2015-06-20 Summing up responses to my presentation in the Portsmouth conference - ECEG2015 III

Georgio Agamben - contemporary superstar  in European legal philosophy
פרופסור למשפטים מאוניברסיטה נחשבת באנגליה ניסה להתאים את מה שאני מתאר לפילוסופיה של המשפט על הציר בין:
A. RULE OF LAW
B. REALISTIC LEGAL PHILOSOPHY - in reference to the writing of Agamben
אני אמרתי שמה שאני מתאר נופל לחלוטין מחוץ לסקאלה זאת, והוא בתחום של:
DEPRIVATION OF RIGHTS UNDER THE COLOR OF LAW.
הטיעון שלי הוא שהפילוסופיות הנ"ל עוסקות בשופטים המאמינים שהם ממלאים את תפקידם באמונה, ורוב המשקיפים, גם אם הם נוטים לצד זה או אחר, יראו את התנהלות השופטים כנורמטיבית .
ההתנהלות שאני מתאר היא הצגה הונאתית במכוון, המנצלת את בית המשפט וחזות שלטון החוק למטרות הנוגדות את החוק.  למעשה, זאת התנהלות פלילית של שופטים, שאין לה כל חסינות.  התנהלות זאת נחשבת להתנהלות חוץ-שיפוטית ( extra-judicial conduct).

Law professor from a highly ranked UK university tried to fit my findings regarding the israeli courts to legal philosophy theories on the scale between:
 
A. RULE OF LAW
B. REALISTIC LEGAL PHILOSOPHY - in reference to the writing of Agamben

I said that what I am describing falls entirely outside such scale, and is in the realm of:
DEPRIVATION OF RIGHTS UNDER THE COLOR OF LAW.

My argument is that the philosophies of law, which he quoted, describe judges, which engage in normative, or lawful conduct.  The conduct that I am describing is in fact criminal, and isn't covered by any immunity either, since it is considered "extra-judicial conduct".
