasury.

3) A demonstration at Ceasaria, about 40 min up north along the shore - in front of seashore residences of Prime Minister Netanyahu.   Netanyahu maintains a oppulent court at a level of extravagance that is unprecedented in Israeli history with three residences maintained at exorbitant cost to the tax payer.  A fat retainer contract to a pistachio ice-cream vendor was recently cancelled after public outcry.

Organized transportation by bus was available to venues 2 and 3, and for one of them - a pre-party at the nearby home of an activist.

My choice was No 1 - at HaBimah Square.  The event was clearly non-violent.  Police was extremely cooperative and friendly,  the marchers made a round, which causes the closing to traffic of main avenues in the center of Tel Aviv.

As usual, the most often heard chant was  "Government, corporations - a crime organization" [Hon, Shilton - Olam Tahton], but at the Teshuvah demonstration the main chant was "it is our money".

Media reporting is understated, as usual in recent weeks.  Claims of imminent threat of missile attack by Syria occupy the headlines...

Personal note: My favorite dancing partners - "HaLo Nehmadot" (the hardcore activist group known as "not nice girls") went to events No 2 and 3 of course...
