Los Angeles, April 18 amended papers, [1] served by Dr Joseph Zernik, Los Angeles County resident and founder of Human Rights Alert, provided conclusive evidence of wrongdoing against Dr Richard Fine by Judge David Yaffe, the Los Angeles Superior Court, and the Sheriff. The papers included declaration by Dr Zernik regarding his April 16, 2009 search of the microfilm judgment archive of the Los Angeles Superior Court, [2] where the March 4, 2009 Judgment of Contempt re: Fine was not found as an entered judgment. The false and deliberately misleading Judgment record (Dkt #16-2) was represented on behalf of Judge Yaffe and the Superior Court as the foundation for Fines imprisonment in the Habeas Corpus petition at the US District Court, LA Fine v Sheriff (2:09-cv-01914).
An October 28, 2009 letter [3] by Court Counsel Frederick Bennett to Dr Zernik claimed that the microfilm judgment archive served, since 1974, as the effective Book of Judgment at the Los Angeles Superior Court. Entry of any judgment of the Court into a Book of Judgment was required by California law to make the judgment effectual for any purpose.
The Court Counsels letter came in response to a series of September-October 2009 letters, [4] in which Dr Zernik noticed the Los Angeles Superior Court Presiding Judge Charles McCoy, and Clerk of the Court John A Clarke, of alleged widespread wrongdoing in the operations of the Los Angeles Superior Court. Already in 2008 complaint filed with FBI and then US Attorney General Michael Mukasey, Dr Zernik alleged that a key to enabling alleged widespread perversion of justice at the Los Angeles Superior Court was the failure of the Court, for over a quarter century to publish honest Local Rules of Court, in which the Due Process procedures employed by the Court for Entry of Judgment were explicitly and honestly stated.
In his October 2009 notices to Presiding Judge McCoy, Dr Zernik provided a list of cases as examples of the alleged wrongdoing. The false March 4, 2009 Judgment for Contempt RE: Fine in Marina v LA County (BS109420) was alleged as an instrument for the perpetration of false imprisonment on Fine. Also listed were two false Judgments by Justice James A Richman in Sturgeon v Los Angeles County (BC351286) - a case that held in the balance the prospect of any future honest court services in Los Angeles County for years to come. Two other cases were listed - Galdjie v Darwish (SC052737) and Samaan v Zernik (SC087400) in which false judgments were instruments for opined or alleged real estate fraud by judges and attorneys under the guise of civil litigations.
In his 2009 notices, Dr Zernik requested that Presiding Judge McCoy initiate corrective actions, including, but not limited to the disclosure of the true Local Rules of Court in re: Entry of Judgment, and publication of such rules, as required by law.
The October 28, 2009 response by Court Counsel Bennett claimed that the entry in the microfilm judgment archive substituted since 1974 the use of the traditional paper-based Books of Judgments. However, to this date, the Local Rules of Court were never updated to reflect such key procedures.
In the April 16, 2010 visit to the Courts microfilm judgment archives, [2] a total of nine judgments and/or appealable orders were searched from the cases which were listed in Dr Zerniks 2009 letters. The searches were conducted by a clerk offices staff member and the supervisor of the judgment microfilm archive in Dr Zerniks presence. Only one of the nine records was found entered in the microfilm records June 2, 2008 Judgment by Judge David Yaffe in Marina v LA County (BS109420) pertaining to the petition for injunction regarding development in Marina del Rey. None of the other records was found entered in the microfilm judgment archives of the Court.
Such findings provided conclusive evidence that there was no valid and effectual record to provide the legal foundation for the holding of Fine by the Sheriff. Therefore, Zernik requested in his papers that the US Supreme Court find that Fine was entitled to his immediate release.
The corruption alleged by Dr Zernik extended far beyond the Los Angeles Superior Court. The cases, which were subject of Dr Zerniks investigation, involved actions by California Courts of Appeals. Such appeals from judgments, which had never been entered, was alleged as founded in fraud as well. Moreover, Dr Zernik noted that in review of the public access systems of the California Court of Appeals, none of the Districts provided any field for recording the Date of Entry of Judgment data, which was critical for establishing the validity and timeliness of any appeal. Furthermore, Dr Zernik noted, that California Chief1 Justice Ronald George served in various leadership positions in the Los Angeles County Superior Court during the years in which the Court failed to publish honest Local Rules of Court pertaining to Entry of Judgment.
Accordingly, in papers submitted on April 18, 2010 on behalf of Human Rights Alert to the United Nations and the US State Department, [5] widespread corruption and racketeering in the justice system were alleged as the cause of widespread abuse of the Human Rights of the 10 million residents of Los Angeles County, California. Dr Zernik called for international monitoring of the California and the US justice systems. Absent international monitoring, Dr Zernik opined that it was unlikely that any improvement would be likely in the justice system and the Human Rights conditions of the people of Los Angeles County, California. Dr Zerniks submission was part of the pending November 2010 first ever review of the Human Rights record of the US by the United Nations.
The case of Fine v Sheriff (09-A827) is scheduled for conference of the US Supreme Court on April 23, 2010.

