More on habeas corpus: "The basic principle of the Great Writ of habeas corpus is that, in a civilized society... if the imprisonment cannot be shown to conform with the fundamental requirements of law, the individual is entitled to his immediate release".
I am no lawyer, but my understanding of the matter is that Habeas Corpus was not created for lawyers, who graduated from ABA accredited law schools, but for uneducated, mostly illiterate prisoners in the middle ages. Accordingly, the prisoner was not required to argue much at all. He only had to ask to be brought in person before a judge.
In turn, the judge was not required to engage in full appeal of the case. Instead, according to the late William Brennan:

Therefore, it was the duty of Magistrate Carla Woehrle, Judge John Warner, Chief Judge Alex Kozinski and others to note that there was no Warrant, no Judgment, no Sentencing, no Register of Actions (California civil docket) in the Marina v LA County (BS109420), the case in which Richard Fine was purported to be arrested and jailed, and release Richard Fine immediately.
There is no way that a reasonable person, upon review of the records, or lack thereof, would conclude that holding of Richard Fine "conform[ed] with the fundamental requirements of the law".
Therein lies the alleged fraud by Alex Kozinski. In order to conceal the fundamental facts in the matter, which a brilliant jurist such was he was, he could not have missed, he issued an nonsensical order, [1] albeit unsigned and unauthenticated. However, such order, bastardized as it was, was sufficient to create reliance that allowed the continued false hospitalization of Richard Fine.

Yo no soy abogado, pero mi entendimiento de la cuestión es que el hábeas corpus no fue creado para los abogados, que se graduaron en escuelas de derecho acreditadas ABA, pero sin educación, los presos en su mayoría analfabetos en la Edad Media. En consecuencia, el preso no estaba obligada a discutir en absoluto. Sólo tenía que pedir que se llevó en persona ante un juez.
A su vez, el juez no estaba obligado a participar en plena apelación del caso. En cambio, según el difunto William Brennan:
"El principio básico de la Gran Mandamiento de hábeas corpus es que, en una sociedad civilizada ... si la prisión no se puede demostrar que se ajustan a las exigencias fundamentales del Derecho, el individuo tiene derecho a su liberación inmediata". Fay v Noia (1963):
Por lo tanto, es deber de magistrado Carla Woehrle, el juez John Warner, el Juez Alex Kozinski y otros, para señalar que no había orden, ni juicio, sin sentencia, no hay Registro de Acciones (expediente civiles de California) en el Condado de Marina V LA (BS109420), el caso en el que Richard multa que pretendía ser arrestados y encarcelados, y la liberación de Richard Fine inmediatamente. No hay forma de que una persona razonable, al revisar los registros, o su ausencia, a la conclusión de que la celebración de Bellas Richard "cumplir [ía] los requisitos fundamentales de la ley".
Ahí está el presunto fraude por Alex Kozinski. Con el fin de ocultar los hechos fundamentales en la materia, que un jurista brillante como era él, él no podía faltar, se emitió una orden sin sentido, aunque sin firmar y no autenticados. Sin embargo, tal orden, bastardeado como estaba, era suficiente para crear la confianza que permitió a la hospitalización falsa continuación de Richard Fine.
