OccupyTLV, May 9 - Joseph Zernik, PhD, of Human Rights Alert (NGO) filed in the Tel-Aviv District Court   Notice of probably missing/erroneous court file registrations and Request for correction in the Rabbi Pinto criminal litigation file.
The Notice and Request refer to two pieces of information:
a) The Verdict (Conviction) record, which according to media reports was rendered on April 14, 2015 is missing from both the “Decisions” and the “Judgments” lists. Missing court records must raise public concerns.

The decision records, which are posted in the public access system, include decisions on postponing hearing dates, changing defense counsel, and Defendant's access to evidence. Missing from the public access system are any hearing protocol, any decision pertaining to the evidence in this case, and any record of the conviction, reported by media to have taken place in a hearing on April 14, 2015. This court file and many others demonstrate that in the courts' new IT system, Net-HaMishpat, judges routinely maintain double-books for case dockets.

b) The April 28, 2015 sentencing hearing, which was extensively reported by media is listed, “Did not take place”, in the Court Calendar. The Case Calendar, likewise, shows that the hearing did not take place. In other cases, it has been documented that judges conduct “unofficial hearings”, off the record (simulated hearings), while the public and parties are under the impression that they are witnessing a lawful, effectual court hearing.

The correction, or failure to do so, would provide clear evidence whether the state of these pieces of information is the result of "human error", or deliberate conduct of the Court.
Pinto is on trial for attempting to bribe Israel Police Brigadier General Ephraim Bracha, Head of the National Fraud Unit. In his investigation, Pinto provided incriminating evidence regarding Major General Menashe Arviv, Head of Lahav 433, the main investigative unit of the Israel Police, popularly known as the Israeli FBI. Pinto claims that he also holds incriminating evidence against the Israel Police Brigadier General Ephraim Bracha, Head of the National Fraud Unit. It is most likely the worst of the corruption scandals in the Israel police, which have rocked its top command in recent years.
Request to Inspect the Court file was filed on April 29, 2015. [1]  No Decision or Responses by the parties have been received so far on the Request to Inspect.
It should be noted that the Requester has no access to the  "Requests Docket", and must rely on phone or internet chat with an agent to be informed of the existence or lack thereof of registration of his own Requests in Net-HaMishpat in the court file.
Such services are provided with disclaimers relative to legal liability regarding the accuracy of the information...
The same services have to be consulted on a routine basis to ascertain whether decisions were listed, since the Court obviously runs in this case double books for the "Decisions Docket": On April 29, 2015, only seven (7) decision records were listed today in the online public access system, in a case that should by now hold at least a couple dozen decision records. The records, which are posted in the public access system, include decisions on postponing hearing dates, changing defence counsel, and Defendant's access to evidence. Missing from the public access system are any hearing protocols, and any decisions pertaining to the evidence in this case.
The maintenance of double-books for Decision Dockets is not unique to this court file, but the pattern is particularly blatant in cases that are related to corruption of government agencies.
Based on experience in other cases in Net-HaMishpat, it is entirely probable that Judge Mudrick would list the decision on the Request to Inspect in a manner that is inaccessible to the Requester, and fail to duly serve it either.
The Request to Inspect the Pinto court file in the Tel-Aviv District Court was filed as part of a study of access to court files in the State of Israel, following major changes in administration of the courts over the past decade.  While the Israeli courts repeatedly declared that public access to court files is a "basic principle of a democratic regime", experience so far indicates that the courts place major hurdles on public access to court files.  The denial of access is particularly noticeable in cases related to corruption of government agencies.
Public access to court records is known for centuries as the fundamental way to safeguard the integrity of the courts, and absent public access to court records it is impossible to maintain the integrity of the courts.

מאהל המחאה ת"א, 8 למאי - דר' יוסף צרניק (Human Rights Alert - NGO) הגיש בבית המשפט המחוזי ת"א עליון הודעה על רישומים חסרים/שגויים ככל הנראה, ובקשה לתיקונם בתיק התביעה הפליילית  בפרשת הרב פינטו, הנידון בפני השופט עודד מודריק.


