א. נשיאת בית המשפט העליון אינה נותנת החלטה על בקשה לספק העתק חתום ומאושר של החלטתה מיום 12 לאוקטובר, שדחתה כביכול בקשה למינוי מותב חדש בתיק זה. [1] הבקשה למינוי מותב חדש נבעה מכך ששופטי המותב דנציגר, עמית וזילברטל לא ענו כדין על בקשת פסלות, ולכן יש לראותם כפסולים. החלטתה של הנשיאה נאור (כמו החלטתם הפגומה -אינה מנומקת - של שופטי המותב) פורסמה באתר בית המשפט, אבל לא הומצאה מעולם. ספרו של נשיא בית המשפט העליון יואל זוסמן ז"ל, מציין את טבען המפוקפק של החלטות שאינן מומצאות. באתר בית המשפט העליון, ההחלטות מתפרסמות בלתי חתומות, "כפוף לשינויי עריכה ונוסח"... לכן, על מנת לוודא את תקפותה של החלטת הנשיאה בעניין כשירות המותב, התבקשה נאור לספק העתק חתום ומאושר של החלטתה.
הבקשה כללה בין השאר:
1. דוגמאות של העתקים מאושרים כביכול של החלטות בית המשפט העליון בתיק זה, שיש לראותם כמשובשים או מזויפים.
2. העתק תשובה על פי חופש המידע, המראה של"מזכירה ראשית" (המוסמכת בחוק לאשר החלטות) עדית מלול אין כתב מינוי, ולכן אין לה סמכות לאשר את החלטות בית המשפט העליון כלל.
3. העתק "עקרונות יסוד בהעסקת בכירים בשירות המדינה" - המסביר מהו מינוי כחוק על פי התקשיר.
בינתיים אין כל תגובה של הנשיאה נאור.

אולי לא התכוונה הנשיאה נאור שההחלטה שלה מיום 12 לאוקטובר היא כתב בית דין אותנטי (אמיתי) בכלל? 

ב. הנשיאה נאור התבקשה לפרסם בדחיפות סדרים לקבלת העתקים חתומים ומאושרים של החלטות בית המשפט בכלל, ובתיק זדורוב בפרט - לאור השיבושים באישורים כביכול של החלטות קודמות. [2]
בינתיים אין תגובה של הנשיאה נאור.
אולי בית המשפט העליון אינו מתכוון כלל, שההחלטות שלו הן כתבי בית דין אותנטיים (אמיתיים)?
ג. מחר, בעזרת השם, יתנו לי לעיין בתיק, לאחר חודשים של דחיות. ניהול הליכים פליליים תוך הסתרת הכתבים הוא עברה חמורה על זכות האדם ל"שימוע הוגן ופומבי".  התנהלות זאת גם עומדת בסתירה להצהרת בית המשפט העליון עצמו, שזכות העיון היא "עקרון יסוד במשטר דמוקרטי", ו"זכות חוקתית על חוקית"... ההפתעה הגדולה, אני חושש, תהיה כמה הסנגוריה הציבורית נרפסת... בתיק בו פרופ' קרמניצר כתב "התנהלות התביעה מפחידה", התנהלות הסנגוריה הציבורית מפחידה לא פחות.. שלא לדבר על התנהלות השופטים...

The analysis and proposed corrective measures are based on the Human Rights Alert submission and report to the UN Human Rights Council, which were incorporated into the HRC 2013 Professional Staff Report.

Essentially, the analysis concludes with proposal for Truth and Reconciliation Commission, in view of widespread corruption of the judiciary, which amounts to a constitutional crisis in a nation with no constitution...

אם תחשבי על זה לעומק, המשמעות של מצב זה הוא ש*כל* שופטי בית המשפט העליון עוסקים יום יום, מאז 2002, ב:
* הונאה, 
* שיבוש כתבי בית דין, 
* שיבוש הליכים, 
* עיוות משפט, 
* הפרת אימונים (מה שהשופט המושחת דוד רוזן פירש - "בגידה"). 
לציבור הרחב זה בולט רק במקרים קיצוניים, כמו זדורוב, או אולמרט (שני הפכים). אבל אם עוקבים אחרי תיקים רבים בפירוט, רואים שזאת תופעה כללית.
התנהלות מסוג זה מוכרת בקרב מומחים לקרימינולוגיה, והיא טיפוסית למשטרים מושחתים. תופעה זאת נקראת בקרימינולוגיה: "פשיעה מאורגנת מדינתית". זהו מצב בו פשיעה מאורגנת מתנהלת תחת חזות רשות מדינתית.

אבל כל מי שמבין בשחיתות ופשיעה יסביר לך שבמצב שנוצר בבתי המשפט בישראל, צעדים טכניים קטנים, כפי שאת מציעה לא ישנו דבר.
אם היית מודיעה לדון קורליאונה שהוחלט להציב מכשיר הקלטה בסלון שלו, את חושבת שזה היה משנה משהו???

אולם לענייננו, מעניין במיוחד שהסנטור פטריק ליהי, דמוקרט ותיק ויו"ר ועדת החוקה של הסנאט, הציע עם בחירתו של אובמה וכניסתו לתפקיד בשנת 2009, שיש להקים ועדת אמת ופיוס נגד מערכת המשפט בארה"ב (שמצבה דומה לשלנו, ומקור ההשראה לשלנו).
אולם כמובן שאין אפשרות להקים ועדת אמת ופיוס נגד אלה שבעמדות הכוח, עד שהם מוסרים מעמדות הכוח.
בקיצור: המצב הקיים בישראל הוא שחיתות ברמה כזאת, שתיקונה מחייב לאתחל מחדש!
