יש לתהות מה עומק השחיתות בבית המשפט העליון, בו ישבה "מזכירה ראשית" ללא כתב מינוי במשך יותר מ-10 שנים...

מאהל המחאה, ת"א, 11 לדצמבר -  דר' יוסף צרניק, מ"סייג לזכויות האדם" הגיש בקשה לנשא בית המשפט העליון אשר גרוניס, להציג את כתבי מינויו של "ראש מדור בלתי מיוצגים" בבית המשפט העליון, עו"ד דני בן טובים. [1]

הבקשה אומרת: "בשנים האחרונות, פעל עו"ד דני בן-טובים כבעל סמכות לקבל לרישום, או לדחות מרישום את הכתבים, שהיגשתי לבית המשפט העליון.  לפיכך, אבקש העתק של כתב מינויו כבעל סמכות מזכירותית בבית המשפט העליון, לחילופין – מראה מקום מדוייק ברשומות למינוי זה."

בקשה דומה הוגשה לעו"ד דני בן-טובים עצמו.

הבקשה לכתב מינויו של עו"ד בן טובים, באה בעקבות סדרת בקשות לכתב מינויה של "מזכירה ראשית" של בית המשפט העליון שרה ליפשיץ, שבסופן התברר שמעולם לא מונתה כדין לתפקידה. הגברת ליפשיץ ישבה במשרדה למעלה מ-10 שנים ללא סמכות חוקית.  תלונה פלילית על התחזות והונאה, שהוגשה למשטרת ישראל, תיעדה גם שהנפיקה אישורים כוזבים של החלטות בית המשפט העליון.  [2]  

תלונה על הונאה הוגשה גם נגד השופט אשר גרוניס, על חלקו בעניין. [3]

לאחר הגשת התלונות נגד הגב' ליפשיץ והשופט גרוניס, "פרשה" הגברת ליפשיץ מבית המשפט העליון, וכיום אין בו מזכיר ראשי כלל. [4]

יש מקום לחשש לשחיתות רחבת מימדים בבית המשפט העליון. תפקידו של עו"ד בן טובים במסגרת זאת היא ככל הנראה למנוע את גישתם של בלתי מיוצגים למשפט הוגן בבית המשפט העליון.

Occupy Tel-Aviv, December 11 - Joseph Zernik, PhD, of Human Rights Alert (NGO) filed a request with Presiding Justice Asher Grunis to present the appointment record of "Pro Se Section Head" in the Supreme Court, Attorney Danny Ben-Tovim. l1]

The request says: "Over the past several years, Attorney Ben Tovim acted as a person, who was authorized to accept for registration, or reject from registration the papers, which I filed in the Supreme Court.   Therefore, I request that you provide me a copy of Attorney Ben Tovim's appointment record as an authorized clerk; alternatively – exact reference to his appointment, as published in the official Register of the State of Israel."

Similar request was filed with Attorney Ben-Tovim himself.

The request for Attorney Ben-Tovim's appointment record followed a series of requests for the appointment record of "Chief Clerk" of the Supreme Court, Ms Sarah Lifschitz, at the end of which it became apparent that she had never been duly appointed.  Ms Lifschitz sat in the office of the Chief Clerk for over 10 years, and a criminal fraud complaint, filed with the Israel Police, documented that she issued false certifications of Supreme Court decisions. Criminal fraud complaint was filed against Jutice Grunis as well, for his part in the affair. [3]

Following the filing of the criminal complaints, Ms LIfschitz "departed" from the Supreme Court, and today, there is no Chief Clerk in the Supreme Court at all. [4]

There is a good cause to suspect widespread corruption in the Supreme Court.  Within such system, Mr Ben Tovim's role was probably to deny access to the Supreme Court and to Fair Hearing to pro se filers.