ההודעה והבקשה מתייחסות לשני פרטי מידע:
א) הכרעת הדין (הרשעה) שעל פי התקשורת נתנה ביום 14 לאפריל, 2015, לא הופיעה בבדיקה - לא ברשימת ההחלטות ולא ברשימת פסקי הדין.  כתבים שיפוטיים חסרים, ובפרט פסקי דין חסרים חייבים לעורר חשש.


תמונה: ביום 29 לאפריל, 2015, נמצאו שבע (7) החלטות בתיק מדינת ישראל נ פינטו, שאמור לכלול עתה לפחות שני תריסרי החלטות. כתבי ההחלטות, המופיעים במערכת גישת הציבור, כוללים החלטות על דחיית מועדי דיון, החלטות על החלפת סנגוריו של פינטו, ועל בקשתו לעיין בחומר הראיות. אולם חסרים במערכת כתבי הפרוטוקולים של הדיונים בתיק זה, החלטות הנוגעות לראיות, וכתב הכרעת הדין, שנתנה על פי התקשורת בדיון מיום 14 לאפריל, 2015. רשימת ההחלטות בתיק זה ואחרים מראים שבמערכת המידע החדשה של בתי המשפט, נט המשפט, השופטים מנהלים בשגרה ספרים כפולים לגבי רשימות ההחלטות.

ב) הדיון בענישה מיום 28 לאפריל, 2015, שדווח בהרחבה בתקשורת, רשום כ "לא התקיים" ביומן בית המשפט.  יומן הדיונים בתיק גם הוא מציין שהדיון נדחה.  לפיכך, יש מקום לחשש שהדיון שדווח בתקשורת היה "דיון בלתי פורמלי" ללא פרוטקול - כלומר לא דיון בר תוקף כלל.

תיקון הכתבים, או אי תיקונם, יספק ראיות לשאלה האם הרישומים והכתבים החסרים הם תוצאה של "טעות אנוש", או תוצאה של התנהלות מכוונת של בית המשפט.

פינטו עומד למשפט על נסיון לשחד את תת-ניצב אפרים ברכה, ראש היחידה הארצית לחקירות הונאה. במהלך חקירתו, סיפק פינטו מידע מפליל על שיחוד ניצב מנשה ארביב, לשעבר מפקד לה"ב 433, יחידת החקירות המרכזית של משטרת ישראל. פינטו טוען שבידיו גם מידע מפליל לגבי תת-ניצב אפרים ברכה. זוהי ככל הנראה החמורה מבין פרשות השחיתות שזעזעו את צמרת המשטרה בשנים האחרונות.

כלי התקשורת העלו חששות שרשויות החוק מנסות למנוע חקירה מקפת וראויה של הפרשה על כל גרורותיה, והתנועה לאיכות השלטון עתרה נגד עסקת הטיעון המקלה במיוחד, שנחתמה על ידי הפרקליטות, תחת היועץ המשפטי לממשלה יהודה ויינשטיין, עם הנאשם פינטו.
בקשה לעיון בתיק זה הוגשה ביום 29 לאפריל, 2015. [1]  עד היום לא התקבלה כל תשובה מהצדדים או החלטה מבית המשפט.יש לציין שלמבקש העיון אין כל גישה לוודא באופן ישיר את רישום הבקשות, שכן, רשימת הבקשות אינה נגישה לציבור.  לפיכך על המבקש להסתמך בעניין זה על שירות טלפוני או צ'ט ברשת, עם סוכנים של הנהלת בתי המשפט, הפועלים תחת תניית פטור לגבי אחריותם למידע.יש לפנות לאותם שירותים באופן תדיר על מנת להוודע האם התקבלה החלטה בעניין הבקשה לעיון, כיוון שעל פי הניסיון בתיקים אחרים, השופט עודד מודריק עלול לרשום את ההחלטה בצורה שלא תהיה נגישה לציבור, ולא להמציא אותה כלל למבקש.
בית המשפט בבירור מנהל ספרים כפולים לגבי "רשימת ההחלטות" בתיק זה. רק שבע (7) החלטות הופיעו ביום 29 לאפריל, 2015 במערכת גישת הציבור בתיק זה, שהיה אמור לכלול אז לפחות שני תריסרי החלטות. הכתבים, המופיעים במערכת גישת הציבור, כוללים החלטות הנוגעות לשינוי מועדי דיון, להחלפת סנגוריו של פינטו, ולבקשתו לעיין בחומר הראיות. אולם אין בין כתבים אלה אף כתב החלטה הכולל פרוטוקול של דיון בתיק זה, וכן אין בין כתבים אלה כל כתב החלטה הנוגע להוכחות.ניהול ספרים כפולים לגבי רשימת ההחלטות בתיק זה אינו תופעה יוצאת דופן.  נוהג זה בולט במיוחד בתיקים הנוגעים לשחיתות רשויות השלטון.