Los Angeles, April 19 – Human Rights Alert, Los Angeles County, California based NGO, filed its submission [1] [2] for the first ever UPR (Universal Periodic Review) of the Human Rights record of the United States by the United Nations. The report alleged serious Human Rights violations in Los Angeles County, the hallmark of which are large scale false imprisonments – including, but not limited to: (1)The Rampart FIPs – thousands of victims of the Rampart corruption scandal (1998-2000), which were left falsely imprisoned to this date; (2) Numerous inmate held under record that are blatantly false and misleading by the Los Angeles County Sheriff’s Department, and (3) Attorney Richard Fine – held for over a year in solitary confinement in a case where no warrant was ever issued for the arrest, and no judgment, conviction, or sentencing was ever entered by the court. The other hallmark of alleged Human Rights violations in Los Angeles County involved real estate fraud cases by the Court. Combined, the report alleged racketeering by the judges of the Los Angeles Superior Court, which is patronized by US agencies, which discriminated against the region of Los Angeles County, California, effectively treating it as an extra-constitutional zone.
The report highlights the central role of unvalidated case management systems (CMSs) and online public access systems in the precipitous deterioration of integrity in state and US courts, in jails, and in financial institutions. The report called upon the international community and the US to establish goals and time frames for enforcement of the law on the courts and the justice system itself, through publicly accountable validation (certified functional logic verification). International monitoring of the US justice system was called for, as essential for stopping the deterioration of Human Rights conditions in the US.

Los Angeles, Arpil 15 – in Motion to Intervene, [1] filed with the US Supreme Court in Fine v Sheriff (09-A827) Joseph Zernik, Los Angeles resident and founder of Human Rights Alert, alleged that Dr Richard Fine, political dissident, is falsely imprisoned for over a year in Los Angeles County jail, with no valid record to provide the foundation for the imprisonment that conformed with the fundamental requirements of the law. According to standards established in Fay v Noia (1963) by the late William Brennan Jr, under such circumstances, the prisoner is entitled to his immediate release. Dr Zernik further claimed that the same is true for numerous other prisoners held by the Los Angeles Sheriff. However, the Sheriff’s Department created a false online system – Inmate Information System, which purported to show that such persons were lawfully held. Dr Zernik further claimed that the fraud in case management systems (CMSs) is a critical flaw in the justice system today. The Los Angeles Superior Court (LASC) was an extreme example. It was alleged to run full cases that were fraud from start to finish, and were not deemed court cases by the court itself, but were represented as such online. A critical violation of the law claimed by Dr Zernik was in the refusal of the LASC to allow public access to its Index of Judgments. Such conditions opened the way to large-scale fraud by the judges of the court, which was alleged as amounting to racketeering. The CMS of the US courts, CM/ECF and the matching public access system – PACER were likewise alleged as failing to comply with the law: In no US court that was examined were such systems established in the local rules of courts, as required by law, and in all cases that were examined, public access was denied to critical authentication records – NEFs (Notices of Electronic Filings) in the US district courts, and NDAs (Notices of Docket Activity) in the US courts of appeals. Under such compromised integrity in the courts, large financial corporations and large law firms were allowed by the courts to engage in alleged racketeering. The prime example in the filing involved Bank of America Corporation (BAC), Brian Moynihan – its president, and Bryan Cave, LLP, which was and is employed by BAC to perpetrate the alleged racketeering at the courts in Los Angeles.
Dr Richard Fine, former US prosecutor, has been held in a hospital room under solitary confinement, purportedly for contempt, for over a year. The case is scheduled for conference of the Justices of the US Supreme Court on April 23, 2010.

Los Angeles, April 13 – in letter to five committee chairs, Dr Joseph Zernik, Los Angeles County resident and founder of Human Rights Alert, requested that the chairs join the Hon Dianne Feinstein, US Senator from California, in inquiries on US agencies – US Department of Justice Inspector General (DOJ-IG), Glenn A Fine, and Office of Comptroller of the Currency (OCC) – John Dugan, why such agencies would not respond on complaints by Dr Zernik, which alleged racketeering by Bank of America Corporation and Brian Moynihan at the Los Angeles Superior Court, and cover up through fraud on US Congress by FBI and US Department of Justice senior officers.
The complaint against Bank of America Corporation and Brian Moynihan was originally filed with OCC in late September 2009. Initial response was filed by the office of Brian Moynihan – BofA President in January 2010, which was alleged as fraud and part of a pattern of racketeering activity by Bank of America and Brian Moynihan in a follow-up complaint. Inquiry by Senator Feinstein on OCC was filed on January 15, 2010. [1] Response by the OCC to Senator Feinstein is still pending.
The complaint against Kenneth Kaiser – FBI Assistant Director for Criminal Investigations, and Kenneth Melson – US DOJ then Director of Attorneys Office, was originally filed with DOJ-IG in later November 2009, and again in early December 2009. The complaint originated from responses provided by the two senior US-DOJ officers to US Congress previous inquiries – by Senator Feinstein and Congresswoman Diane Watson, why they would not respond on a complaint by Dr Zernik, which alleged racketeering by judges of the Los Angeles Superior Court, and failure of US to provide Equal Protection for the 10 million county residents. The by Kaiser and Melson were alleged as fraud on US Congress and deliberate disregard for the Human, Constitutional, and Civil Rights of the 10 million residents of LA County. Inquiry by Senator Feinstein on DOJ-IG was filed on February 26, 2010. [2] Response by DOJ-IG is still pending.
Five committee chairs were requested to join Senator Feinstein in her inquiries on OCC and US DOJ-IG: Representative Barney Frank and Christopher Dodd - Chairs of the House Financial Services/ Senate Banking Committees, Representative John Conyers and Senator Patrick Leahy - Chairs of the House and Senate Judiciary Committees, and Senator Carl Levine – Chair of the Senate Subcommittee on Investigations. The conduct of financial institutions and the courts detailed in the complaints was claimed as the true underlying cause of the current credit crisis, which was founded in criminality, and the conduct of US agencies was alleged as part of the ongoing cover-up.
