Chief Justice John Roberts Asked to Secure Integrity of Supreme Court Docket in the Case of Falsely Imprisoned Former US Prosecutor Richard Fine

Los Angeles, April 21- in notice to Deputy Clerk of the US Supreme Court Gary Kemp, Dr Joseph Zernik, Los Angeles County resident and founder of Human Rights Alert, asked that Chief Justice Robert act pursuant to the Code of Conduct of US Judges, and secure the integrity of US Supreme Court docket in Application of Fine v Sheriff (09-A827). The application was submitted on March 30, 2010 to Associate Justice Ruth Ginsburg, and is scheduled for conference on April 23, 2010. The request came following failure of Dr Zerniks filings in the case, received by the Court on April 20, [1] to appear on the docket.  On April 21, 2010 Mr Danny Bickell, clerks office staff counsel consented that he held Dr Zerniks filings in his hands, but refused to state whether the filing of the papers, or even their rejection would be listed on the docket.  Mr Bickell stated that he was not Deputy Clerk by authority, nevertheless indicated that he would make the determinations in the matter.
The delays by Mr Danny Bickell of notation in the docket of either the filing, or rejection of the filing of Dr Zerniks papers received by the Supreme Court on April 20 were particularly alarming, since one of Dr Zerniks filings was a Request for Correction of Supreme Court records, pertaining to Mr Bickells previous transactions in the case.  The correction request pertained to the original submission of the Application by Richard Fine to Associate Justice Anthony Kennedy, which was noticed by Mr Danny Bickell to the parties as "denied" by Justice Kennedy on March 12, 2010, and was also listed as "denied" in the Courts docket,
[2] albeit  an unverified court record.  In contrast, the listing of orders and rulings of the US Supreme Court showed no such ruling or order on or about March 12, 2010. [3]  Moreover, although the Rule 22(3) of the US Supreme Court explicitly state "a Justice denying an application will note the denial thereon", a copy of the Application, obtained from the US Supreme Court file on March 22, 2010, failed to show any such note by Justice Kennedy on the Application. [4] In a phone call on April 21, 2010, Mr Danny Bickell refused to provide any explanation for such discrepancies in the US Supreme Court records, or the basis for his notice to parties in the case of a March 12, 2010 denial by Justice Kennedy.
Moreover, the core of the claims in April 20, 2010 papers filed by Dr Zernik was of dishonesty in docketing in other justice system agencies in the case of Richard Fine:
[5]

  • The Los Angeles County Sheriffs Department employed unverified and unvalidated online public access system (OPAS) and unvalidated case management system (CMS) to present the false pretense that Richard Fine (1824367) was arrested and booked at and by the authority of the non-existent Municipal Court of San Pedro.
  • The Los Angeles Superior Court, where Mr Fine was in fact arrested, likewise employed unverified and unvalidated  OPAS and unvalidated CMS, to present the false pretense of a March 4, 2009 Judgment for Contempt against Richard Fine in Marina v LA County (BS109420).  In fact, such March 4, 2009 Judgment was never adequately verified by a judge, was never authenticated, and was never entered by the Los Angeles Superior Court as an honest valid and effectual Court Judgment.
  • The US District Court, Los Angeles, where Mr Fine filed a habeas corpus petition  Fine v Sheriff (2:09-cv-01914), likewise employed unverified and unvalidated  OPAS and unvalidated CMS, to present the false pretense of June 29, 2009 Judgment denying the habeas corpus petition.  In fact, new records (NEFs  - Notices of Electronic Filings) from the US District Court case discovered by Dr Zernik and specifically referenced in his filings with the US Supreme Court, [5] showed that the US District Court never authenticated such June 29, 2009 Judgment and never adequately noticed and served it on Richard Fine.
  • The US Court of Appeals, 9th Circuit, falsely presented a June 30, 2009 Denial of Richard Fines Petition - Fine v Sheriff (09- 71692),  and a February 12, 2010 Mandate from the Appeal - Fine v Sheriff (09- 09-56073)  both were never adequately served, noticed or entered as valid records by the Courts.