הבקשה לעיון בתיק פינטו בבית המשפט המחוזי ת"א הוגשה כחלק מסקר על גישת הציבור לעיון בתיקים בבתי המשפט בישראל, לאחר המהפך בהנהלת בתי המשפט בעשור האחרון.  בתי המשפט בישראל הכריזו שוב ושוב שזכות גישת הציבור לעיון בתיקים היא "עקרון בסיסי במשטר דמוקרטי".  אולם הסקר מראה שבפועל, בתי המשפט מקשים או מסרבים לאפשר את הגישה לעיון בתיקים.  מצב זה בולט במיוחד בתיקים הנוגעים לשחיתות רשויות השלטון. 
 
גישת הציבור לעיון בתיקי בתי המשפט מוכרת מזה מאות שנים כאמצעי הבסיסי לשמירה על יושרת בתי המשפט, וללא גישה לעיון בתיקי בתי המשפט בלתי אפשרי לשמור על יושרת בתי המשפט.

A. Notice of probably missing/erroneous court file registrations
  1. In the course of filing the April 29, 2015 Request to inspect, the Requester to Inspect noticed the following probably erroneous/missing registrations in instant court file:
a) The Verdict (Conviction) record, which according to media reports was rendered on April 14, 2015 is missing from both the “Decisions” and the “Judgments” lists. Missing court records must raise public concerns.
b) The April 28, 2015 sentencing hearing, which was extensively reported by media is listed, “Did not take place”, in the Court Calendar. The Case Calendar, likewise, shows that the hearing did not take place. In other cases, it has been documented that judges conduct “unofficial hearings”, off the record (simulated hearings), while the public and parties are under the impression that they are witnessing a lawful, effectual court hearing.
  1. Such registrations, in case they are indeed missing/erroneous, may undermine public trust in the judicial process in general and in instant court file in particular.
  2. Therefore, the Requester is performing his public duties by noticing the Court of such probably missing/erroneousregistrations.
B. Request for correction of probably missing/erroneous court file registrations
  1. Therefore, in view of the above, the Requester is asking the Court to correct the registrations of the April 14, 2015 Verdict and the April 29, 2015 Sentencing Hearing, in case they are indeed missing/erroneous court file registrations.
In view of the importance of public trust in the judicial process, the Court should address instant Notice and Request.

    א) כתב הכרעת הדין (הרשעה), שעל פי התקשורת ניתן ביום 14 לאפריל, 2015, אינו מופיע ברשימת "החלטות בתיק", וכן אינו מופיע ברשימת "פסקי דין" בתיק זה. כתבי בית דין חסרים חייבים לעורר את חששות הציבור.

  1. לפיכך, לאור האמור לעיל, מבקש העיון מבקש שבית המשפט יתקן את הרישומים הנוגעים לכתב הכרעת הדין מיום 14 לאפריל, 2015, ולדיון מיום 29 לאפריל, 2015, ככל שהם רישומים חסרים או שגויים בתיק זה.
לאור חשיבות אמון הציבור בהליך השיפוטי, מן הראוי שבית המשפט יתייחס להודעה ובקשה זאת.

