11-07-04 Corruption of the Courts and the Legal Profession: Rabbi Lerner and Professor Chomsky - Lone Voices in the Roaring Silence of the Jewish Community

The Jewish community is vastly over-represented among attorneys and judges. It should assume accountability for corruption of the courts and the legal profession and renew its commitment to Civil Rights. Rabbi Michael Lerner and Professor Noam Chomsky have so far been the only ones, who agreed to opine -  on Jewish ethics and computer science, respectively.

Los Angeles, July 4 -  a series of figures in the Jewish community and leaders of Jewish institutions has been approached by Joseph Zernik, PhD, of Human Rights Alert (NGO) with questions related to corruption of the courts and the legal profession.
 
So far only two have responded:

• Rabbi Michael Lerner of Tikkun Magazine - regarding ethics duties of the Los Angeles Jewish Federation and Bet Tzedek, whose current and former leaders: Sandor Samuels, David Pasternak, and Terry Friedman, are involved racketeering in the courts, [[i],[ii],[iii],[iv]] and
• Professor Noam Chomsky of MIT - regarding computer systems of the courts, which were opined by Dr Zernik as large-scale fraud on the People.

Corruption of the courts is central to the ongoing financial crisis
                                

In his communications with the ADL, Dr Zernik repeatedly opined and presented evidence of racketeering by current and former leaders of Bet Tzedek - the Los Angeles "House of Justice" - a prominent Los Angeles Jewish charity and an affiliate of the Greater Los Angeles Jewish Federation:

• Sandor Samuels is a central figure in the current financial crisis.  "Samuels played a key part in one of the biggest frauds in history against homeowners, against shareholders, and against the US Treasury," says Zernik, "Widespread bribing of state and US judges by Countrywide and Bank of America must be a serious concern." [[xvi],[xvii]]  Regardless, Samuels serves as President of Bet Tzedek, and on the board of Los Angeles Jewish institutions. 
• David Pasternak is a central figure in corruption of the Los Angeles courts in real estate matters.  Complaint pertaining to racketeering by Pasternak and the Los Angeles Superior Court has recently been posted by the International Criminal Bar. [[xviii]]  Regardless, Pasternak as well served as President of Bet Tzedek and member of its board.

"The roaring silence of the ADL regarding corruption of the Los Angeles Jewish-legal community is particularly surprising," says Zernik "They are not gun shy..."

The US is in the midst of a constitutional crisis
"Corruption of the courts has reached the level of a constitutional crisis, the like of which has not been seen since the Civil War," says Dr Zernik, "The People are deprived of life, liberty, and property with no due process of law.  The Jewish community should renew its commitment to the Civil Rights movement and carefully examine the conduct of its own leaders and institutions." Corruption of the courts in the United States has reached the level of a constitutional crisis, the like of which has not been seen since the Civil War. The People are deprived of life, liberty, and property with no due process of law. The United States Congress should perform its duties.

       

Los Angeles, July 2 – request was filed with the US Congress for impeachment of  US Judge George A O’Tool and Clerk Sarah Allison Thornton, both of the US District Court, District of Massachusetts. [[i]] The request was forwarded to Congressman Bachus, Chair of the House Rules Committee, Senator Leahy, Chair of the Senate Judiciary Committee, and Congressman Smith, Chair of the House Judiciary Committee.

The request pertained to conduct of Judge O’Tool and Clerk Thornton in litigation of McGarry v Geriatric Facilities of Cape Code, Inc et al (1:10-cv-11343).  Laura McGarry, a disabled nurse, filed complaint pursuant to the Americans with Disabilities Act, in effort to protect her rights.  Dr Zernik provided the US Congress with evidence that Judge O’Tool, Clerk Thornton, attorneys for defendant (Jackson Lewis, LLP), and others subjected Ms McGarry to simulated litigation.  The court published online records, which the court itself deemed void, but Ms McGarry was lead to believe were valid court minutes, orders, and authentication records. [[ii]]

The request alleged that conduct of US Judge O’Tool and Clerk Thornton amounted to various violations of the US law, including, but not limited to: Denial of Access to the Courts; Deprivation of Rights under the Color of Law; Adulteration of court records; Fraud on the court, and/or Racketeering.

The conduct, documented in the request for impeachment of O’Tool and Thornton, has also been documented in other US courts from coast to coast. [[iii]] It is enabled through large-scale fraud in PACER and CM/ECF, the electronic record systems of the US courts. [[iv]] The beneficiaries are financial institutions, large corporations, and government officials, while individuals are deprived of their rights.

Accordingly, Dr Zernik has repeatedly asked that the US Congress initiate corrective actions to safeguard the integrity of the electronic records of the US courts.

Dr Zernik claims that corruption of the US courts is a central cause of the current financial crisis, which is often overlooked. “It undermines any prospect of effective banking regulation,” he says.

“Corruption of the courts has reached the level of a constitutional crisis, the like of which has not been seen since the Civil War,” says Dr Zernik, “The People are deprived of life, liberty, and property with no due process of law.” [[v]]

Sacramento – Senator Loni Hancock (D-Oakland) will introduce legislation on Monday, June 27th, to replace the death penalty in California with permanent imprisonment and to convert death penalty sentences to life imprisonment with no possibility of parole.

Hancock is chair of the Senate Public Safety Committee and the Senate Budget Subcommittee on Corrections, which oversees all funding for the prison system.

Hancock will amend one of her existing bills, SB 490, on Monday, June 27th, and turn it into the vehicle for carrying her death penalty legislation.  The "new" bill will be printed and available on Tuesday, June 28th.  It is expected to have its first hearing in the Assembly Public Safety Committee on Tuesday, July 5th, at 9:30 AM.

Senator Hancock’s legislation will be written as a statutory change to the law that will require both the Governor's signature and approval by voters in a Legislature-sponsored initiative that would be put on the November 2012 ballot.

“Capital punishment is an expensive failure and an example of the dysfunction of our prisons,” Hancock stated. “California's death row is the largest and most costly in the United States.  It is not helping to protect our state; it is helping to bankrupt us.”

Hancock announced her legislation after the Los Angeles Times reported last week on a new study that highlights the exorbitant cost of maintaining the death penalty.  The study projects that the cost of maintaining the death penalty will rise to $9 billion by 2030.  The study reports that taxpayers have already spent more than $4 billion on only 13 executions since the death penalty was reinstated in 1978.

The report, "Executing the Will of the Voters: A Roadmap to Mend or End the California Legislature's Multi-Billion-Dollar Death Penalty Debacle," was written by U.S. 9th Circuit Judge Arthur L. Alarcon, a former prosecutor, and Loyola Law School professor Paula M. Mitchell.   It will be published this week in the Loyola of Los Angeles
Law Review.

According to Senator Hancock, “Study after study has shown that capital punishment as a penalty is not a deterrent and that the multiple appeals that drag on for years and years multiply costs and add to the uncertainty and anxiety of victims.   The death penalty failings cannot be fixed; it must be repealed.  Distinguished prosecutors such as Los Angeles County’s long-time DA Gil Garcetti have come out against it.  It is time for the Legislature to act.”

Senator Hancock added, “It is not simply a cost issue.  More than a dozen people were wrongly executed in Illinois before that state banned the death penalty earlier this year.  I don’t want to see that kind of tragic statistic in California.  We need to join Illinois and the 15 other states that have chosen to substitute life imprisonment without the possibility of parole for a failed death penalty.” 

“Today we’re not tough on crime; we’re tough on the taxpayer.  Every time we spend money on failed policies like the death penalty, we drain money from having more police officers on the street, more job training, more education, more of the things that would truly make for safer communities.
