In the criminal prosecution of Tax Authority whistle-blower Rafi Rotem, Defendant is denied access to the Public Defender's records, and in particular to the appointment records ׂ(if they exist at all) of his purported outside "Public Defenders"... The most plausible explanation is false appearance of unauthorized outside "Public Defenders" and perversion of justice in collusion with Judge Yael Pradelsky and the Police Prosecution. Conduct of the State Prosecution in the Zadorov's murder conviction was "scary", but the collusion of a Judge, Police Prosecution, and "Public Defenders" in the persecution of Rotem is even scarier... and the same District Public Defender was also in charge of representing both Rotem and Zadorov... Attorney Elkana Leist...
 
Whistle-blower Rafi Rotem in one of the numerous false arrests by the Tel-Aviv Police, now prosecuting him for "insulting policemen"; the conviction of Roman Zadorov in the murder of 13-year-old Tair Rada is doubted even by the victim's parents...

OccupyTLV, November 24 - following is an update regarding the criminal prosecution of whistle-blower Rafi Rotem on 19 counts of "offending public service employee" and "abuse of telecom lines". Previous summary of the case noted, "mounting evidence of Fraud Upon the Court in the criminal prosecution of Israeli whistle-blower Rotem". [1] 
At that time, Rotem asked to inspect the Public Defender's file in his case, since he had received no due notice of appointment of the three outside attorneys, who purported to represent him in court as "Public Defenders".  Such "Public Defenders" failed to file any papers in a year and a half of litigation, except for requests for changing hearing dates...  and also failed to obtain the evidence material from the Police Prosecution, although it was electronically linked to the court file a long time ago... 
The same attorneys also failed to file their Certificates of Appointment in court, while Judge Pradelsky failed to comply with provisions of the law, among others - relative to the appointment and replacement of Public Defenders in a criminal prosecution.
Update:
  • On November 13, 2014, Tel-Aviv District Pro tem Public Defender Attorney Elekana Leist met Rotem, at Leist's initiative, for reasons that were not clarified to Rotem in advance. During the meeting, Rotem hand-delivered to Leist a request for a written meeting summary. [2] According to Rotem, Leist refused to sign a copy of the request, "Received". No response has been received from Leist to this date either. On November 24, 2014, a repeat request was forwarded by Rotem to the Tel-Aviv Pro-tem District Public Defender Elkana Leist for a written summary of the November 13, 2014 meeting. [3]
  • Requests for access to the Public Defender's file records, including, in particular, the appointment records of the purported outside Public Defenders, were first sent on November 5, 2014, to both Tel-Aviv Pro-tem District Public Defender Elkana Leist and National Public Defender Yoav Sapir .  No response has been received to this date.  Repeat requests were sent on November 24, 2014 to both the Tel-Aviv District Pro tem Public Defender Attorney Elekana Leist and the National Public Defender Yoav Sapir. There is no reasonable explanation for the conduct so far of the outside purproted "Public Defenders", the Tel-Aviv Pro-tem Public Defender Elkana Leist and the National Public Defender Yoav Sapir, which is consistent with honesty. 
The most plausible explanation for the conduct of the outside purproted "Public Defenders" is false appearance of unauthorized outside "Public Defenders", as part of perversion of justice, fraud upon the court, and breach of loyalty in collusion with both the District and National Public Defenders.
Such conduct is part of the overall conduct in this litigation, where Police Prosecution filed indictment, which defied the fundamental of justice, given the circumstances of the case, and where Judge Yael Pradelsky routinely disregards the fundamental provisions of the Criminal Court Procedure Act. [1]
Combined, such prosecution amounts to persecution of a whistle-blower, who exposed corruption leading to the highest offices of govedrnment in Israel, including Prime Minister Netanyahu. [6,7]
But beyond corruption in the Tax Authority, the case has by now produced unique evidence of the deep corruption of the Israeli justice system today.
Regarding the conviction of Roman Zadorov in the murder of of 13-year-old Tair Rada, Law Professor Menny Mautner wrote, "conduct of the State Prosecution in the Zadorov case is scary". [8]
Conduct of the Judge, the Police Prosecution, and in particular the Public Defender's office in the Rotem case is even scarier... 
And it is the same District Public Defender, who is in charge of representing both Rotem and Zadorov - Attorney Elkana Leist...

בתביעה הפלילית המתנהלת נגד חושף השחיתויות ברשות המסים רפי רותם, נמנעת מהנאשם הגישה לתיק הסנגוריה הציבורית, ובמיוחד לכתבי המינוי (אם הם קיימים בכלל) של אלה שהופיעו כסנגוריו כביכול. ההסבר ההגיוני הפשוט ביותר להתנהלות זאת הוא הונאה, שבבסיסה הופעת עורכי דין חיצוניים כסנגורים למראית עין ושיבוש הליכי משפט תוך שיתוף פעולה עם התביעה המשטרתית והשופטת יעל פרדלסקי.  התנהלותה של התביעה בתיק זדורוב הייתה "מפחידה", אולם התנהלותם של השופטת, התביעה המשטרתית, והסנגוריה הציבורית בתיק רותם מפחידה עוד יותר... ואותו סנגור ציבורי מחוזי - עו"ד אלקנה לייסט - אחראי הן על ייצוגו של רותם והן על ייצוגו של זדורוב...   
 