OccupyTLV, May 8 - Joseph Zernik, PhD, of Human Rights Alert (NGO) filed in the Supreme Court Request for Leave to File and Reply on Responses by the parties on Request to Inspect former Prime Minister Ehud Olmert's appeal file in the Supreme Court  in the Holyland corruption scandall.
The original Request to Inspect the Holyland-Olmert Supreme Court appeal file was filed on March 23, 2015. [1]  The State Prosecution's objection to inspection of the Supreme Court file in this case is limited (in contrast with the Zadorov and Baranes cases...), while the Defendant clearly objects (in contrast with the Zadorov and Baranes cases...).
Defendant Olmert in part argues that inspection should be postponed until the appeal process is completed, and not while while the case is pending before the court.
The reply in part argues that such claim by Defendant Olmert amounts to restricting the principle of public hearing to retroactive publicity only...
Olmert was purportedly convicted in 2014 by Tel-Aviv District Judge David Rosen on bribery charges in the Holyland affair and sentenced to a six year prison term.  The purported conviction and sentencing in this landmark case were widely reported by Israeli media.
However, inspection of the Tel-Aviv District Court file of the Holyland affair has so far failed to discover duly made conviction and sentencing records for former PM Olmert and his secretary Shula Zaken (in contrast with other defendants in the same case).
In response to Request to Inspect in the Tel-Aviv District Court, Judge David Rosen first produced an incredible response, claiming that the records (today - supposedly electronic records) were "physically" moved to the Supreme Court.  Judge Rosen's decision on the Request to Inspect in the Tel-Aviv District Court was first listed in Net-HaMishpat (IT system of the Court) in a manner that the Requester could not access it, and was not served on the Requester either.
Following a request for due process service, an unsigned , unauthenticated copy of the same decision was sent to the Requester.  But Judge Rosen continues to refuse to respond on repeat requests for a signed and authenticated copy of the purported decision on the Request to Inspect Olmert''s and Zaken's conviction and sentencing records.
The public access system of the Tel-Aviv District Court shows about 60 decisions in the Holyland corruption court file, while the Office of the Clerk access system shows over 260 decisions in the same court file.  The maintenance of double-books in this case for the dockets is not unique.  Such practice is particularly blatant in cases related to corruption of government agencies.
Judge Rosen's March 18, 2015 Decision record, purporting that the duly made conviction and sentencing records were "physically" moved to the Supreme Court, has not been registered in the public access system to this date either, regardless of repeat requests for honest registration, filed with Judge David Rosen...