Accordingly, Dr Zerniks April 20, 2010 papers filed with the US Supreme Court claimed that there was never any valid record as foundation for the imprisonment of Richard Fine, and that Richard Fine was therefore entitled to his immediate release.
In addition, Dr Zernik requested that the US Supreme Court issue a mandate to lower courts to establish their OPASs and CMSs as validated systems in the Local Rules of Court, as required by law.
Richard Fine has been held in solitary confinement since March 4, 2009. Prior to his imprisonment he had exposed and protested "not permitted" secret payments of about $45,000 per judge per year for over a decade to all Los Angeles Superior Court judges.
[6] During the same period, as Mr Fine had shown, it had become practically impossible to win a case in court against the payer -  Los Angeles County.  On February 20, 2009, less than two weeks prior to Mr Fine's warrantless arrest, the Governor of California signed into law "retroactive immunities" (pardons) for all judges who had taken the "not permitted" payments.
In recent submission to the United Nations, for the 2010 Universal Periodic Review of Human Rights in the United States, Human Rights Alert and Dr Zernik highlighted the role of unverified and unvalidated OPASs and CMSs in the precipitous deterioration of integrity of the US justice system, and pervasive alleged abuses of Human Rights by the US government.  The submission called for international monitoring of the California and US courts.

Der US Court of Appeals, 9th Circuit, ein falsch 30.

The favor of a response within 10 days is requested.

Dear Mr Carrizosa:

I would be grateful for any comments by the California Judicial Council, either before or after April 23, 2010 conference of the US Supreme Court, on the April 19, 2010 press release, copied below.

Specifically, comments are sought regarding:

1)  Failure of Superior Court of California, County of Los Angeles, to operate by published Local Rules of Court in re: Entry of judgment, for over a quarter century, and the ongoing publication - for over a quarter century of false and misleading Local Rules of Court in this regard;

2) Failure of Superior Court of California, County of Los Angeles, to provide any public access, electronic or not, to "books of judgments or equivalents" in any Clerk's Office or Court location, except for the hardly accessible underground central County Archive.

3) Enforcement by the Superior Court of California, County of Los Angeles, of execution of judgments which were never entered in "books of judgments or equivalent" as required by law to make them "effectual for any purpose", particularly in relationship to deprivation of Liberty or the deprivation of the right for possession.

4) Failure of any of the electronic public access systems of California Courts of Appeals to include data in their online dockets of the "Date of Entry of Judgment" in appeals before such courts.

5) Taking and reviewing of appeals by California Courts of Appeals from judgments, which were never entered in "books of judgments or equivalent" as required by law to make them "effectual for any purpose".

Truly,

10-04-19 Definitive New Evidence Produced of Alleged Wrongdoing by Los Angeles Superior Court, Sheriff Against the Falsely Imprisoned Richard Fine // Definitive Neue Beweise für den angeblichen Fehlverhalten von Los Angeles Superior Court Produced, Sheriff gegen die fälschlich Gefangen Richard Fine // Nueva evidencia definitiva Producido de presuntas irregularidades cometidas por el Tribunal Superior de Los Ángeles, el sheriff contra la multa Richard falsamente encarceladas