חושף השחיתויות ברשות המסים רפי רותם באחד ממעצרי השווא הרבים על ידי משטרת ת"א, התובעת אותו עכשיו על "העלבת עובדי ציבור"; אפילו הוריה של תאיר ראדה בת ה-13, מפקפקים בהרשעתו של רומן זדורוב ברצח.

מאהל המחאה ת"א, 24 לנובמבר - להלן עדכון למהלך התביעה הפלילית נגד חושף השחיתויות ברשות המסים רפי רותם בבית המשפט השלום ת"א על 19 סעיפי אישום של "העלבת עובד ציבור" ו"שימוש לרעה במתקן בזק".
סיכום קודם בתחילת החודש תיאר "ראיות למכביר לשיבוש הליכים והונאה בבית המשפט בתביעה הפלילית נגד רפי רותם". [1] אז ביקש רותם לעיין בתיק הסנגוריה הציבורית בתביעה זאת, כיוון שמעולם לא קיבל הודעות כדין על מינוי שלושה עורכי דין, שהופיעו כסנגוריו הציבוריים כביכול בתיק זה.  "סנגורים ציבוריים" אלה לא הגישו במשך שנה וחצי אף כתב בקשה או תגובה, פרט לבקשות לשינוי מועדי דיון... הם גם כשלו מלקבל את חומר הראיות מהתביעה המשטרתית עד היום, למרות שקישורים אלקטרוניים לחומר הראיות מופיעים בתיק בית המשפט כבר מזמן...
אותם "סנגורים ציבוריים" גם לא הגישו את כתבי המינוי כדין לבית המשפט, והשופטת יעל פרדלסקי כשלה בשנה וחצי האחרונות מלקיים את הוראות חוק סדר הדין הפלילי, בין השאר - לגבי מינויים והחלפתם של סנגורים ציבוריים בהליכים פליליים...
עדכונים:
  • ביום 13 לנובמבר, 2014, נפגש הסנגור הציבורי המחוזי (בפועל) ת"א, עו"ד אלקנה לייסט עם  רותם, ביזמתו של לייסט, מסיבות שלא הובהרו לרותם קודם לפגישה. בזמן הפגישה עצמה, הגיש רותם ללייסט בקשה לקבלת סיכום בכתב של הפגישה. [2] על פי דבריו של רותם, סירב עו"ד לייסט לחתום, "התקבל", על העתק הבקשה לסיכום הפגישה בכתב...  כל תגובה על בקשה זאת גם לא התקבלה מלייסט עד היום. ביום 24 לנובמבר, נשלחה בקשתו החוזרת של רותם ללייסט לקבלת סיכום הפגישה בכתב.   • בקשותיו של רותם לעיין בתיק הסנגוריה הציבורית בתביעה זאת, ובמיוחד בכתבי המינוי (אם הם קיימים בכלל) של עורכי הדין שהופיעו כסנגוריו הציבוריים כביכול, נשלחו לראשונה לסנגור הציבורי הארצי יואב ספיר ולסנגור הציבורי המחוזי (בפועל) ת"א אלקנה לייסט ביום 5 לנובמבר, 2014.  כל תגובה על בקשות אלה לא התקבלה עד היום. בקשות חוזרות נשלחו ביום 24 לנובמבר לסנגור הציבורי הארצי יואב ספיר ולסנגור הציבורי המחוזי (בפועל) ת"א אלקנה לייסט. ההסבר ההגיוני הפשוט להתנהלותם של ה"סנגורים הציבוריים" כביכול, הוא הונאה שבסיסה בהופעת עורכי דין ללא סמכות כלל, כחלק משיבוש הליכים, הונאה בבית המשפט והפרת אימונים, תוך שותפות עם הסנגור הציבורי הארצי יואב ספיר, והסנגור הציבורי המחוזי (בפועל) ת"א אלקנה לייסט. התביעה המשטרתית, מצידה, הגישה בתיק זה כתב אישום הנוגד תחת הנסיבות את יסודות הצדק והשכל הישר, והשופטת יעל פרדלסקי מתעלמת באופן שיטתי מהוראות חוק סדר הדין הפלילי... [1]
בכללם, יש לראות בהליכים הפליליים נגד רותם חלק מרדיפתו של חושף שחיתויות ברשות המסים. הפרשיות שחשף רותם מגיעות הישר ל"חלונות הגבוהים" של הממשלה, ובכללם לראש הממשלה בנימין נתניהו. [6,7]
אולם מעבר לשחיתות ברשות המסים, התביעה הפלילית נגד רותם ייצרה ראיות חסרות תקדים לשחיתות העמוקה של מערכת המשפט בישראל היום.  
לגבי הרשעתו של רומן זדורוב ברצח הילדה תאיר רדה, כתב פרופ' מני מאוטנר "ההתנהלות של הפרקליטות בתיק זדורוב מפחידה". [8]  התנהלותם של השופטת יעל פרדלסקי, התביעה המשטרתית, ובמיוחד הסנגוריה הציבורית בתיק רפי רותם מפחידה עוד יותר...  
ואותו הסנגור הציבורי המחוזי אחראי הן על ייצוגו של זדורוב והן על ייצוגו של רותם - עו"ד אלקנה לייסט...