מאהל המחאה ת"א, 8 למאי - דר' יוסף צרניק (Human Rights Alert - NGO) הגיש בבית המשפט העליון בקשת רשות הגשה ותגובה על תשובות הצדדים על בקשה לעיון בתיק הערעור של ראש הממשלה לשעבר אהוד אולמרט בפרשת הולילנד בבית המשפט העליון.
הבקשה לעיון הוגשה ביום 23 למרץ, 2015.  [1]  התביעה השיבה בהתנגדות מוגבלת לעיון בתיק זה (בניגוד לתיקי ברנס וזדורוב), בעוד המערער אולמרט השיב בהתנגדות כללית (בניגוד לסנגוריה בתיקי ברנס וזדורוב).
תשובת אולמרט טוענת בחלקה שיש לדחות את העיון עד למתן פסק-דין בערעור, ולדחות את העיון בזמן שהמקרה תלוי ועומד בבית המשפט העליון.
תגובת מבקש העיון טוענת שתשובת אולמרט בעניין זה כמוהה כהגבלת פומביות הדיון לבדיעבד בלבד...
אולמרט הורשע כביכול בשנת 2014 בבית המשפט המחוזי ת"א על ידי השופט דוד רוזן על קבלת שוחד בפרשת הולינד, ודינו נגזר כביכול לשש שנות מאסר בפועל.  הרשעה וגזר הדין בבית המשפט המחוזי ת"א דווחו בהרחבה בתקשורת הישראלית, בתיק שהוא בעל חשיבות היסטורית.
אולם עיון בתיק  הולילנד בבית המשפט המחוזי ת"א לא העלה עד היום כתבי הכרעת דין וגזר דין עשויים כדין לגבי אולמרט וזקן (בניגוד לנאשמים אחרים באותו תיק).
בתשובה על בקשה לעיון בבית המשפט המחוזי ת"א, הנפיק השופט דוד רוזן כתב החלטה תמוה, הטוען שכתבי הכרעת הדין וגזר הדין של אולמרט וזקן הועברו "פיזית" לבית המשפט העליון (בשעה שבית המשפט המחוזי ת"א מנהל כביכול תיקים אלקטרוניים).  כתב ההחלטה של השופט רוזן בעניין הבקשה לעיון נרשם תחילה בנט המשפט בצורה שלא הייתה נגישה למבקש העיון, וגם לא הומצא למבקש.
בעקבות בקשה להליך הוגן, נשלח למבקש העיון כתב ההחלטה - בלתי חתום ובלתי מאומת.  השופט רוזן ממשיך לעמוד בסירובו לספק למבקש העיון העתק חתום ומאומת כדין של כתב החלטה זה...
מערכת גישת הציבור לכתבים בבית המשפט המחוזי ת"א בתיק הולילנד מראה כ-60 החלטות בלבד, בשעה שמערכת גישת המזכירות באותו תיק מראה יותר מ-260 החלטות.  קיום ספרים כפולים לגבי רשימות ההחלטות בתיק זה אינו תופעה יוצאת דופן.  נוהג זה בולט במיוחד בתיקים הנוגעים לשחיתות רשויות השלטון.
החלטתו של השופט רוזן,שכתבי הכרעת הדין וגזר הדין עשויים כדין  הועברו כביכול "פיזית" לבית המשפט העליון לא נרשמה במערכת גישת הציבור. זאת - למרות בקשות חוזרות לשופט רוזן לרישום הוגן של החלטותיו בנידון הבקשה לעיון.

