מאהל המחאה ת"א, פורים - לקח שנים, ומאות מליוני ש"ח להקים את מערכת המידע של בתי המשפט - "נט המשפט", אבל היום, הנהלת בתי המשפט אומרת שאין כל תיעוד בכתובים של הנהלים הבסיסיים במערכת...

 

שופטים מזייפים את הכתבים בנט המשפט בסיטונאות, ואיש לא שואל את השאלה הבסיסית:  איך זה בכלל ייתכן מבחינה טכנית?  מערכת מידע תקינה הייתה אמורה למנוע דברים אלה...

 

הבקשה בכפוף לחוק חופש המידע (פ 7/2015) שאלה:

• מי אחראי על אבטחת מערכת המידע נט המשפט? בכיכול השב"כ אמור היה להיות אחראי, אבל השב"כ כבר ענו לי שהם אינם אחראים...
• מה הבסיס לכך שמנפיקים במערכת "הזמנות לדין" בלתי חתומות?  על פי החוק הזמנה לדין חייבת להיות חתומה על ידי המזכיר הראשי - הליך ללא "הזמנה לדין" תקינה הוא הליך פסול  מיסודו.
• איך יכול בעל דין לראות את כתבי "הזמנה לדין" או  "מכתב מלווה" בנט המשפט?  הראיות מצביעות על כך שכתבים אלה, שתקינותם חיונית לאימות הכתבים וההליכים, אינם נגישים במערכת כלל, וספק אם הם נשמרים במערכת בצורה אמינה.
• מי מוסמך לרשום כתב כ"פסק דין" בנט המשפט? והאם רישומו כ"פסק דין" אומר שהוא אכן "פסק דין"?  הראיות מצביעות על כך שהרישומים שרירותיים וגחמנים... וכזכור שופט העליון נועם סולברג הבהיר לנו  לאחרונה שוב, שבישראל אי אפשר לדעת מהו "פסק דין".  הונאה מצחיקה ממש...
• מי מוסמך להתקין קישורים לתיקי חקירות משטרתיות בהליכים פליליים בתיקי נט המשפט?  קישורים אלה הם עברה חמורה על זכויות האדם, כיוון שהם חושפים את בית המשפט לראיות שאינן נגישות לנאשם.
• מה הבסיס למניעת גישת הציבור ל"החלטות בפתקית"?  הרי הנשיאה דורית בייניש החליטה שיש בישראל זכות גישת הציבור להחלטות בתי המשפט?
• מה הבסיס למניעת גישת הציבור והצדדים בתיק לחתימות האלקטרוניות?  התקינו חתימות אלקטרוניות בלתי נראות - "בגדי המלך החדשים" - הונאה בסגנון ימי הביניים.... או אגדות ילדים... אי אפשר לדעת מה חתום ומה לא חתום.
• מה הבסיס למניעת גישת בעלי דין לתיקיהם? הראיות מצביעות על מניעת גישה מחוץ לבתי המשפט השלום והמחוזי ת"א...  הפרה חמורה של זכויות האדם...
• מה הבסיס למניעת הזכות להגשה ולהמצאה אלקטרונית לבעלי דין שאינם מיוצגים?  רק לעורכי דין ניתנת גישה למערכת - הפרה חמורה של זכויות האדם - אפליה בגישה לבתי המשפט....

התשובה מהיום אומרת שאין כל מידע בכתובים על שאלות אלה...