Los Angeles, April 18 amended papers, [1] served by Dr Joseph Zernik, Los Angeles County resident and founder of Human Rights Alert, provided conclusive evidence of wrongdoing against Dr Richard Fine by Judge David Yaffe, the Los Angeles Superior Court, and the Sheriff.  The papers included declaration by Dr Zernik regarding his April 16, 2009 search of the microfilm judgment archive of the Los Angeles Superior Court, [2] where the March 4, 2009 Judgment of Contempt re: Fine was not found as an entered judgment. The false and deliberately misleading Judgment record (Dkt #16-2) was represented on behalf of Judge Yaffe and the Superior Court as the foundation for Fines imprisonment in the Habeas Corpus petition at the US District Court, LA Fine v Sheriff (2:09-cv-01914).
An October 28, 2009 letter [3] by Court Counsel Frederick Bennett to Dr Zernik claimed that the microfilm judgment archive served, since 1974, as the effective Book of Judgment at the Los Angeles Superior Court.  Entry of any judgment of the Court into a Book of Judgment was required by California law to make the judgment effectual for any purpose.
The Court Counsels letter came in response to a series of September-October 2009 letters, [4] in which Dr Zernik noticed the Los Angeles Superior Court Presiding Judge Charles McCoy, and Clerk of the Court John A Clarke, of alleged widespread wrongdoing in the operations of the Los Angeles Superior Court.  Already in 2008 complaint filed with FBI and then US Attorney General Michael Mukasey, Dr Zernik alleged that a key to enabling alleged widespread perversion of justice at the Los Angeles Superior Court was the failure of the Court, for over a quarter century to publish honest Local Rules of Court, in which the Due Process procedures employed by the Court for Entry of Judgment were explicitly and honestly stated.
In his October 2009 notices to Presiding Judge McCoy, Dr Zernik provided a list of cases as examples of the alleged wrongdoing. The false March 4, 2009 Judgment for Contempt RE: Fine in Marina v LA County (BS109420) was alleged as an instrument for the perpetration of false imprisonment on Fine. Also listed were two false Judgments by Justice James A Richman in Sturgeon v Los Angeles County (BC351286) - a case that held in the balance the prospect of any future honest court services in Los Angeles County for years to come. Two other cases were listed - Galdjie v Darwish (SC052737) and Samaan v Zernik (SC087400) in which false judgments were instruments for opined or alleged real estate fraud by judges and attorneys under the guise of civil litigations.
In his 2009 notices, Dr Zernik requested that Presiding Judge McCoy initiate corrective actions, including, but not limited to the disclosure of the true Local Rules of Court in re: Entry of Judgment, and publication of such rules, as required by law.
The October 28, 2009 response by Court Counsel Bennett claimed that the entry in the microfilm judgment archive substituted since 1974 the use of the traditional paper-based Books of Judgments.  However, to this date, the Local Rules of Court were never updated to reflect such key procedures.
In the April 16, 2010 visit to the Courts microfilm judgment archives, [2] a total of nine judgments and/or appealable orders were searched from the cases which were listed in Dr Zerniks 2009 letters. The searches were conducted by a clerk offices staff member and the supervisor of the judgment microfilm archive in Dr Zerniks presence. Only one of the nine records was found entered in the microfilm records June 2, 2008 Judgment by Judge David Yaffe in Marina v LA County (BS109420) pertaining to the petition for injunction regarding development in Marina del Rey. None of the other records was found entered in the microfilm judgment archives of the Court.
Such findings provided conclusive evidence that there was no valid and effectual record to provide the legal foundation for the holding of Fine by the Sheriff.  Therefore, Zernik requested in his papers that the US Supreme Court find that Fine was entitled to his immediate release.
The corruption alleged by Dr Zernik extended far beyond the Los Angeles Superior Court.  The cases, which were subject of Dr Zerniks investigation, involved actions by California Courts of Appeals.  Such appeals from judgments, which had never been entered, was alleged as founded in fraud as well. Moreover, Dr Zernik noted that in review of the public access systems of the California Court of Appeals, none of the Districts provided any field for recording the Date of Entry of Judgment data, which was critical for establishing the validity and timeliness of any appeal. Furthermore, Dr Zernik noted, that California Chief1 Justice Ronald George served in various leadership positions in the Los Angeles County Superior Court during the years in which the Court failed to publish honest Local Rules of Court pertaining to Entry of Judgment.
Accordingly, in papers submitted on April 18, 2010 on behalf of Human Rights Alert to the United Nations and the US State Department, [5] widespread corruption and racketeering in the justice system were alleged as the cause of widespread abuse of the Human Rights of the 10 million residents of Los Angeles County, California.  Dr Zernik called for international monitoring of the California and the US justice systems. Absent international monitoring, Dr Zernik opined that it was unlikely that any improvement would be likely in the justice system and the Human Rights conditions of the people of Los Angeles County, California. Dr Zerniks submission was part of the pending November 2010 first ever review of the Human Rights record of the US by the United Nations.
The case of Fine v Sheriff (09-A827) is scheduled for conference of the US Supreme Court on April 23, 2010.