I file herein my Request for Leave to File Reply on Responses by the parties in instant court files on my Request to Inspect.
1. On March 23, 2015, I filed my Requests to Inspect in the following court files in the Office of the Clerk:
a) Ehud Olmert v State of Israel (4478/14)
b) Ehud Olmert v State of Israel (5270/14)
  1. On April 21, 2015, I filed Requests for Due Process in both court files, since the parties' Responses on my Requests to Inspect had not been duly served on me.
  2. On April 27, 2015, I received by email from Appellant Olmert's Counsel the copies of parties' responses on my Request to Inspect instant court files.
  3. Therefore, I file herein my Request for Leave to File Reply on the parties' responses on my Request to Inspect in instant court files.
    The Court should grant instant Request for Leave to File for the cause of furthering the fundamentals of justice.
b) Reply by Filer of the Request to Inspect on Responses by parties in instant court files
Following is my Reply on the parties' Responses on my Request to Inspect:
  1. The State Prosecution's Response says:
    The limits of Dr Joseph Zernik's Request to Inspect “all paper and electronic records in instant court files” are unclear. As far as it refers to protocols of hearings of the Court, and court file records, the State Prosecution hold no objection.
    2. Regarding the State Prosecution's Response, I herein clarify: In part, the purpose of my research is to examine the limits on the public's right to access court records in the wake of implementation of IT systems in the courts, and administration of public access in such systems. Therefore, the Request to Inspect was stated in the most general manner in almost all requests to inspect, which I have filed in the various courts in recent years. It refers to all records in instant court files, including both paper or electronic records, including also all registrations in instant court files, e.g.: lists of records, lists of requests, lists of service, etc. In other word, the Request to Inspect pertains all records that were included prior to the implementation of IT systems (for example, in Regulations of the Court – Registration Office, 1936) as “records and books” of the courts.
    3. Counsel for Appellant Olmert in her response says in part:
    In instant court file, key arguments have been filed in written records and oral arguments have been stated in hearings, and the case is pending before the Honorable Court. Under such circumstances, it appears right to wait with inspection of the court file until after the Honorable Court grants its judgment. Once judgment is granted, the Appellant would have no objection to the inspection.
    4. On the Response by Counsel for Appellant Olmert I herein reply as follows: In part, the purpose of my study is to test the limits of the public's right to access court records and the requirement for justification of requests to inspect court records in the State of Israel in the wake of the 2009 Judgment in Association for Civil Rights in Israel et al v Minister of Justice et al (5917/97). The Judgment says in part:
    The principle of public hearing is a fundamental principle of any democratic regime. It holds a constitutional status, superior to regular acts in our legal system, and there is no dispute regarding its importance and centrality...
    The right to access court records to inspect and to copy and to publish their content is derived from Basic Law: The Judicature, Article 3, which provides the principle of public hearing, and from the rule, applicable to any public authority, which holds authority by law, according to which, in the absence of statutory provisions to the contrary, its records shall be open and visible...”. Judgment of the Israeli Supreme Court 4825/97 Gahel v Tax Assessment Officer (2001).
    Regarding the requirement for justification by the Filer of Request to Inspect versus the burden of convincing on a party opposing the inspection, the Judgment in the Association's petition says:
    The opening position is that the inspection should be granted, and given such opening position, the party, who opposes the inspection, carries the burden of convincing that it should not be permitted...
    The Filer of Request to Inspect needs to disclose the essence of his objective in the inspection... The burden is not on the Filer of the Request to Inspect, but on the party opposing the inspection. Under such circumstances, the requirement for justification in the Regulations – which, as stated, is minute, and unlimited in its causes – creates no burden of convincing on the Filer of the Request to Inspect... The infringement on the public's right to access court records to inspect and to copy – if any – resulting from the requirement for justification, is marginal and small, and in no case amounts to infringement, which requires examination of the Regulations under Constitutional standards...
    The weight of the public's right to access court records to inspect and to copy by a person, who is driven by mere prurience, is inferior to the weight of the right of a person, who requests to inspect and to copy for the purpose of study or research.
    5. In view of b) 4., above, the Filer of the Request to Inspect in instant court files should be deemed as one who fulfilled the requirement for justification.
    6. Appellant Olmert's response on the Request to Inspect, in fact requests that the principle of public hearing be restricted by its application only in retrospect, but not during of the litigation. It is doubted that a reasonable person would find such argument convincing. On the contrary, any reasonable person would most likely find that postponing the right to inspect until after the judicial process is completed as voiding the principle of public hearing from its foundation. Therefore, the objection to the inspection by Appellant Olmert should be deemed as one that did not fulfill the requirement of convincing.
    7. The Judgment in the Association's petition also repeats the petitioners' arguments regarding the importance of the right to access court records relative to public trust in government authorities:
    The importance of this principle is in generating public trust in the public authorities in general, and in the courts in particular, since it contributes to generating the appearance of the process of justice in a manner that promotes such trust.
    A similar statement appears in the landmark ruling of the US Supreme Court, pertaining to the public's right to access court records to inspect and to copy, as one of the foundations of such right: to fulfill the citizen's desire 'to keep a watchful eye on the workings of public agencies'. [i]
    There is no doubt that instant court files are ones, where the need to promote public trust in government authorities in general and in the courts in particular, holds special importance.
    8. The Judgment in the Association's petition finds the need to balance the right to access court records to inspect and to copy with the right for privacy. However, the parties in instant court files have not argued the right for privacy in their Responses, and the Filer of the Request to Inspect claims that the right for privacy exists in instant court files neither for Appellant Olmert, nor for Appellee State of Israel. Alternatively, in case any right for privacy exists relative to some specific record, the Court should order the redaction of the relevant information.
The Court should grant instant Request in compliance with provisions of the law and the fundamentals of justice.

  1. ביום21 לאפריל, 2015 הגשתי בקשות להליך הוגן בתיקים אלה, לאחר שלא הומצאו לי תגובות הצדדים על בקשותי לעיון בתיקים אלה.
  2. ביום 27 לאפריל, 2015 קיבלתי בדוא”ל מבא כוחו של המשיב אולמרט את העתקי תגובות הצדדים על הבקשות לעיון בתיקים אלה.
  3. לפיכך, הריני מבקש בזאת את רשות בית המשפט להגשת תגובות המבקש על תשובות המשיבים על הבקשות לעיון בתיקים אלה.
מן הדין והצדק שבית המשפט יתיר את הגשת תגובות המבקש בבקשות לעיון בתיקים אלה.
ב) תגובת המבקש על תשובות המשיבים על הבקשות לעיון
להלן תגובת המבקש על תשובות המשיבים על הבקשות לעיון בתיקים אלה:
1. פרקליטות המדינה אומרת בתשובתה:
גדרי בקשת דר' יוסף צרניק לעיין "בכל כתבי הנייר והכתבים האלקטרוניים בתיק" אינם ברורים דיים למשיבה. ככל שמדובר בפרוטוקולים של דיונים בבית המשפט ובכתבי בית דין אין למשיבה התנגדות.
2. לעניין תגובת המשיבה פרקליטות המדינה הריני מבהיר: מטרת מחקרי בחלקה לבדוק את גדרי זכות העיון בכתבי בתי המשפט בעקבות הנהגת מערכות המידע האלקטרוניות, וכן את ניהול התיקים וניהול גישת הציבור לאחר הנהגת מערכות אלה. לפיכך, נוסחה הבקשה בצורה הכללית ביותר. והיא מנוסחת בצורה כמעט זהה בכל הבקשות שהיגשתי בשנים האחרונות בבתי המשפט השונים במדינת ישראל. הכוונה היא לכלל הכתבים, ובתוכם כתבי נייר וכתבים אלקטרוניים, ולכלל הרישומים בתיק, כגון: רשימת הכתבים, רשימת הבקשות, רשימת ההמצאות, וכו'. במילים אחרות, כלל מה שנקרא לפני הנהגת מערכות המידע האלקטרוניות, (לדוגמה, בתקנות בתי המשפט - משרד רישום, 1936) "כתבים ופנקסים” של בתי המשפט.
3. באת כוח המשיב אולמרט אומרת בין השאר בתשובתו:
בתיק זה הוגשו עיקרי טיעון בכתב ונשמעו טיעוני הצדדים בעל פה, והתיק תלוי ועומד וממתין לפסק דין על ידי בית המשפט הנכבד. בנסיבות אלה, נראה לנו כי נכון יהיה להמתין עם העיון בתיק עד לאחר מתן פסק הדין של בית המשפט הנכבד. לאחר מתן פסק הדין לא יתנגד המשיב לבקשה לעיון בתיק.
4. על תשובתו של המשיב אולמרט הריני מגיב להלן: בחלקה, מטרת‬ מחקרי לבדוק את גדרי זכות העיון ואת גדרי חובת ההנמקה של המבקש לעיין בכתבי בתי המשפט בישראל בעקבות פסק הדין משנת 2009 בעתירת האגודה לזכויות האזרח ואח' נ שר המשפטים ואח' (5917/97). פסק דין זה אומר בין השאר:
עקרון פומביות הדיון הוא עקרון יסוד של כל משטר דמוקרטי. הוא בעל מעמד חוקתי על-חוקי בשיטתנו המשפטית, ועל חשיבותו ומרכזיותו אין חולק...
"הזכות לעיין במסמכי בית המשפט ואף הזכות לפרסם את תוכנם נגזרות מסעיף 3 לחוק יסוד: השפיטה, הקובע את עקרון פומביות הדיון, ומן הכלל החל על כל רשות ציבורית הממלאת תפקיד על-פי דין, ולפיו, בהעדר הוראה חקוקה הקובעת אחרת, מסמכים שברשותה צריכים להיות גלויים ופתוחים...". פסק הדין בע"א 4825/97 גהל נ' פקיד השומה למפעלים גדולים, פ"ד נה(2) 433, 437 (2001)
וכן אומר פסק הדין בעתירת האגודה לגבי חובת ההנמקה של מבקש העיון לעומת נטל השכנוע על המתנגד לעיון:
נקודת המוצא הינה כי יש להתיר את העיון, ובהתחשב בנקודת מוצא זו, על בעל הדין המתנגד לעיון הנטל לשכנע כי אין להתירו...
על מבקש העיון לגלות בתמצית את מטרת העיון... הנטל הוא לא על מבקש העיון כי אם על המתנגד לו. במצב דברים זה, אין בדרישת ההנמקה הקבועה בתקנות - שהינה כאמור דרישה מזערית אשר אינה מוגבלת בעילותיה - משום הטלת נטל השכנוע להתרת העיון בתיק על מבקש העיון... הפגיעה בזכות העיון - אם נגרמת - כתוצאה מדרישת ההנמקה הינה פגיעה שולית וקטנה ביותר, אשר בכל מקרה אינה עולה כדי הפגיעה המחייבת את בחינת התקנות במשקפי הבחינה החוקתית...
משקלה של זכות העיון של מי שמבקש לעיין בתיק מתוך סקרנות גרידא פחוּת ממשקל זכותו של מי שמבקש לעיין בתיק לצורך לימוד או מחקר.
  1. לאור האמור בפסקה ב)4., לעיל, מן הראוי לראות את מבקש העיון במקרה זה כמי שמילא את חובת ההנמקה.
  2. המשיב אולמרט מבקש למעשה בתשובתו על הבקשה לעיון לצמצם את עקרון פומביות הדיון ולהפעילו רק בדיעבד, אך לא במשך הדיון. ספק אם אדם בר דעת ימצא טיעון זה משכנע. נהפוך הוא, כל אדם בר דעת קרוב לוודאי ימצא את דחיית זכות העיון עד לאחר תום ההליך המשפטי כמעקרת את עקרון פומביות הדיון מיסודו. לפיכך, מן הראוי לראות את ההתנגדות לעיון בתשובתו של המשיב אולמרט כשאינה מספקת את נטל השכנוע.
  3. פסק הדין בעתירת האגודה גם חוזר על טיעוני העותרים לגבי חשיבות זכות העיון לגבי אימון הציבור ברשויות השלטון:
חשיבותו של עקרון זה ביצירת אמון הציבור ברשויות הציבור בכלל ובבתי המשפט בפרט, שכן הוא תורם ליצירתה של מראית פני הליך עשיית הצדק באופן המקדם אמון זה.
בדומה מוצאת פסיקה בעלת חשיבות היסטורית של בית המשפט העליון של ארה"ב את הבסיס לזכות העיון, בין השאר, בצורך לספק את רצונו של אדם "להחזיק עין מפקחת על פעולותיהן של הרשויות הציבוריות.” [1]
אין ספק שתיקים אלה, שבהם הוגשו הבקשות לעיון, הם תיקים בהם יש חשיבות רבה במיוחד בצורך ליצירת אימון הציבור ברשויות הציבור בכלל ובבתי המשפט בפרט.
  1. פסק הדין בעתירת האגודה מוצא צורך לאזן בין זכות העיון לבין זכות הפרטיות. אולם המשיבים על הבקשה לעיון לא טענו להימצאות זכות הפרטיות בתיקים אלה, ולטענת המבקש זכות הפרטיות אינה קיימת בתיקים אלה - לא למשיב אולמרט, ובוודאי שלא למשיבה מדינת ישראל. במידה שקיימת זכות הפרטיות לגבי מידע כלשהו בכתבים, מן הראוי שבית המשפט יורה על השחרת מידע זה לפני העמדתו לעיון המבקש.
לפיכך, מן הדין והצדק שבית המשפט יתיר את העיון המבוקש בתיק זה.
